І. General provisions

1.1. This Charter of the higher education institution has been developed in accordance with the applicable legislation and constitutes the document regulating the activities of the National Aerospace University "Kharkiv Aviation Institute" (hereinafter – the University).

The Kharkiv Aviation Institute was established pursuant to the Order of the Supreme Council of National Economy of the USSR dated 17 April 1930 No. 1240 “In furtherance of the Resolution of the Presidium of the Supreme Council of National Economy of the USSR on the establishment of sectoral higher technical educational institutions.”

By Resolution of the Council of Ministers of the Ukrainian SSR dated 31 January 1978 No. 76 “On conferring the name of N. Ye. Zhukovsky upon the Kharkiv Aviation Institute,” the Institute was named after N. Ye. Zhukovsky. In accordance with the Resolution of the Cabinet of Ministers of Ukraine dated 7 August 1998 No. 1246 “On the establishment of the State Aerospace University named after N. Ye. Zhukovsky ‘Kharkiv Aviation Institute’ on the basis of the Kharkiv Aviation Institute,” the State Aerospace University named after N. Ye. Zhukovsky "Kharkiv Aviation Institute" was created. Pursuant to the Decree of the President of Ukraine dated 11 September 2000 No. 1059 “On granting certain higher education institutions national status,” the University was conferred the status of national.

By Order of the Ministry of Education and Science of Ukraine dated 3 March 2025 No. 401 “On the renaming of the National Aerospace University named after N. Ye. Zhukovsky ‘Kharkiv Aviation Institute’,” the University was renamed as the National Aerospace University "Kharkiv Aviation Institute."

The University is the legal successor of the Kharkiv Aviation Institute, the State Aerospace University named after N. Ye. Zhukovsky "Kharkiv Aviation Institute," and the National Aerospace University named after N. Ye. Zhukovsky "Kharkiv Aviation Institute."

Pursuant to the Order of the Ministry of Education and Science of Ukraine dated 17 July 2021 No. 811 “On the reorganization of the separate structural subdivision of the State University of Telecommunications,” the University is the legal successor to all property, rights, and obligations of the Separate Structural Subdivision "Kharkiv Professional College of Information Technologies of the State University of Telecommunications."

The University is a multidisciplinary (technical) higher education institution which carries out innovative educational activities at various levels of higher education (including the Doctor of Philosophy degree), conducts fundamental and/or applied scientific research, serves as a leading scientific and methodological center, maintains a developed infrastructure of educational, scientific, and research-and-production units, promotes the dissemination of scientific knowledge, and carries out cultural and educational activities.

The University is under the jurisdiction of the Ministry of Education and Science of Ukraine.

1.2. Name of the University:

The full official name of the University in Ukrainian: Національний аерокосмічний університет «Харківський авіаційний інститут».

The full official name of the University in English: National Aerospace University “Kharkiv Aviation Institute”.

The abbreviated name of the University: in Ukrainian – ХАІ; in English – KhAI.

1.4. The main tasks of the University are as follows:

1. to carry out educational activities at a high level, ensuring the acquisition of higher education by individuals at the appropriate degree level in their chosen specialties;

2. to conduct scientific activities through research and by fostering the creative work of participants in the educational process, the training of highly qualified scientific personnel, and the application of obtained results in the educational process;

3. to contribute to the social and economic development of the state through the formation of human capital;

4. to develop the individual through patriotic, legal, and environmental education, instilling moral values, social activity, civic stance and responsibility, a healthy lifestyle, independent thinking, and self-organization skills in modern conditions among participants in the educational process;

5. to ensure the organic integration of educational, scientific, and innovative activities within the educational process;

6. to create the necessary conditions for participants in the educational process to realize their abilities and talents;

7. to preserve and multiply the moral, cultural, and scientific values and achievements of society;

8. to disseminate knowledge among the population and to raise the educational and cultural level of citizens;

9. to establish international relations and carry out international activities in the fields of education, science, sports, arts, and culture;

10. to study labor market demand for specific specialties and to assist graduates in employment.

1.5. Legal status of the University

The University is a state institution which is a legal entity under public law. It may, in its own name, acquire property and personal non-property rights and assume obligations, as well as act as a plaintiff or defendant in court. The University is a higher education institution of state ownership.

The University is a budgetary institution operating on a non-profit basis. It is prohibited to distribute received income (profits) or any part thereof among the founders, employees of the University (except for remuneration of their labor and payment of the single social contribution), members of the governing bodies of the University, and other related persons. The income (profits) of the University shall be used exclusively to finance expenditures for the maintenance of the University, the implementation of its statutory tasks, and the achievement of its objectives.

The University carries out its activities in accordance with the legislation and this Charter.

The University maintains an independent balance sheet; has special registration accounts opened with the territorial body of the central executive authority in the field of treasury servicing of budgetary funds and with banking institutions, including settlement, current, deposit, foreign currency, and other accounts; as well as an estimate of expenditures, a seal and other official stamps bearing its name, trademarks (marks for goods and services), letterheads and stamps with requisites, and other attributes of a legal entity.

1.6. Structure of the University

The structure of the University, the status and functions of its structural subdivisions shall be determined by this Charter and the regulations on the respective structural subdivisions of the University. Structural subdivisions shall be established by decision of the Academic Council of the University.

The main structural subdivisions of the University are faculties, departments, and the scientific and technical library.

The separate structural subdivisions of the University are:

- Intersectoral Research Institute for Problems of Physical Modeling of Aircraft Flight Modes of the National Aerospace University "Kharkiv Aviation Institute," located at: 17 Vadym Manko Street, Building 48, Kharkiv, Kharkiv Region, 61070, Ukraine;

- Student Campus of the National Aerospace University "Kharkiv Aviation Institute," located at: 1 Vadym Manko Street, Kharkiv, Kharkiv Region, 61070, Ukraine;

- Health and Sports Camp "Icarus" of the National Aerospace University "Kharkiv Aviation Institute," located at: 3A Novoseliv Street, Rybache Village, Alushta, Autonomous Republic of Crimea, 98522, Ukraine;

- Separate Structural Subdivision "Kharkiv Professional College of Information Technologies of the National Aerospace University 'Kharkiv Aviation Institute'" (hereinafter – the Professional College), located at: 7 Kooperatyvna Street, Kharkiv, Kharkiv Region, 61003, Ukraine. 

The Professional College shall have the right, in accordance with its license(s), to provide specialized secondary education of professional and academic orientation, vocational (vocational-technical) education, and/or the initial (short-cycle) level of higher education in accordance with the legislation.

The Professional College shall exercise the powers, rights, duties, objectives, and principles of activity provided for by the Law of Ukraine "On Professional Pre-Higher Education" and other legislative acts for an institution of professional pre-higher education, provided that its right to carry out educational activities in the field of professional pre-higher education is specified in the University’s license and that the main type of activity of the Professional College is educational activity in this field.

The Professional College shall be vested with certain rights of a legal entity, in particular the right to maintain a separate balance sheet and estimate of expenditures, accounts and a network code in the territorial body of the State Treasury Service of Ukraine, current accounts in banking institutions, a seal and stamp with its own name, as well as to introduce its own symbols and attributes.

The Professional College shall carry out its activities on the basis of regulations approved by the Academic Council of the University; the Director of the Professional College shall be subordinated to the Rector of the University and shall act on the basis of the relevant authorization.

Information about the Professional College shall be entered into the Unified State Register of Enterprises and Organizations of Ukraine and into the Unified State Electronic Education Database. The Professional College shall carry out educational activities according to its own educational (educational-professional) programs and shall issue education documents under its own name.

The structural subdivisions of the University may include:

- scientific, educational-scientific, research, research-and-production, and design institutes; educational-scientific-production centers (sectors, units, complexes, etc.); research stations; design bureaus; postgraduate and doctoral departments; training and production centers; experimental enterprises; legal clinics; science parks; technology parks; and other units ensuring practical training of specialists in specific specialties and/or conducting scientific research;

- preparatory departments (units); units for retraining and advanced training of personnel; institutes of postgraduate education; laboratories; educational-methodological rooms; computer and information centers; training and production and creative workshops; training and research farms; production structures; publishing houses; sports complexes; cultural and social institutions; student sports centers;

- a special educational and rehabilitation subdivision, established to organize an inclusive educational process and provide special educational and rehabilitation support for higher education students with special educational needs, ensuring their access to quality higher education with regard to life limitations;

- other units, the activities of which are not prohibited by law.

1.7. The University may act as the founder or co-founder of other legal entities, which operate in accordance with the University’s educational, scientific, research-and-production, innovative, or other areas of activity, and/or facilitate the implementation of the University’s statutory objectives.

