1. General regulations

1.1 Regulations on Academic Integrity ((hereinafter - Regulations) at National Aerospace University «Kharkiv Aviation Institute» (hereinafter - the University) establish the norms and rules of professional communication and behavior between participants of the educational process at the University regarding issues of academic integrity.

1.2 The Regulations were established in accordance with the Constitution of Ukraine, Laws of Ukraine "On Education", "On Higher Education", On Scientific and Technical Activity", "On Copyright and Related Rights", "On Publishing", "On Prevention of Corruption", the Civil Code of Ukraine, the University Statute, the Internal Rules of the University, the Collective Agreement and other normative legal acts of current legislation of Ukraine and internal university normative acts.

1.3 The academic community of the University recognizes academic integrity as a fundamental value of educational and scientific processes and is obliged to adhere to generally accepted norms of ethics, morals, standards in the fields of educational, research and disciplinary activities, respect the dignity of people working and studying at the University, maintain a system of democratic relations between all members of the university community, promote moral and psychological climate in the team, direct their actions to strengthen the authority and positive image of the University.

1.4 The system of ensuring academic integrity is an integral part of the internal quality assurance system of higher education of the University and it includes:

1) measures aimed at acquainting students with the concept and requirements for written works;

2) mechanisms for identifying violations of the academic integrity made by students;

3) the procedure for bringing participants of the educational process to academic responsibility.

1.5 The requirements of the Regulations apply to all employees and students in the fields of educational, research and disciplinary activities and are mandatory for all participants of the educational process at the University.

1.6 The Regulations are published on the official website of the University.

2. Compliance with the academic integrity

2.1 Participants of the educational process in their academic activities must adhere to generally accepted moral and ethical norms and standards of behavior, as well as:

- independently carry out educational tasks, tasks of current and final control of learning results (for persons with special educational needs this requirement is applied taking into account their individual needs and capabilities), except for cases when such tasks involve group work;

- refer to sources of information if using ideas, developments, statements, information;

- comply with the legislation on copyright and related rights;

- provide reliable information about the results of their own educational (scientific, creative) activities, research methods used and sources of information;

- teachers must monitor students’ compliance with academic integrity;

- teachers must objectively evaluate learning results.

3. Liability for violation of academic integrity

3.1 Violations of academic integrity at the University are the following:

- academic plagiarism is the publication (in part or in full) of scientific results obtained by others as the result of their own research and/or reproduction of published texts by other authors without indication of authorship;

- self-plagiarism is the publication (in part or in full) of one’s own previously published scientific results as new scientific results;

- fabrication is making up data or facts used in the educational process or research;

- falsification is a deliberate change or modification of existing data relating to the educational process or research;

- cheating is using external sources of information, other than those permitted for use, when doing written works, in particular during the evaluation of learning results;

- deception is the provision of knowingly false information about one's own educational and/or scientific activity or organization of the educational process; forms of deception are, in particular, academic plagiarism, self-plagiarism, fabrication, falsification and cheating;

- academic bribery is the provision (receipt) by a participant of the educational process or a proposal to provide (receive) funds, property, services, perks or any other benefits of a tangible or intangible nature in order to obtain an illegal advantage in the educational process;

- biased evaluation is a deliberate overestimation or underestimation of the grade of students learning results;

- academic fraud is the forgery of signatures in official documents (statements, records, acts, reports, agreements, etc.), passing of knowledge control procedures by fictitious persons.

3.2 For violation of academic integrity, scientific, pedagogical and research staff of the University may be held liable for the following academic liability in the prescribed manner:

- refusal to award a scientific degree or academic title;

- deprivation of an awarded scientific degree or academic title;

- refusal to assign or deprivation of the assigned pedagogical title, qualification category;

- deprivation of the right to participate in the work of statutory bodies or to hold statutory positions.

3.3 For violation of academic integrity, students may be held liable for the following academic liability in the prescribed manner:

- re-assessment (test, exam, credit, etc.);

- re-passing of the relevant educational component of the educational program;

- expelling from the University;

- deprivation of an academic scholarship;

- deprivation of tuition benefits provided by the University.

