1. General regulations
1.1 Regulatory framework of the regulations on the Commission on academic integrity
In order to monitor and comply with the norms of this regulation by employees and participants of the educational process, a Commission on academic integrity (hereinafter referred to as the Commission) is established at the University.
In its activities, the Commission is guided by the Constitution of Ukraine, the laws of Ukraine "On education", "On higher education", "On scientific and scientific-technical activities", "On copyright and related rights", "On publishing", "On prevention of corruption", the Civil Code of Ukraine, the University Charter, the internal regulations of the University, the Collective Agreement, the guidelines of IAU-MCO (International Association of Universities and the Magna Charta Observatory) regarding the institutional code of ethics of Higher Education, the European Charter of researchers, the Berlin Declaration on open access to knowledge in Science and the humanitarian sphere, the Bucharest declaration of ethical values and principles of higher education in Europe and other regulatory legal acts of the current legislation of Ukraine and intra-university regulations and this regulation.
2. Rights and power of the Academic Integrity Commission
Power of the Commission:
- receive and consider applications for violation of the principles of academic integrity, analyze them and prepare appropriate conclusions, as well as accept and consider appeals and make decisions on them, etc.;
- involve experts from various fields in their work, as well as use technical and software tools to reliably establish the facts of violation of the norms of academic integrity on the submitted application;
- conduct information work to popularize the principles of academic integrity and professional ethics of scientific and pedagogical, research workers and applicants for higher education;
- prepare proposals to improve the effectiveness of implementing the principles of academic integrity in the educational and scientific activities of the University;
- provide recommendations and advice on ways and means to better comply with the provisions of this regulation;
- other powers in accordance with the requirements of the current legislation of Ukraine and internal university regulations.
The Commission is authorized to receive applications for violations of academic integrity and appeals related to issues related to the assessment of knowledge of educational applicants and determining learning outcomes; to consider them and make appropriate decisions; to submit proposals to the university administration on the imposition of appropriate sanctions.
3. Procedure for forming and functions of the Commission
3.1 Composition of the Commission on academic integrity and organizational forms of its work
The Commission consists of members of the university community, namely:
Permanent members of the Commission ex officio:
- Chairman of the university employees' Trade Union;
- Chairman of the University Students' Trade Union;
- Student Ombudsman;
- deans of university faculties;
- head of the legal department.
Individuals appointed or elected to the Commission:
- four individuals on the recommendation of student self-government bodies;
- representative from scientific schools;
- representative of the administration by order of the Chancellor of the University.
The composition of the Commission is considered at a meeting of the Academic Council. The term of office of the Commission is two years.
At the first meeting, the Commission elects the Chairman and Secretary of the Commission by a simple majority of votes from among its members.
Membership in the Commission is terminated in the following cases:
- submission of an application by a member of the Commission to resign at his own request;
- systematic failure to fulfill the duties of a member of the Commission or violation of the University's code of ethical conduct;
- termination of employment relations with the University or exclusion from the list of university applicants.
An application for resignation of a member of the Commission delegated from the scientific and pedagogical staff and other divisions of the University is submitted to the Chairman of the Commission.
An application for resignation of a member of the Commission delegated from applicants is submitted to the Student Ombudsman for consideration.
Members of the Commission may not delegate their powers to other persons.
Any employee or applicant of higher education of the University can apply to the Commission with a statement about violation of the norms of this regulation, making suggestions or additions.
Organizational form of work
The organizational form of the Commission's work is a meeting.
Meetings can be regular, held within the time limits specified in the work plan, or extraordinary, which are convened if it is necessary to resolve operational and urgent issues.
The meeting of the Commission begins if there is a quorum of at least 2/3 of the Commission's composition. The Chairman of the Commission conducts meetings, signs protocols and decisions, and so on. In the absence of the Chairman, his duties are performed by a deputy.
The secretary is responsible for keeping the protocols of the meeting, technical preparation of materials for consideration at the meeting, etc.
Decisions are made by secret ballot. The decision is considered adopted if more than half of those present at the Commission meeting voted for it.
The meeting of the Commission is drawn up in protocols, which are signed by the Chairman and Secretary.
The Commission reports on its work to the Academic Council of the University once a year.
Any participant in the educational process who has become aware of the facts of violation of the norms of this regulation or the preparation of the possibility of such violation should apply to the Chairman or Secretary of the Commission with a written statement addressed to its Chairman. The application must contain the applicant's personal data (last name, first name, patronymic, contact details: address, phone number, place of work, position, course, group, personal signature).
The Commission does not consider anonymous applications or applications submitted in incorrect form.
The applicant and the person against whom the issue of violation of the code of academic integrity or an appeal is being considered are invited to attend the Commission meeting. These conclusions are of a recommendatory nature and are submitted to the Chancellor of the University for further application of appropriate measures of a moral, disciplinary or administrative nature. Decisions on appeals related to the assessment of knowledge are final.
3.2 Rights of applicants when considering violations of academic integrity or appeals
The procedure for identifying and establishing violations of academic integrity is regulated by the regulation "On academic integrity".
Every person in respect of whom the issue of violation of academic integrity is considered has the following rights:
1) get acquainted with all the materials of checking the fact of violation of academic integrity, submit your comments or appeal to the Commission on academic integrity;
2) personally or through a representative provide oral and written explanations or refuse to provide any explanations, participate in the study of evidence of violation of academic integrity;
3) know the date, time and place and be present during the consideration of the issue of establishing the fact of violation of academic integrity and bringing it to academic responsibility;
4) appeal the decision to bring to academic responsibility to the Commission on academic integrity of the University or in court.
3.3 Procedure for consideration of appellate cases
The Commission considers the application and makes a decision no later than 20 working days from the date of registration of the application.
In exceptional cases, when the case concerns difficult circumstances and it is necessary to obtain additional information, the deadline for reviewing the application and making a decision can be extended to 40 business days. The Commission notifies the applicant of the extension of the time limit.
Meetings of the Commission are held behind closed doors, provided that there are no requests from members of the Commission and parties to the conflict for open consideration.
The parties to the conflict have the right to attend the meeting of the Commission and provide oral explanations.
If the Commission decides that consideration of the application is beyond its competence, the applicant must be notified in writing as soon as possible with an explanation of the reasons for refusal.

If a member of the Commission is unable to attend for valid reasons, he / she has the right to bring his / her opinion to the attention of the Commission in writing or to take part in a meeting of the Commission via videoconference.
3.4 Commission decision
The Commission's decisions are advisory in nature and are submitted to the Chancellor of the University for further consideration.
Decisions are made by secret ballot. A decision is considered adopted if more than half of the Commission members who were present at the meeting voted for it. If the votes of the Commission members are divided equally, the decision is considered rejected.
The decision of the Commission is drawn up in protocols, which indicate the date and place of the meeting, the list of issues considered at the meeting, and the decision of the Commission.
The protocol of the Commission is signed by the Chairman and Secretary. The protocol must be drawn up and submitted to the parties no later than two working days from the date of the meeting.
4. Final regulations
The regulations are approved by the Academic Council of the University and put into effect by order of the Chancellor of the University.
Control over the implementation of the regulation is carried out by university officials within the limits of their powers established in job descriptions.
Amendments and additions to the regulation are considered and approved by the Academic Council of the University and put into effect by order of the Chancellor of the University in accordance with the established procedure.