ІІ. Concept of the University’s Educational Activities

2.1. Educational activity at the University is aimed at organizing, ensuring, and implementing the educational process and is carried out with the purpose of providing higher and postgraduate education, as well as meeting other educational needs of the participants of the educational process. The University’s educational activity is based on the conceptual foundations of the National Doctrine of Education Development, approved by the Decree of the President of Ukraine of April 17, 2002, No. 347/2002, the Laws of Ukraine “On Education”, “On Higher Education”, “On Scientific and Scientific-Technical Activities”, Resolution of the Cabinet of Ministers of Ukraine of November 3, 1993, No. 896 “On the State National Program ‘Education (Ukraine of the 21st Century)’” (as amended), on regulatory legal acts of the Cabinet of Ministers of Ukraine in the field of education, and on normative documents of the Ministry of Education and Science of Ukraine.

In order to ensure compliance of the conditions of educational activity and learning outcomes with the requirements of legislation and higher education standards, professional and/or international standards (where applicable), as well as with the needs of stakeholders and society — ensured through internal and external quality assurance procedures — the University provides for the implementation of the following procedures and measures:

1. defining the principles and procedures of quality assurance in higher education;

2. monitoring and periodic review of educational programs;

3. annual assessment of higher education applicants, academic, teaching, and research staff of the University, and regular publication of the results of such assessments on the University’s official website, on information boards, and in any other way;

4. ensuring professional development of teaching, scientific, and academic staff;

5. ensuring the availability of necessary resources for organizing the educational process, including students’ independent work, for each educational program;

6. ensuring the availability of information systems for effective management of the educational process;

7. ensuring transparency of information on educational programs, higher education degrees, and qualifications;

8. ensuring an effective system for the prevention and detection of academic plagiarism in the scientific works of University staff and higher education applicants, including the creation and functioning of an effective system for the prevention and detection of academic plagiarism, self-plagiarism, fabrication, falsification, cheating, deception, undue advantage, and biased evaluation in the scientific works of academic, teaching, research, and other staff, as well as higher education applicants, based on the principles of scientific integrity, mutual trust, respect, and responsibility.

The internal quality assurance system of higher education and educational activity at the University is regulated by a separate regulation approved by the Academic Council of the University.

2.2 Ensuring Academic Integrity at the University

2.2.1. Academic integrity at the University is a set of ethical principles and rules established by law that participants of the University’s educational process must adhere to during learning, teaching, and conducting scientific (creative) activities, with the aim of ensuring trust in learning outcomes and/or scientific (creative) achievements.

2.2.2. Adherence to academic integrity by teaching, academic, and research staff of the University implies:

1. providing references to sources of information when using ideas, developments, statements, or data;

2. compliance with copyright and related rights legislation;

3. providing accurate information about research methods and results, sources of information used, and their own academic, teaching (creative) activities;

4. monitoring compliance with academic integrity by higher education applicants at the University;

5. objective assessment of learning outcomes.

2.2.3. Adherence to academic integrity by students at the University implies:

1. independent completion of academic assignments, tasks of current and final assessment of learning outcomes (for persons with special educational needs, this requirement applies with consideration of their individual needs and capabilities);

2. providing references to sources of information when using ideas, developments, statements, or data;

3. compliance with copyright and related rights legislation;

4. providing accurate information about the results of their own academic (scientific, creative) activities, research methods used, and sources of information.

2.2.4. For violations of academic integrity, academic, teaching, and research staff of the University, as well as higher education applicants, may be held academically liable. The types of academic liability (including additional and/or detailed ones) of participants of the educational process for specific violations of academic integrity are determined by special laws and/or the University’s internal regulations, approved by the Academic Council of the University and agreed with the student self-government body of higher education applicants with regard to their responsibility.

2.3. The Concept of the University’s Educational Activity

The Concept of the University’s Educational Activity is developed and approved by the Academic Council of the University. The Concept of the University’s Educational Activity is based on the personal orientation of education, the formation of national and universal values, the creation of equal opportunities for young people to obtain quality education, the development and implementation of educational innovations and information technologies, the promotion of continuing education and lifelong learning, the integration of Ukrainian education into the European and global space, and the creation and development of civil society values.

The Concept of the University’s Educational Activity consists in training specialists capable of creating knowledge-intensive, world-class technologies, working under conditions of open information technologies, creatively solving new technical problems, and possessing civic responsibility, professional dignity, and a commitment to self-improvement.

The Concept of the University’s Educational Activity is complemented and specified by the concepts of educational activity of faculties, departments, and other structural subdivisions.

2.4. The main tasks in the field of the University’s educational activity are:

1. ensuring that students of the University acquire knowledge in the relevant field at the level of higher education standards and preparing them for professional activity;

2. ensuring the professional mobility of University graduates in the labor market;

3. fostering a socially mature, creative personality, and a morally, mentally, and physically healthy generation of citizens;

4. shaping in young people a civic position, patriotism, a sense of dignity, readiness for work, and responsibility for their own destiny, as well as for the destiny of society, the state, and humanity;

5. training specialists for scientific, teaching, and cultural-educational activities;

6. conducting scientific research and carrying out educational outreach activities as a basis for the training of future specialists and for the socio-economic, scientific-technical, and cultural development of the state;

7. preparing citizens of Ukraine and foreign nationals for admission to educational institutions.

2.5. The University’s educational activity is carried out in the following areas:

1. training of specialists under accredited educational programs;

2. training, retraining, and certification of scientific and academic staff of the highest qualification for the University and other educational institutions;

3. retraining and professional development of specialists employed in various spheres of public life, sectors of the economy, education, science, and culture;

4. organization and implementation of research, scientific-technical, scientific-industrial, design and exploratory, experimental-design, engineering-technological, innovative, and environmental activities.

2.6. Principles and Organization of the Educational Process at the University

The educational process at the University is based on the principles of scientific character, humanism, democracy, continuity and lifelong learning, independence from the interference of any political parties, public or religious organizations, and is regulated by the Regulation on the Organization of the Educational Process at the University.

The approach to organizing the educational process at the University is aimed at student-centered learning, which involves encouraging higher education applicants to act as autonomous and responsible participants in the educational process, creating a learning environment focused on meeting the needs and interests of students, in particular by providing opportunities for the formation of an individual educational trajectory, and building the educational process on the principles of mutual respect and partnership among participants of the educational process.

The organization of the educational process at the University is carried out in accordance with the requirements of the Laws of Ukraine “On Education”, “On Higher Education”, “On Scientific and Scientific-Technical Activities”, standards of educational activity, higher education standards, the Concept of the University’s Educational Activity, and the Regulation on the Organization of the Educational Process at the University.

The requirements for the development and approval of the University’s regulatory documents concerning the organization of the educational process are determined by the relevant internal regulations of the University.

The procedure for the certification of higher education applicants is defined by the Law of Ukraine “On Higher Education”.

2.7. Language of the Educational Process

The language of the educational process at the University is the state language. The use of other languages at the University is determined by the Laws of Ukraine “On Ensuring the Functioning of the Ukrainian Language as the State Language” and “On Education”.

The Academic Council of the University has the right to decide on teaching one, several, or all disciplines, performing individual assignments, and conducting assessments in English, provided that all students enrolled in the respective disciplines have proficiency in English. If there is a written request from one or more higher education students, the University ensures translation into the state language.

Teaching, academic, and research staff of the University, except for foreign nationals or stateless persons invited to the University and working on a temporary basis as research staff, teachers, academic staff, or foreign language instructors, are required to have proficiency in the state language and to use it while performing their official duties.

The level of proficiency in the state language of the teaching, academic, and research staff of the University is certified either by a document of complete general secondary education, provided that such a document confirms the study of the Ukrainian language as an academic subject (discipline), or by a state certificate of proficiency in the state language issued by the National Commission on State Language Standards in accordance with the Law of Ukraine “On Ensuring the Functioning of the Ukrainian Language as the State Language”.

III. Powers of the Ministry of Education and Science of Ukraine

3.1. The Ministry of Education and Science of Ukraine (hereinafter – MESU) exercises the rights and responsibilities of the body authorized by the Cabinet of Ministers of Ukraine with respect to the University, as the central executive authority in the field of education and science, under whose subordination and management the University operates.

3.2. MESU:

1. approves the Charter of the University and, upon the submission of the University’s Labor Collective Conference, makes amendments thereto by adopting a new version;

2. concludes a contract with the Rector of the University elected through a competitive procedure in accordance with the Law of Ukraine “On Higher Education” and this Charter, within one month;

3. upon the submission of the University’s Labor Collective Conference, may prematurely terminate the contract with the Rector of the University on grounds specified by labor legislation or for violations of the University’s Charter and the terms of the contract;

4. exercises control over the financial and economic activities of the University;

5. exercises control over compliance with the University’s Charter;

6. exercises other powers provided for by the legislation of Ukraine.

MESU may delegate certain of its powers to the Rector of the University.

IV. Scope of the University’s Civil Legal Capacity

4.1. Civil Legal Capacity of the University

The civil legal capacity of the University arises from the moment of its establishment and consists of its rights and obligations. The civil legal capacity of the University terminates on the date of entry of the record of its termination into the Unified State Register of Legal Entities, Individual Entrepreneurs, and Public Formations.