4. The procedure for identifying and constituting a violation of academic integrity by students

4.1 In case of violation of academic integrity in written works, publications, during the current or final control or certification, the student must be notified of the time, place and procedure for constituting a violation of academic integrity and bringing the student to academic liability. The matter of constituting a violation of academic integrity and bringing to academic liability is considered by the teacher who conducted the current or final control, and the head of the graduating department in the presence of the student, in case of final certification, the examination commission considers the issue. The absence of the student, informed of when and where the consideration of constituting a violation of academic integrity will take place and bringing the student to academic liability, is not an obstacle to resolving this issue on the merits. The student is notified of the decision.

4.2 Everyone who has been the subject of violation of academic integrity has the following rights:

- to get acquainted with all the materials of the inspection for constituting a violation of academic integrity, to submit comments to them;

- to provide oral and written explanations or refuse to provide any explanations personally or through a representative, to participate in the study of evidence of academic integrity violation;

- to be aware of the date, time and place and to be present during the consideration of constituting a violation of academic integrity and bringing to academic liability. Notifications are sent to the corporate e-mail address in the khai.edu domain or to the e-office of the PILOT system, or the e-mail can be sent to the e-mail address provided by the participant of the educational process. The person is considered to have received the notification from the moment of its sending;

- to appeal the decision to bring to academic liability to the body of the University authorized to consider such appeals, or to the court.

4.3 Pedagogical and scientific workers monitor the observance of academic integrity by students in the educational process and scientific activity.

4.4 The student’s observance of academic integrity when performing tasks of current and final control and certification of the student is provided by the teacher (examination commission).

4.5 The student’s observance of academic integrity in the course works (projects) is provided by the teacher who manages the work (project). The supervisor of the work (project) is obliged to use their own corporate e-mail address to download the relevant file to the electronic library system for checking for text borrowings (hereinafter, the repository of KHAI), followed by checking for text borrowings in comparison with the corporate account library of the University.

4.6 The student’s observance of academic integrity in writing qualification papers and dissertations is provided by the supervisor (consultant), reviewers (opponents) and the person responsible for the department of work with the prevention and detection of academic plagiarism system (hereinafter, person in charge of anti-plagiarism work at the department). The full procedure of dissertations examination is determined by the regulations on the dissertation work of the postgraduate student.

4.6.1 No less than a week before the established date of the diploma project (work) presentation, the student is obliged to submit to their supervisor an electronic version file of the diploma project (work) explanatory note. Files submission containing characters’ substitution, in particular (but not limited to), from other alphabets or their graphic images, is considered an attempt to conceal academic plagiarism and is punishable under the Regulations.

4.6.2 No less than four working days before the date of diploma projects (works) presentation, the supervisor (consultant) is obliged to submit to the person in charge of anti-plagiarism work at the department electronic version files of all students, whose work they manage.

4.6.3 The person in charge of anti-plagiarism work at the department is obliged to immediately upload to the repository of KHAI all received files with the subsequent check for text borrowings in comparison with the library of the corporate account of the University. Based on the results of the inspection, a technical report on the availability of text borrowings is generated by the system. The file of the report is submitted to the supervisor and reviewers for decision no later than one working day before the established date of the presentation.

4.6.4 The person appointed by the order of the rector responsible for working with the system of prevention and detection of academic plagiarism at the University, is obliged to provide the department responsible for anti-plagiarism work, mandatory, methodological recommendations for work in the system and to monitor the timely submission of electronic versions of diploma theses (projects) to the repository.

4.7 In case the department (faculty) receives information about violations present in the article, abstracts at a conference or other scientific event, competition work or any scientific or educational work of the student, the department (faculty) creates a commission that checks such information.

4.8 The Dean of the Faculty or the Rector shall be notified of the fraud or bribery detection. If the violation contains elements of a criminal offense, the information is transmitted to the National Police of Ukraine.

5. Decision to constitute a violation of academic integrity and bring the student to academic liability

5.1 The decision to constitute a violation of academic integrity and bring the student to academic liability is set out in the form of a submission addressed to the Dean of the faculty.

5.2 The Dean decides on bringing the student to academic liability and prepares the submission and the corresponding draft order addressed to the University Rector. In case the Dean is unable to make a decision on bringing the student to academic liability, the Dean is bound to refer the case to the University's Academic Integrity Commission with the relevant supporting documents.

5.3 In case of liability application in the form of repeated processing of the educational component of the educational program, the teacher (examination commission) enters the mark "not allowed" in the record of academic performance (protocol). The student is offered to repeat the course in the next academic year.