4.2. Rights of the University

4.2.1. In the sphere of educational, scientific, innovative, and organizational activity, the University shall have the right to:

1. develop and implement educational programs within the licensed specialties;

2. independently determine the forms and types of education and organization of the educational process;

3. select types of bachelor’s and master’s programs provided by the International Standard Classification of Education;

4. hire teaching, academic, and other staff;

5. form and approve its own staffing table in accordance with the law. In case of a decrease in the number of students in each educational program by up to 20% of the number determined at the start of studies, the staffing of academic staff shall not be reduced;

6. make final decisions regarding the recognition, including the establishment of equivalence, of degrees obtained in foreign higher education institutions (bachelor, master, PhD, Doctor of Science) and academic titles (associate professor, professor) when admitting students and/or appointing scientific or academic staff;

7. implement ranking evaluation of educational, research, and innovative achievements of participants in the educational process;

8. provide additional educational and other services in accordance with the law;

9. independently develop and implement its own programs of educational, scientific, scientific-technical, and innovative activities;

10. create, reorganize, and liquidate its structural subdivisions;

11. independently introduce specializations, determine their content and course programs;

12. confer higher education degrees to students who have successfully completed the certification procedure in accordance with the law;

13. make decisions in accordance with the law on awarding and revoking doctoral degrees, and independently establish temporary specialized academic councils;

14. establish general secondary education institutions in agreement with local self-government authorities;

15. act as founder or co-founder of vocational, pre-higher professional education institutions, and colleges;

16. engage in publishing activities, including the publication of textbooks, teaching materials, and scientific works, and develop its own printing facilities;

17. carry out joint activities with educational institutions, scientific institutions, and other legal entities under appropriate contracts in accordance with the law;

18. place its educational, research, and educational-scientific-production subdivisions at enterprises, institutions, and organizations;

19. participate in the work of international organizations;

20. introduce its own symbols and attributes;

21. establish its own forms of moral and material incentives for participants in the educational process;

22. initiate proposals to governing bodies in the field of higher education for amendments to existing regulations or the development of new legal acts, and participate in related projects;

23. conduct financial, economic, and other activities in accordance with the law and this Charter;

24. manage its own revenues, including those from paid services;

25. open current and deposit accounts in banks;

26. create on its basis innovative structures of various types (scientific and technological parks, business incubators, small enterprises, etc.) based on the combination of interests of high-tech companies, science, education, business, and the state for the implementation of innovative projects;

27. set standards for the number of students per academic or research staff position;

28. independently determine the articles and volumes of expenditures of its own revenues;

29. train specialists at initial (short-cycle), first (bachelor), second (master), third (educational-scientific), and scientific levels under state order, agreements, and contracts with government bodies, citizens, enterprises of Ukraine, and with legal and natural persons of other countries within the licensed volume in accordance with the law;

30. establish educational, educational-scientific, and educational-scientific-production complexes, scientific parks, and join consortia in accordance with the law;

31. conduct, beyond the scope of established curricula, trainings, courses, extracurricular activities, clubs, electives, seminars, and driver training for vehicle categories A, A1, B, B1, C, C1, D, D1, E, E1 in accordance with the law;

32. conduct research, experimental-design, design-engineering, technological, exploratory, and project-exploratory work, including research and experimental developments in other natural and technical sciences in accordance with the law;

33. establish media outlets;

34. exercise other rights not contrary to the law.

4.2.2. In the sphere of financial and economic activity, in accordance with the procedure established by law and this Charter, the University shall have the right to:

1. own intellectual property created with its own funds or with funds from state or local budgets (except in cases defined by law or contract);

2. establish an endowment fund of the University and manage the income from its use in accordance with the conditions of the endowment fund, as well as receive property, funds, and material assets, including buildings, structures, equipment, and vehicles from state authorities, local self-government bodies, legal entities, and individuals, including as charitable assistance;

3. carry out financial and economic activities in Ukraine and abroad in accordance with the law;

4. use property assigned to it under economic management rights, including for conducting economic activities, lease it, or provide it for use in accordance with the law;

5. create or use under agreement other material and technical bases for educational, scientific, innovative, or economic activities;

6. create and develop its own social and domestic facilities, network of sports and wellness, medical-preventive, and cultural-artistic subdivisions;

7. perform capital construction, reconstruction, and carry out capital and current repairs of fixed assets in accordance with the law;

8. allocate funds for social support of the University’s academic, scientific, teaching, and other staff;

9. open current and deposit accounts in national and foreign currencies in accordance with the law, use bank credits without restrictions on borrowing rights established by Article 16 and Clause 27 of Part One of Article 116 of the Budget Code of Ukraine;

10. participate in forming the charter capital of innovative structures and small enterprises created with the participation of higher education institutions that develop and implement innovative products, by contributing intangible assets (property rights to intellectual property objects);

11. establish educational institutions and scientific organizations;

12. establish enterprises for innovative and/or industrial activities;

13. make foreign currency transfers for collective membership fees in international educational and scientific associations, subscriptions to foreign scientific publications, and access to global information networks and databases;

14. participate in forming the charter capital of various types of innovative structures (scientific, technological parks, business incubators, etc.) by contributing intangible assets (property rights to intellectual property);

15. establish legal entities or act as a co-founder of legal entities, including those outside Ukraine, which operate within the scope of the University’s educational, scientific, production, or innovative activities and/or ensure the fulfillment of its statutory objectives in accordance with the established procedure;

16. conduct production, marketing, consulting, and agency activities;

17. produce thermal energy (except for thermal power plants, heat stations, nuclear power plants, cogeneration facilities, or facilities using unconventional or renewable energy sources), transport it through main and local (distribution) heat networks, and supply thermal energy for population and utility needs in accordance with the law;

18. ensure, as the owner of the electrical network system, technical capability to supply electricity at the consumer connection point within the allowed capacity, in accordance with the law;

19. provide video and audio services, information and translation services, services related to legalization, apostille, and recognition of foreign higher education degrees and documents on general secondary, vocational, or technical education, perform service maintenance of equipment, provide hotel, communal, transport, catering, excursion, and cultural-event organization services in accordance with the law;

20. develop, test, produce, and operate aviation equipment, launch vehicles, components of spacecraft, ground space infrastructure, equipment of satellite systems, and other high-tech engineering products;

21. provide telecommunications services, including telephone services (except departmental facilities) in local dual-purpose networks, with the right to establish its own network with up to one thousand subscriber numbers, and operate in the field of electrical communication in accordance with the law;

22. perform operations with precious metals and gemstones in the educational process and for scientific research, as well as during disposal of instruments and equipment in accordance with the law;

23. provide accommodations at recreation bases and camps in accordance with the law;

24. perform repair and maintenance of vehicles and other means of transport, manufacture carpentry, metal products, structures, and equipment in accordance with the law;

25. conduct other activities not contrary to the law.

4.2.3. If the law requires obtaining a relevant permit (license) for a specific type of activity, the University shall have the right to conduct such activity only after obtaining the corresponding permit (license).

4.3. The rights of the University as a national higher education institution are defined by the Law of Ukraine “On Higher Education.”

4.4. The University’s intellectual property rights are acquired, formalized, protected, and enforced in accordance with the legislation of Ukraine. The University has the right to manage property rights to intellectual property objects, including implementing measures for their utilization, such as technology transfer, for intellectual property rights acquired by the University. The University also implements measures to prevent academic plagiarism.

Property rights to intellectual property created by its employees or by persons performing work under civil-law contracts for the benefit of the University in the course of educational-methodological work, scientific research, experimental-design, or other activities belong to the University, unless otherwise explicitly provided by an agreement between the University and its employee (or the person performing work under a civil-law contract for the University).

4.5. The University shall be obliged to:

1. take measures to prevent and detect academic plagiarism in the scientific works of academic, teaching, research, and other staff, as well as students of higher education, and hold them accountable under disciplinary procedures;

2. maintain an internal quality assurance system for higher education, including an approved policy for ensuring participants in the educational process adhere to academic integrity (Academic Integrity Code);

3. create the necessary conditions for persons with special educational needs to obtain higher education;

4. publicly disclose on the official website, information boards, and by any other means information regarding the exercise of its rights and fulfillment of its obligations;

5. carry out educational activities based on a student-centered learning approach;

6. ensure proper working and learning conditions for all participants in the educational process in accordance with labor protection legislation;

7. ensure compliance with Ukrainian legislation regarding labor, environmental protection, and perform other duties imposed under the laws of Ukraine;

8. ensure access control on the University premises, including restrictions on photography, video recording, and access of foreign citizens to restricted facilities and rooms in accordance with the University’s access control regulations.

V. University Governance Bodies

5.1. University Management

The University is managed on the principles of autonomy and self-governance; delineation of rights, powers, and responsibilities between the Ministry of Education and Science (MES), the University’s management bodies, and its structural subdivisions; a combination of collegial and single-leadership principles; and independence from political parties, public, and religious organizations. The autonomy and self-governance of the University are exercised in accordance with the legislation of Ukraine.

5.2. University Governance Bodies

The direct management of the University’s activities is carried out by its head – the Rector.

The highest collegial body of public self-governance is the Conference of the University’s Labor Collective.

The Academic Council is a collegial governing body of the University.

The Supervisory Board is established to oversee the management of the University’s assets and ensure adherence to the purpose of its establishment.

To resolve current operational matters of the University, working bodies such as the Rectorate, Dean’s offices, Admissions Committee, and others are formed.

5.3. Legal Status, Rights, and Duties of the Rector

This section covers the legal status, rights, and responsibilities of the Rector, as well as the procedures for election, appointment, and dismissal from office.

5.3.1. Rights, Duties, and Responsibilities of the Rector

The rights, duties, and responsibilities of the Rector of the University are determined by the legislation of Ukraine, this Charter, and the contract. The Rector represents the University in relations with state authorities, local self-government bodies, legal entities, and individuals, and acts without a power of attorney within the scope of authority provided by the Law of Ukraine “On Higher Education” and this Charter.

5.3.2. Powers of the Rector

Within the scope of granted authority, the Rector:

1. Organizes the activities of the University;

2. Resolves matters related to the University’s financial and economic activities, approves its structure and staffing schedule;

3. Issues orders and directives, and gives instructions mandatory for all participants of the educational process and the University’s structural subdivisions;

4. Is responsible to the Ministry of Education and Science (MES) for the University’s performance, including timely submission of established statistical, accounting reports, and other necessary information about the University’s operations and status;

5. Acts as the manager of the University’s property and funds;

6. Ensures execution of the financial plan (budget) and concludes contracts;

7. Appoints and dismisses employees;

8. Appoints deputy rectors (vice-rectors), determines their duties, and delegates part of their powers if necessary;

9. Ensures occupational safety and compliance with law and order;

10. Determines the functional duties of employees;

11. Expels or reinstates students in agreement with student self-government bodies and the primary trade union organization of students, postgraduates, and doctoral candidates (if a member of the trade union), on grounds established by the Law of Ukraine “On Higher Education”;

12. Organizes and controls the implementation of study plans and academic programs;

13. Monitors compliance of all subdivisions with staffing and financial discipline;

14. Controls the quality of work of pedagogical, scientific-pedagogical, scientific, and other employees;

15. Ensures conditions for effective and transparent public oversight of the University’s activities;

16. Facilitates and creates conditions for the operation of student self-government bodies, primary trade union organizations of University employees, students, postgraduates, and doctoral candidates, and other public organizations functioning in the University;

17. Promotes a healthy lifestyle among students, strengthens the University’s sports and wellness infrastructure, and creates proper conditions for mass sports activities;

18. Together with the elected bodies of the primary trade union organizations of employees, students, postgraduates, and doctoral candidates, submits for approval to the University’s Labor Collective Conference, including elected student representatives, internal regulations and collective agreements and signs them after approval;

19. Exercises other powers provided by this Charter.

The Rector may delegate part of their powers to vice-rectors and heads of structural subdivisions.

5.3.3. Accountability of the Rector

The Rector is responsible for the conduct of educational, scientific, research, and innovation activities at the University, as well as for the results of financial and economic activities, and the condition and preservation of the University’s movable and immovable property. The Rector reports annually to MES and the University’s Labor Collective Conference. The Rector must publish the annual report on the University’s official website.

The annual report should include information on the level of achievement of the University’s target performance indicators specified in the contract as of December 31 of the reporting year. The report is entered into the Unified State Electronic Database on Education and is published in the Registry of Educational Activity Subjects and on the University’s official website.

5.3.4. Post-Retirement Appointment

Upon retirement, a person who has served as Rector for at least ten consecutive years may be appointed as an advisor to the Rector on a voluntary basis or funded from the University’s own revenues.

5.3.5. Election of the Rector

The Rector is elected by secret ballot for a term of five years in accordance with the Law of Ukraine “On Higher Education” and this Charter. The election process is based on principles of openness, publicity, secret and free voting, voluntary participation, democracy, and equality of voting rights.

A candidate for Rector must be a citizen of Ukraine, proficient in the state language at the level established by the National Commission on State Language Standards, hold an academic title and scientific degree, and have at least ten years of work experience in scientific-pedagogical positions. The same person cannot serve as Rector for more than two terms.

A person may not be elected, appointed, or act as Rector if they:

1. Are legally incapacitated or have restricted legal capacity by court decision;

2. Have an unexpunged or unremoved criminal conviction;

3. Are barred by a court decision from holding relevant positions;

4. Are found guilty of a corruption offense by a court decision within one year of its legal effect;

5. Have been subject to administrative liability for a corruption offense within one year of the court decision taking legal effect;

6. Fall under the provisions of Article 1, part three, of the Law of Ukraine “On Purification of Power” (Lustration Law).

MESU announces the competition for the Rector position no later than two months before the end of the current Rector’s contract. In case of early termination, the competition is announced within one week of vacancy. MESU receives proposals for candidates within two months and submits qualified candidates to the University for voting within ten days after the deadline for proposal submission.

Participants in the election include:

1. All scientific, scientific-pedagogical, and pedagogical staff;

2. Representatives of other staff elected by direct secret ballot;

3. Elected student representatives chosen by students through direct secret ballot.

The total number of scientific, scientific-pedagogical, and pedagogical staff must be at least 75% of all voters; representatives of other staff up to 10%, and student representatives at least 15% of voters.

Elections are valid if more than 50% of eligible voters participate, each with one personal vote.

If no candidate receives more than 50% of votes, a second round is held on the seventh calendar day after the first round. The top two candidates from the first round are included on the ballot. The candidate who receives more than 50% of votes in the first or second round is considered elected.

MESU signs a five-year contract with the elected Rector within one month, specifying target performance indicators, mechanisms for monitoring them, and timelines for achievement. If the elected candidate fails a special check, MESU announces a new competition within seven calendar days.

The Rector may be dismissed by MESU or by a decision of the University’s Labor Collective Conference on grounds established by labor law, for violation of the University Charter or contract terms. The proposal for dismissal may be submitted by at least half of the Supervisory or Academic Council members. The decision requires a majority vote with at least two-thirds of the Labor Collective Conference members present.

5.4. Academic Council

The Academic Council is a collegial governing body of the University, established for a term of five years, the composition of which is approved by the Rector’s order within five working days after the expiration of the previous Council’s term.

5.4.1. Competence of the Academic Council

The Academic Council of the University has authority over the following matters:

1. Determining the strategy and prospective directions for the development of educational, scientific, and innovative activities of the University;

2. Developing and submitting to the University Labor Collective Conference a draft Charter, as well as decisions on amendments and additions thereto;

3. Approving the financial plan and annual financial report of the University;

4. Defining the system and approving the procedures for internal quality assurance in higher education;

5. Deciding, upon the Rector’s submission, on the placement of own revenues in the territorial bodies of the central executive authority in the field of treasury servicing of budget funds or in banking institutions;

6. Deciding, upon the Rector’s submission, on the establishment, reorganization, or liquidation of the University’s structural subdivisions;

7. Approving educational programs and curricula for each level of higher education and specialty;

8. Making decisions regarding the organization of the educational process, including determining study duration at respective levels;

9. Approving templates and procedures for the issuance of higher education documents, including joint and double diplomas;

10. Determining the main directions of scientific research and innovative activities;

11. Evaluating the scientific-pedagogical activities of structural subdivisions, reviewing proposals, and approving decisions concerning the organization of educational and research processes at the University;

12. Conferring academic titles of Professor, Associate Professor, and Senior Researcher, and submitting respective decisions for approval to the MES attestation board;

13. Making final decisions on the recognition of foreign higher education documents, academic degrees, and titles for employment purposes and during student enrollment;

14. Making final decisions on the recognition of higher education documents issued by higher spiritual education institutions, the charters of which are registered in accordance with legislation, during enrollment;

15. Approving the Admission Rules, regulations on the University’s working and advisory bodies, the organizational committee and election commission for Rector elections, and other internal regulations governing University activities;

16. Submitting a proposal for the recall of the Rector on grounds provided by law, this Charter, or the contract, for consideration by the Labor Collective Conference;

17. Considering other issues of University activity as provided by this Charter.

5.4.2. Chair of the Academic Council

The Academic Council is headed by a Chair, elected by secret ballot from among its members who hold an academic degree and/or academic (honorary) title, for the term of the Academic Council.

5.4.3. Composition of the Academic Council

The Academic Council includes by office: the Rector, vice-rectors, deans of faculties (heads of institutes), Academic Secretary, Director of the Scientific and Technical Library, Chief Accountant, leaders of student self-government bodies, elected representatives of primary trade union organizations of University staff and students, postgraduates, and doctoral candidates, as well as elected representatives from scientific, scientific-pedagogical staff (heads of departments, professors, PhD holders, doctors of sciences), other University employees, and elected representatives of postgraduates and doctoral candidates.