5.4 If the violation, which provides for expelling, is detected during the final attestation of the student, the mark "not allowed" is entered in the protocol of the examination commission.

5.5 The decision to constitute a violation of academic integrity and bring the student to academic liability shall be put into effect:

- if it was appealed to the Commission on Academic Integrity of the University or in court and the appeal (or claim) was denied - from the moment of the decision of the Commission on Academic Integrity of the University (or from the moment of entry into force of the court decision on refusal to satisfy the claim);

- if it has not been appealed to the Commission on Academic Integrity of the University or in court - from the moment of expiration of the term of appeal.

5.6 Decisions on constituting violations of academic integrity and bringing to academic liability that have been put into effect are published in publicly available sources (University website, bulletin boards, etc.).

6. Appeal against the decision to constitute a violation of academic integrity and bring the student to academic liability

6.1 It is possible to appeal against the decision to constitute a violation of academic integrity and bring the student to academic liability within three working days from the moment of notification of the student about the decision of the department (faculty) to constitute a violation of academic integrity and bring to academic liability.

6.2 The procedure for filing an appeal:

1) an appeal is submitted in writing to the chairman of the Commission on Academic Integrity of the University through the University office;

2) an appeal must indicate: last name, name, patronymic; all contact details; faculty, department, educational program; the decision of the department (faculty) being appealed; what is the illegality of the decision with justification and relevant objections; petition of the person who filed the appeal; list of documents and other materials attached to the appeal;

3) an appeal is filed by the person filing it or by a representative of such a person. A power of attorney or other document certifying the authority of the representative must be attached to the appeal filed by the representative;

4) an appeal must be considered within three working days from the date of its submission;

5) appeals are considered publicly, in the presence of the student and/or their representative. The absence of the student and/or their representative, who were informed about the time and place of the meeting, cannot be an obstacle to the consideration of the appeal;

6) the decision of the Commission on Academic Integrity of the University is made in the absence of persons who do not belong to the commission;

7) as a result of the appeal consideration, this commission may adopt the following decisions:

- to satisfy the appeal and cancel the decision of the department (faculty) to constitute a violation and bring to academic liability;

- to change the decision of the department (faculty) to constitute a violation and bring to academic liability;

- to refuse to satisfy the appeal.

8) decisions of the Commission on Academic Integrity of the University are drawn up in the form of the protocol of the meeting, which is signed by the chairman of the commission and the secretary, and enter into force from the moment of their adoption. The protocol must contain the arguments on the basis of which the commission made a decision. A copy of the protocol is sent to the student or their representative.

6.3 Appeals against the decision to constitute a violation of academic integrity and bring to academic liability in court may be made in accordance with the requirements of current procedural legislation of Ukraine within three working days from notifying the student of the department (faculty) decision to constitute a violation of academic integrity and bring to academic liability.

7. Prevention of academic dishonesty

7.1 The following set of preventive measures is used at the University to prevent non-compliance with the principles, norms and rules of academic integrity:

- informing students, scientific and pedagogical, researchers and staff about the need to comply with the rules of academic integrity, professional ethics;

- distribution of methodical materials;

- conducting seminars with students on informational activities of the University, correct writing of scientific, educational works, rules for appropriate quotations and citations of sources;

- acquaintance of students, scientific and pedagogical workers and employees with the Regulations;

- strengthening the control of the heads of the departments, supervisors of course, diploma projects/works, members of examination commissions on the correct design of references to sources of information in the case of borrowing ideas, statements, information, etc.;

- verification of diploma projects/works on academic plagiarism;

- expert assessment and (or) technical examination (with the help of specialized software on the basis of concluded agreements) on academic plagiarism in dissertation research prepared for presentation, etc.

8. Final regulations

8.1 The Regulations are approved by the Rector's Assistant for Quality Assurance, Chairman of the Student Council of the University, Chairman of the primary trade union of students and a leading legal adviser, approved by the Academic Council of the University and put into effect by order of the University Rector.

8.2 Control over the implementation of the Regulations is exercised by the officials of the University within the limits of their powers established in the job descriptions.

8.3 Changes and additions to the Regulations are considered and approved by the Academic Council of the University and put into effect by order of the University Rector in the prescribed manner.