By decision of the Academic Council, representatives of employer organizations may also join the Council.

At least 75% of the Academic Council must be scientific or scientific-pedagogical staff, and at least 10% must be elected student representatives.

Elected staff representatives are chosen by the Labor Collective Conference based on submissions from structural subdivisions. Student representatives are elected by students through direct secret ballot. Elected representatives of postgraduates and doctoral candidates are selected by the scientific society of students, postgraduates, doctoral candidates, and young scientists.

5.4.4. Termination of Powers

The powers of Council members may be terminated early by the Rector upon submission by the Chair in the following cases:

1. Members included by office or as representatives of staff who have left the University or are on long-term (over four months) business leave;

2. Members elected as student representatives who have ceased their studies;

3. Members elected as representatives of self-government bodies, trade union bodies, or employer organizations who have left the relevant body or organization;

4. Members who have ceased personal participation in Council activities (absence from meetings for more than four months without valid reason).

Vacant positions may be filled with new members by Rector’s order until the next Labor Collective Conference.

5.4.5. Meetings and Decision-Making

The Chair convenes the Academic Council, typically monthly. The Council is competent to consider issues and make decisions if at least two-thirds of members participate. Decisions are considered adopted if supported by more than half of the members present. Council decisions are implemented by Rector’s orders. The Council approves its regulations and internal rules of procedure.

5.4.6. Specialized Academic Councils

The University may establish specialized Academic Councils for dissertation defense in relevant fields.

5.5. Supervisory Board of the University

The Supervisory Board of the University is established by the decision of the Ministry of Education and Science of Ukraine (MESU) to oversee the management of the University’s property and ensure compliance with the purpose of its establishment. The personal composition of the Supervisory Board is approved by the MESU.

5.5.1. Main Tasks of the Supervisory Board

The main tasks of the University’s Supervisory Board are:

1. Reviewing and analyzing priority directions for the development of the University in education, scientific, scientific-technical, and innovative activities;

2. Assisting in solving long-term development challenges of the University;

3. Supporting the University administration in implementing state policy in higher education and science;

4. Attracting financial resources to support the University’s core development activities and overseeing their use;

5. Facilitating effective interaction of the University with state authorities, local self-government bodies, the scientific community, socio-political organizations, and economic entities to enhance the quality of education and the University’s competitiveness;

6. Assisting in improving the material and technical base of the educational process, scientific and scientific-technical activities, and the University’s social infrastructure;

7. Exercising public oversight of the University’s activities;

8. Promoting the integration of the University into the international education system and expanding and enhancing international cooperation;

9. Contributing to establishing the University’s image as a leader in higher education, science, and culture at regional and national levels.

5.5.2. Term and Composition

The term of the Supervisory Board is five years. Employees and students of the University may not be members of the Supervisory Board.

5.5.3. Functions of the Supervisory Board

In accordance with its tasks, the Supervisory Board:

1. Prepares and submits proposals to the Academic Council and Rector regarding priority directions for educational, scientific, scientific-technical, and innovative activities;

2. Participates in developing programs aimed at enhancing the University’s material and technical base and social infrastructure;

3. Provides proposals for optimizing the organizational structure of the University in accordance with its statutory activities;

4. Monitors the status and quality of educational, scientific, scientific-technical, and international activities, promoting the introduction of innovative technologies;

5. Analyzes opportunities and supports attracting investments, additional funds, material assets, and intangible assets for educational, scientific, cultural, recreational, and sports activities;

6. Monitors and examines the effectiveness of the University’s economic, financial, and operational activities and provides recommendations to the administration on improving expenditure planning, use of property, land plots, and funds according to the development plan.

5.5.4. Rights of the Supervisory Board

The Supervisory Board has the rights established by the Law of Ukraine “On Higher Education” and this Charter.

5.5.5. Rights of Members of the Supervisory Board

Members of the Supervisory Board have the right to:

1. Participate in the University Labor Collective Conference with advisory voting rights;

2. Contribute to defining the University’s development strategy and monitor its implementation;

3. Facilitate attracting additional funding sources;

4. Analyze and evaluate the activities of the University and its Rector;

5. Control the implementation of the University budget and submit recommendations and proposals that must be considered by the Rector;

6. Submit proposals to the MES regarding incentives or recall of the Rector under the grounds established by the Law of Ukraine “On Higher Education”;

7. Exercise other rights established by Ukrainian legislation and this Charter, including attending Academic Council meetings, faculty councils, the Rectorate, and other advisory bodies, and initiating discussion of issues during regular and extraordinary meetings of the Supervisory Board by adding them to the agenda.

5.5.6. Meetings

The Supervisory Board conducts meetings, typically at least once a year. The date and location of meetings are determined by the Chair of the Supervisory Board. In the Chair’s absence for valid reasons, meetings are conducted by the Deputy Chair.

5.5.7. Chair of the Supervisory Board

The Chair of the Supervisory Board:

1. Organizes the work of the Supervisory Board;

2. Convenes meetings;

3. Presides over meetings;

4. Coordinates the activities of members in fulfilling their responsibilities;

5. Determines persons responsible for preparing agenda items and persons who are not members but must attend;

6. Signs decisions, extracts from minutes, letters, inquiries, and responses concerning issues addressed by the Board;

7. Represents the Supervisory Board in state authorities, enterprises, institutions, organizations, and media;

8. Exercises other powers necessary for the Board to perform its functions.

5.5.8. Decision-Making

Within its authority, the Supervisory Board makes decisions, organizes, and monitors their implementation. Meetings are valid if at least two-thirds of members are present. Decisions are adopted if supported by more than half of members present. Decisions and issues considered are recorded in minutes, signed by the Chair and Secretary. Adopted decisions must be communicated to the Rector within five days and are mandatory for consideration and action, and reported at the next Academic Council meeting.

5.5.9. Organizational and Technical Support

The University, through the Rector, provides organizational and material-technical support to the Supervisory Board, including meeting rooms, computers, and office equipment.

5.6. Operational and Advisory Bodies of the University

For the purpose of promptly addressing current issues in the University’s activities, operational bodies and administrative units are established within its structure, including the Rectorate, Deanships, Admissions Committee, Administrative Council, and others.

For the purpose of developing strategies and directions for the University’s educational and/or scientific activities, the Rector of the University has the right to establish advisory (consultative) bodies on a public basis, such as an Employers’ Council, Investors’ Council, Business Council, Student Council, Scientific Council, and others.

The regulations on operational and advisory bodies are approved by the University Academic Council.

VІ. Governance Bodies of the University's Structural Units

6.1. Rights and responsibilities, procedure for election, appointment, and dismissal of the head of a faculty (research institute) or department of the University.

6.1.1. Faculty Leadership.

The faculty is headed by a Dean, who may not hold this position for more than 10 years. The Dean of the faculty must hold an academic degree and/or an academic (honorary) title, generally in accordance with the profile of the faculty.

The functional duties of the Dean are determined by the University Rector in accordance with this Statute and the regulations on the faculty, which are approved by the University Academic Council. The Dean may delegate part of their powers to their deputies. Deputy Deans are appointed by the Rector of the University upon the Dean’s recommendation. The Dean issues orders regarding the activities of the respective faculty, which are mandatory for all participants in the educational process and may be revoked by the Rector if they contradict the law, this Statute, or harm the interests of the University.

The Rector, with the consent of the majority of the full composition of the faculty’s labor collective assembly, appoints the Dean for a term of up to five years and concludes a contract with them. The Dean may be dismissed by the Rector upon the recommendation of the University Academic Council or the faculty’s labor collective assembly on grounds defined by labor legislation, this Statute, or the terms of the contract. A proposal for dismissal of the Dean is submitted to the faculty’s labor collective assembly by no less than half of the votes of the faculty Academic Council. The dismissal proposal is adopted by no less than two-thirds of the faculty labor collective assembly.

Appointment and dismissal of the head of a territorially separate structural unit of the University, which is part of the University’s structural units, is carried out in the procedure established by this Statute for a Dean.

The same person may not serve as Dean, College Head, or head of a territorially separate structural unit of the University for more than 10 years.

Leadership of a Professional College, which is a separate structural unit conducting educational activities, is carried out by a Director, who is appointed under a contract following a competitive selection procedure conducted according to Article 42 of the Law of Ukraine “On Professional Pre-Higher Education.” The same person may not serve as Director (Head) of a Professional College for more than two terms.

6.1.2. Department Head.

A department is headed by the Head of Department, who may not serve more than two terms. The Head of Department must hold an academic degree and/or an academic (honorary) title in accordance with the department’s profile. The Head of Department is elected by the University Academic Council through a secret ballot for a five-year term, taking into account the proposals of the faculty Academic Council and the labor collective of the faculty and department. The Rector concludes a contract with the Head of Department. The Head of Department ensures the organization of the educational process, implementation of curricula and syllabi, and supervises the quality of teaching, methodological, and research activities of faculty members.

6.2. Academic Councils of Faculties (Institutes) and Scientific-Technical Councils.

6.2.1. Academic councils of structural units may be established within the University, with powers determined by the University Academic Council in accordance with this Statute. The University Academic Council may delegate part of its powers to the academic councils of structural units. The composition of these academic councils is formed based on the principles outlined in Parts Three and Four of Article 36 of the Law of Ukraine “On Higher Education.”

6.2.2. Research units of the University establish Scientific-Technical Councils, which are collegiate management bodies of these structural units and are established for a five-year term. The Scientific-Technical Council of a research unit (research institute) is chaired by the Vice-Rector for Research (Head of the Research Institute). The procedure for forming the Scientific-Technical Council and its areas of activity are defined by the regulations on the Scientific-Technical Council, developed in accordance with the law, this Statute, and approved by the Rector upon the recommendation of the University Academic Council.

VII. University (Faculty) Self-Governance Bodies

7.1. Public and Student Self-Governance Bodies at the University

The University has the following public and student self-governance bodies:

1. Conference of the University’s Workforce;

2. Student Self-Governance Bodies;

3. Scientific Society of Students, Postgraduates, Doctoral Students, and Young Scientists.

7.2. Conference of the University’s Workforce

The highest collegiate body of public self-governance at the University is the Conference of the University’s Workforce, including elected student representatives.

The procedure for convening and making decisions by the Conference of the University’s Workforce is determined by this Statute. The regular Conference is convened by the Rector. An extraordinary Conference may be convened at the request of at least 20% of the workforce, at the initiative of the Rector, or by the University’s Academic or Supervisory Council.

The Conference of the University’s Workforce:

1. Approves, upon submission by the Academic Council, the University Statute or any amendments thereto;

2. Annually hears the Rector’s report on educational and scientific work, financial and economic activities, and tasks for the next academic year, and evaluates the Rector’s performance;

3. Elects a labor disputes commission in accordance with labor legislation;

4. Elects representatives to the University’s Academic Council upon submission of the respective structural units;

5. Considers, based on a justified submission from the Supervisory or Academic Council, issues concerning the early termination of the Rector’s powers in accordance with legislation and the contract;

6. Approves the University’s internal regulations;

7. Reviews and approves the collective agreement, decides on granting the head of the primary trade union committee authority to sign it on behalf of the workforce, and hears reports on its implementation;

8. Makes decisions on other matters of University activity in accordance with the law and this Statute.

The Conference of the University’s Workforce is convened at least once a year. The total number of delegates is 180. All categories of participants in the educational process must be represented. At least 75% of delegates must be full-time academic, scientific, and pedagogical staff, and at least 15% must be elected student representatives, chosen through direct secret voting.

The number of delegates and representation quotas from each structural unit is determined by the University Academic Council. Delegates from staff are elected for five years, while student delegates are elected for one year.

The Conference is considered valid if at least two-thirds of the elected delegates are present. Decisions are made by a simple majority of votes of those present.

The preparation and conduct of the Conference of the University’s Workforce are determined by regulations approved by the University Academic Council.

7.3. Faculty (Research Institute) Workforce Meetings

The public self-governance body of a faculty (research institute) is the faculty (research institute) workforce meeting, including elected representatives from among the students of the University. The procedure for convening and conducting the meetings of a faculty (research institute) is determined by this Statute.

The faculty (research institute) workforce meeting is authorized to consider issues and make decisions if more than half of the total members of this elected body participate in the meeting.

A decision of the faculty (research institute) workforce meeting is considered adopted if more than half of the participants present at the meeting vote in favor.

The faculty (research institute) workforce meeting is convened at least once a year.

All categories of faculty (research institute) employees and elected student representatives must be represented at the meetings. At least 75% of the delegates must be academic and scientific staff of the faculty (research institute), and at least 15% must be elected student representatives, chosen by direct secret ballot.

The faculty (research institute) workforce meeting:

1. Evaluates the performance of the head of the faculty (research institute);

2. Approves the annual report on the activities of the faculty (research institute);

3. Submits proposals to the University Rector regarding the dismissal of the head of the faculty (research institute) on grounds specified by legislation, this Statute, or the contract concluded with them;

4. Elects representatives to the faculty (research institute) Academic Council;

5. Elects delegates to the University Workforce Conference;

6. Elects candidates for the University Academic Council.

The preparation and conduct of the faculty (research institute) workforce meetings are governed by regulations approved by the University Academic Council.

7.4. Student Self-Governance Bodies

Student self-governance operates at the University and its structural units and constitutes an integral part of the University’s public self-governance. Student self-governance is the right of University students to address issues related to their education and daily life, protect their rights and interests, and participate in the management of the University.

Student self-governance includes all students of the University. All students enrolled at the University have equal rights and may be elected to and serve in working, advisory, elective, and other bodies of student self-governance.

Student self-governance ensures the protection of students’ rights and interests and their participation in the management of the University. It is exercised directly by students and through student self-governance bodies elected by direct secret ballot. In their activities, these bodies are guided by legislation, this Statute, and the University’s regulations on student self-governance.

Student self-governance bodies operate on principles of voluntariness, collegiality, transparency, elective and accountable governance, equality of students’ rights to participate, and independence from political parties and religious organizations.

Student self-governance is exercised at the level of academic (student) groups, year, specialty, faculty (research institute), dormitory, student campus, and the University.

Representative, executive, and audit bodies of student self-governance are elected for a term of one year. Students elected to these bodies may be removed by a general secret ballot of students. The head of student self-governance and their deputies may serve no more than two terms.

Participation in student self-governance ends when a student ceases their studies at the University, in accordance with the University’s regulations on student self-governance.

Student self-governance bodies have all rights defined by the Law of Ukraine “On Higher Education” and the University’s regulations on student self-governance.

Decisions of the University regarding the following issues are made in agreement with the student self-governance body:

1. Expulsion and reinstatement of students;

2. Transfer of state-funded students to contract-based study funded by individuals or legal entities;

3. Transfer of students funded by individuals or legal entities to state-funded study;

4. Appointment of deputy deans, deputy heads of research institutes, and deputy rectors (vice-rectors);

5. Accommodation and eviction of students in dormitories;

6. Approval of internal regulations concerning students;

7. Operation of student campuses and dormitories.

Decisions of student self-governance bodies are advisory, except for the powers to approve certain University management decisions listed above.

The highest student self-governance body at the University is the general assembly of students, which:

1. Approves regulations on student self-governance, determines the structure, powers, and procedure for conducting direct secret elections of representative and executive bodies in University units, dormitories, etc., elects the University Student Council and its head, and hears their reports;

2. Reviews reports of representative, executive, and audit bodies of student self-governance and evaluates their activities;

3. Approves procedures for using property and funds of student self-governance bodies, supporting student initiatives on a competitive basis;

4. Approves the annual budget of student self-governance bodies, makes amendments, and reviews budget execution reports;

5. Elects an audit commission from among students to monitor the use of property and budget execution.

University administration shall not interfere with the activities of student self-governance bodies. The University Rector ensures proper conditions for their activities (provides premises, furniture, office equipment, telephone and Internet access, technical resources, and space for information boards) through a formal agreement.

The financial basis for student self-governance consists of funds allocated by the University Academic Council of at least 0.5% of the University’s own revenue from core activities, as well as membership fees from students, the amount of which is determined by the general assembly of students. The monthly membership fee per student may not exceed 1% of the legally established minimum subsistence level.

Funds of student self-governance bodies are directed toward fulfilling their tasks and exercising their powers according to the approved budgets.

Student self-governance bodies publicly report on the use of funds and budget execution at least once a year.

7.5. Scientific Societies of Students, Postgraduates, Doctoral Candidates, and Young Scientists of the University

Scientific societies of students, postgraduates, doctoral candidates, and young scientists operate at the University and its structural units and are part of the University’s public self-governance system.

Members of these scientific societies include individuals up to 35 years old (up to 40 years for doctoral candidates) who study or work at the University.

The scientific societies ensure the protection of the rights and interests of those studying or working at the University, particularly regarding scientific activities, support for research-intensive ideas, innovations, and knowledge exchange. In their activities, these societies are guided by legislation, this Statute, and the regulations on scientific societies of students, postgraduates, doctoral candidates, and young scientists.

These societies operate on the principles of freedom of scientific creativity; voluntariness, collegiality, and transparency; equality of rights for participants in scientific activities. They have the rights established by the Law of Ukraine “On Higher Education” and the University regulations on scientific societies of students, postgraduates, doctoral candidates, and young scientists.

With the agreement of the scientific society, the University administration makes decisions regarding the expulsion and reinstatement of individuals pursuing a Doctor of Philosophy degree.

The governance bodies of the scientific societies are formed democratically through elections. The structure and organizational mechanism of the scientific society are defined by regulations approved by the University’s labor collective conference.

The University administration shall not interfere in the activities of these scientific societies, except in cases where such activities contradict legislation, this Statute, or harm the interests of the University. The University Rector facilitates the creation of proper conditions for the activities of the scientific societies (providing premises, furniture, office equipment, telephone and Internet access, and space for information boards).

VIII. Rights and Responsibilities of Participants in the Educational Process at the University

8.1. Rights and Responsibilities of Academic, Scientific, and Teaching Staff

8.1.1. Rights of academic, scientific, and teaching staff:

1. Academic freedom in the interests of individuals, society, and humanity.

2. Academic mobility for professional activities.

3. Protection of professional honor and dignity.

4. Participation in university governance, including the right to elect and be elected to the labor collective conference or the academic council of the University or faculty/research institute.

5. Choice of teaching methods and tools to ensure high-quality education.

6. Proper working conditions, professional development, rest, and welfare in accordance with legislation, University regulations, employment contracts, and collective agreements.

7. Free access to library, informational, educational, scientific, sports, and cultural resources.

8. Protection of intellectual property rights.

9. Qualification improvement and internships at least once every five years.

10. Provision of housing, including service housing, as prescribed by law.

11. Preferential long-term loans for construction, reconstruction, or purchase of housing.

12. Participation in civil associations.

13. Social and pension security in accordance with law, including under the Law on Scientific and Scientific-Technical Activity.

14. Other rights established by law and this Statute.

15. Involvement in work not specified in the employment contract requires consent or is allowed only in cases prescribed by law.

16. Academic positions require relevant scientific degrees or titles, or a master’s degree.

17. Vacant academic staff positions are filled following competitive selection prior to employment contract signing.

8.1.2. Guarantees for staff:

1. Proper working conditions, professional development, and welfare, including for staff with disabilities.

2. Compensation in case of job loss.

3. Additional pay for doctoral degrees in accordance with Ukrainian law, with potential for higher payments from University funds.

8.1.3. Obligations of academic, scientific, and teaching staff:

1. Teach at a high scientific, theoretical, and methodological level and conduct scientific activities (for academic staff).

2. Improve professional skills, teaching mastery, and scientific qualifications; undergo attestation as required.

3. Uphold pedagogical ethics and respect student dignity; foster patriotism and respect for Ukrainian Constitution and state symbols.

4. Maintain academic integrity in teaching and research; ensure students comply with it.

5. Promote independence, initiative, and creativity in students.

6. Comply with the Statute, internal regulations, job description, laws, and other legal acts.

8.2. Rights and Responsibilities of Students

8.2.1. Rights of students:

1. Choose the form of study upon admission.

2. Safe and healthy learning, work, and living conditions.

3. Engage in employment outside of study hours.

4. Additional paid leave, reduced working hours, and other benefits for combining work and study.

5. Free access to libraries, information resources, and University facilities.

6. Accessible learning materials for students with special educational needs.

7. Use of production, cultural, recreational, and sports facilities.

8. Dormitory provision with 24/7 access during study.

9. Participate in research, conferences, exhibitions, competitions, and publications.

10. Participate in educational, scientific, cultural, sports, and community activities.

11. Engage in discussions on improving educational processes, research, scholarships, leisure, welfare, and recreation.

12. Make proposals regarding tuition fees and conditions.

13. Join public associations.

14. Participate in University and faculty self-governance, academic councils, and student self-government bodies.

15. Choose elective courses within at least 25% of ECTS credits for the degree.

16. Study in multiple programs or universities while obtaining only one degree per level from the state budget.

17. Academic mobility, including international mobility.

18. Receive social assistance where provided by law.

19. Count study periods for pension insurance if contributions are paid voluntarily.

20. Academic leave or temporary study interruption with retention of certain rights and reinstatement.

21. Participate in forming an individual study plan.

22. Receive moral and/or material encouragement for academic, scientific, cultural, or sports achievements.

23. Protection from exploitation, physical and psychological abuse.

24. Free internships at institutions and organizations with remuneration per law.

25. Vacation of at least eight calendar weeks per academic year.

26. Preferential state loans for higher education.

27. Appeal actions of University management, staff, and academic personnel.

28. Special rehabilitation support and accessible infrastructure for students with health limitations.

29. Receive scholarships as prescribed by law.

8.2.2. Obligations of students:

1. Comply with laws, the Statute, and internal regulations.

2. Follow safety, labor, sanitary, and fire safety rules.

3. Meet educational program requirements and academic integrity, achieving learning outcomes.

4. Adhere to moral standards.

5. Respect University symbols.

6. Acquire knowledge, practical skills, and modern research methods.

7. Follow the educational schedule and attend classes.

8. Inform the University within three days if unable to attend for valid reasons.

9. Take care of University property and compensate for damages.

10. Contribute to University infrastructure development.

11. Uphold the University’s reputation.

12. Improve cultural and physical levels; reject immoral behavior.

8.2.3. Grounds for dismissal from the University:

1. Completion of the educational program.

2. Personal request.

3. Transfer to another higher education institution.

4. Non-compliance with the individual study plan.

5. Breach of the contract between the student and University or sponsor.

6. Other legal grounds.

A higher education student has the right to take a break from studies due to circumstances that make it impossible to complete the educational or scientific program, including health reasons, conscription for compulsory military service (in case the right to deferment is lost), family circumstances, and other valid reasons. Such students are granted academic leave in accordance with the established procedure.

Study or internship at educational or research institutions (including those in foreign countries) may also serve as grounds for a break in studies, unless otherwise provided by international acts or agreements between higher education institutions.

Students called up for military service due to mobilization are guaranteed retention of their place of study and continued scholarship payments.

Students exercising the right to academic mobility, during studies, internships, or research activities at another higher education or research institution in Ukraine or abroad, are guaranteed retention of their place of study and scholarship payments in accordance with Ukrainian legislation governing the implementation of the right to academic mobility. Such students are not expelled from the University.

A student expelled from the University before completing the relevant educational program has the right to be re-enrolled within the licensed capacity of the University. Re-enrollment of students who were expelled or granted academic leave, as well as transfers of higher education students, is usually carried out during vacation periods.

IХ. Scientific, Technological, and Innovation Activities of the University

9.1. Scientific, technological, and innovation activities at the University are an integral part of educational activities and are carried out with the aim of integrating scientific, educational, and production activities within the system of higher education, in accordance with the legislation of Ukraine on educational, scientific, technological, and innovation activities, and are conducted directly on the basis of autonomy.

9.2. In terms of conducting scientific and technological activities, the University is subject to state attestation in the manner determined by the Cabinet of Ministers of Ukraine. Upon successful completion of state attestation in the field of scientific (technological) activities, the University is entitled to the guarantees for the provision of scientific (technological) activities established by the Law of Ukraine “On Scientific and Scientific-Technical Activities” for research institutions.

9.3. The main objective of scientific, technological, and innovation activities at the University is the acquisition of new scientific knowledge through conducting research and development, as well as their application towards the creation and implementation of new competitive technologies, types of equipment, materials, and more, in order to ensure the innovative development of society and the training of innovation-oriented specialists.

9.4. The main tasks of scientific, technological, and innovation activities at the University are defined by the Laws of Ukraine “On Higher Education” and “On Scientific and Scientific-Technical Activities.”

9.5. The subjects of scientific, technological, and innovation activities at the University include research and academic staff, students of the University, other employees of the University, as well as employees of enterprises, institutions, and organizations that jointly conduct scientific, technological, and innovation activities with the University.

9.6. The organization of scientific, technological, and innovation activities, as well as the training of scientific and academic staff at the University, is carried out by the Rector and, by his/her authorization, by the Vice-Rector for Research.

9.7. Scientific, technological, and innovation activities may also be carried out by the University through legal entities established by it, whose activities are aimed at developing the results of the University’s scientific and technological work into innovative products and their subsequent commercialization.

9.8. Scientific research at the University is carried out in accordance with thematic plans approved by the Academic Council of the University; with work plans commissioned on a competitive basis by research teams or individual scholars in line with national, state, regional, international, cross-sectoral, and other programs, projects, and developments; and on the basis of economic contracts. The University registers research projects, conducts expert evaluations of their results, and submits informational and statistical data to the relevant governing authority.

Research funded by the state budget is financed by the Ministry of Education and Science regardless of the financing of educational activities. Scientific and technological activities at the University may also be carried out under economic contracts and may be expanded through the use of other sources of funding (grants, internal funds, etc.).

Х. Sources and Use of the University’s Funds and Property

10.1. Material and Technical Resources of the University

The material and technical resources of the University include buildings, facilities, land, communications, equipment, vehicles, service housing, and other tangible assets.

In accordance with the legislation and taking into account the organizational and legal form of the University, with the aim of ensuring its statutory activities, the Ministry of Education and Science (MES) assigns to the University, on the basis of the right of economic management, buildings, facilities, property complexes, communications, and service housing.

Land use and the exercise of land ownership rights, including the acquisition of the relevant land rights, are carried out by the University in accordance with the Land Code of Ukraine.

Property assigned to the University under the right of economic management may not be used as collateral, nor may it be seized, alienated, privatized, misused, or transferred to legal or natural persons without the consent of the MES and the Conference of the University Staff, except as provided by law.

The University’s own revenues obtained from payment for services provided in the framework of educational, scientific, and training-production activities, as well as charitable contributions and grants, shall, in accordance with decisions adopted by the Academic Council of the University, be credited to special registration accounts opened in the territorial body of the central executive authority responsible for treasury services of budgetary funds, or to current and/or deposit accounts in state banks. Such revenues, as well as interest accrued from placing University funds on deposit accounts in state banks, are included in the financial plan (budget) of the University and may be used for the acquisition and utilization of property, capital construction and renovation of facilities, and the improvement of the material, laboratory, and methodological resources for the educational process, within the framework of the University’s statutory activities.

The lease of property assigned to the University under the right of economic management shall be carried out without the right of purchase, in accordance with the legislation.

Buildings, facilities, and premises of the University must comply with accessibility requirements under state construction norms and standards. If such facilities cannot be fully adapted to the needs of persons with special educational needs, they shall be reasonably adapted in accordance with the principles of universal design.

The design, construction, and reconstruction of University buildings, facilities, and premises shall be carried out with due consideration of the needs of persons with special educational needs.

Land plots shall be granted to the University, regardless of the form of ownership, for permanent use in accordance with the procedure defined by the Land Code of Ukraine.

Damages caused to the University as a result of violations of its property rights by individuals, legal entities, or state authorities shall be compensated to the University by court decision.

The University independently disposes of revenues and other funds received from the provision of paid services permitted by law.

10.2. Sources of Financing of the University

The University is financed from the state budget and additional sources not prohibited by law (general and special funds). Funding from the state budget is provided on a normative basis through state procurement for the training of specialists, research, and academic staff, as well as from other lawful sources, with adherence to the principles of targeted and efficient use of funds, publicity, and transparency in decision-making.

Funds received by the University as payment for studies, training, retraining, or professional development, or for the provision of educational services, may not be withdrawn to the revenue of state or local budgets.

Additional sources of financing include:

1. funds received for training, professional development, and retraining of personnel under contracts;

2. payment for additional educational services;

3. funds received for research (services) and other work performed by the University under contracts with enterprises, institutions, organizations, and individuals;

4. income from the sale of products and processed goods of training and production workshops, enterprises, facilities, and farms, as well as from leasing or use of premises, facilities, and equipment;

5. subsidies from executive authorities, local self-government bodies, and private individuals;

6. loans and borrowings from banks, dividends from securities, and income from placing temporarily free off-budget funds on deposit accounts;

7. foreign currency revenues;

8. voluntary financial contributions and material assets received from enterprises, institutions, organizations, individuals, and other sources.

The University independently disposes of its own revenues obtained from the provision of paid services, works, and other types of economic activity permitted under Ukrainian law.

10.3. State Procurement as a Source of Financing of the University

Placement of state procurement is carried out on a competitive basis, under the principles of fair competition, openness and transparency, equality, objective and impartial evaluation of proposals. State procurement for the training of bachelor-level specialists is concluded through contracts between state procuring authorities to which the University is subordinated and the University, provided that the University has duly submitted information regarding admission of persons who, on a competitive basis, obtained the right to higher education financed by the State Budget of Ukraine.

10.4. Paid Services as a Source of Financing of the University

In accordance with legislation and this Charter, the University may provide paid services to individuals and legal entities, provided that the quality of educational services as the primary statutory activity is ensured. The list of paid educational and other services that may be provided by the University shall be approved by the Cabinet of Ministers of Ukraine. The procedure for the provision of such services, including the determination of their cost for students, shall be established by the MES, the central executive body responsible for economic policy, and the central executive body responsible for financial, budgetary, and tax policy.

The University may provide paid educational and other services exclusively in addition to the volumes established by the state standard, and outside the scope of activities financed from the relevant budgets. Paid educational services may be provided by the same structural units responsible for educational processes under state procurement or by separate structural units established for the provision of paid services, operating on the basis of regulations approved under legislation and this Charter. Paid educational and other services may be provided by the University only if its material and technical resources comply with legislative requirements, and, where required by law, upon obtaining the necessary licenses or permits.

10.5. Financial Management of the University

The University is financed from the following sources:

1. the general fund, within the framework of state or local procurement and research activities;

2. the special fund, formed from revenues obtained for training, retraining, professional development, provision of additional educational services under contracts with legal entities and individuals, income from leasing property, premises, and equipment, revenues from research, experimental, design, exploratory, and other works (services) performed by the University under contracts with enterprises, institutions, organizations, and individuals, as well as other revenues permitted by law.

Attracted funds shall be used for the implementation of the statutory activities of the University in the manner and on the terms defined by law and this Charter.

Remuneration at the University shall be carried out in accordance with the Labour Code of Ukraine, the Laws of Ukraine “On Education,” “On Higher Education,” “On Scientific and Scientific-Technical Activities,” regulations of the Cabinet of Ministers of Ukraine, orders of the MES, intersectoral and sectoral agreements, and the University’s Collective Agreement, in accordance with pay scales and tariff rates set by the Cabinet of Ministers of Ukraine, and contracts. Forms and systems of remuneration, conditions and criteria for bonuses, procedures for establishing allowances and surcharges, as well as procedures for setting and cancelling increased salaries and scholarships, shall be determined in accordance with legislation.

ХІ. Reporting and Control of the University’s Financial and Economic Activities

11.1. As a budgetary institution maintained at the expense of the state budget, the University prepares and submits reports in accordance with the requirements of budgetary legislation.

11.2. The University independently carries out operational, accounting, and financial record-keeping of its activities, maintains statistical reporting, and provides information upon request of the authorities vested by the legislation of Ukraine with the right to exercise control over the relevant areas of activity.

11.3. The Rector and the Chief Accountant of the University bear personal responsibility for the accuracy of the University’s accounting, financial, and statistical reporting.

11.4. The Chief Accountant exercises constant control over compliance with accounting procedures.

11.5. The University’s activities are subject to audit in accordance with the applicable legislation.

11.6. The University publishes the following information on its official website:

1. the budget estimate for the current year and all amendments thereto;

2. the report on the use and receipt of funds;

3. information on the conduct of tender procedures;

4. the staff schedule for the current year.

XII. International Relations of the University

12.1. The University carries out international cooperation, concludes agreements and memoranda of cooperation, and establishes direct relations with higher education institutions, research organizations, enterprises of foreign countries, international organizations, foundations, and others in accordance with the legislation. The main areas of international cooperation of the University are defined by the Law of Ukraine “On Higher Education.”

12.2. The University conducts foreign economic activities in accordance with the legislation through the conclusion of contracts with foreign legal entities and individuals. The main areas of the University’s foreign economic activities are defined by the Law of Ukraine “On Higher Education.”

12.3. Foreign currency and material revenues from the University’s foreign economic activities are used to ensure the fulfillment of its statutory objectives.

12.4. The University’s representation in international relations and foreign economic activities is carried out by the Rector or by a person authorized by him/her.

XIII. Amendments to the University Statute

13.1. The Statute of the University is approved by the Conference of the University Staff upon submission by the Academic Council of the University and is submitted to the Ministry of Education and Science for ratification.

13.2. Amendments to this Statute are formalized by adopting a new edition and are approved in the same manner as the Statute itself.

XIV. University Reorganization and Liquidation Procedures

14.1. The liquidation and reorganization (merger, accession, division, transformation) of the University shall be carried out in accordance with the legislation.

14.2. The liquidation of the University is carried out by a liquidation commission established by the Ministry of Education and Science (MES). The liquidation commission shall include representatives of the MES and the University. The procedure, as well as the deadline for creditors to submit claims against the University being terminated, shall be determined by the MES.

14.3. From the moment of appointment, the liquidation commission assumes the authority to manage the University’s affairs. The liquidation commission shall prepare the University’s liquidation balance sheet and submit it for approval by the MES.

Creditors and other legal entities with contractual relations with the University shall be notified of its liquidation in writing.

In the event of the termination of the University’s activities (as a result of liquidation, merger, division, accession, or transformation), its assets shall be transferred to one or several non-profit organizations of the corresponding type or credited to the state budget.

14.4. During the liquidation and reorganization of the University, the rights and interests of released employees shall be guaranteed in accordance with the labor legislation of Ukraine.

The reorganization or liquidation of the University shall not infringe upon the rights and interests of students enrolled at the University.

14.5. The University shall be considered as having ceased its activities from the date of its entry as terminated in the Unified State Register of Legal Entities, Individual Entrepreneurs, and Public Organizations.
