1. General Provisions
1.1. These Regulations on the Conference of the Labor Collective (hereinafter - Regulations) of the National Aerospace University "Kharkiv Aviation Institute" (hereinafter - University) are developed in accordance with the Laws of Ukraine "On Education" dated 05.09.2017 No. 2145-VIII (as amended), "On Higher Education" dated 01.07.2014 No. 1556-VII (as amended), "On Scientific and Scientific-Technical Activity" dated 26.11.2015 No. 848-VIII (as amended), other regulatory acts of Ukraine, normative documents of the Ministry of Education and Science of Ukraine, the Statute of the University (hereinafter - Statute), and define and regulate the procedure for convening and operating the Conference of the Labor Collective of the University.
1.2. The Conference of the Labor Collective of the University, in accordance with Article 39 of the Law of Ukraine "On Higher Education" and the Statute, is the supreme collegial body of public self-government of the University.
1.3. The Conference of the Labor Collective of the University includes representatives (delegates) from among the scientific, scientific-pedagogical, pedagogical staff, other employees of the University, and students. Members of the University Supervisory Board have the right to participate in the conference with an advisory vote. If there are available seats in the venue, other representatives of all employee groups and student representatives may participate in the Conference of the Labor Collective of the University without voting rights, provided that this has been previously agreed upon with the organizing committee or the chair of the conference.
1.4. The mandate of the Conference of the Labor Collective of the University is established for a term of 1 year.
2. Powers of the University Labor Collective Conference
2.1. The University Labor Collective Conference has the following powers:
1) approves, upon the recommendation of the University Academic Council, the Statute or amendments (supplements) thereto;
2) hears the annual report of the University Rector and evaluates their activities;
3) elects the Labor Dispute Commission in accordance with labor legislation;
4) considers, upon a substantiated recommendation of the Supervisory Board or the University Academic Council, the issue of early termination of the University Rector's powers;
5) approves the internal regulations of the University or amendments (supplements) thereto;
6) considers and adopts the draft collective agreement or amendments (supplements) thereto, hears information on its implementation, and authorizes the trade union committee or another body authorized by the labor collective to sign the collective agreement with the Rector on behalf of the University collective;
7) approves the Regulations on Student Self-Government at the University, adopted by the supreme body of student self-government of the University;
8) approves the regulations on the Scientific Society of Students, Postgraduates, Doctoral Candidates, and Young Scientists of the University;
9) elects eligible representatives to the University Academic Council;
10) considers other highly relevant issues concerning the University's activities.
2.2. Matters that, according to the legislation of Ukraine and the University Statute, fall within the competence of the Rector, the Academic Council, the Supervisory Board, or other governing and self-governing bodies of the University and its faculties, shall not be included in the agenda of the University Labor Collective Conference and shall not be considered.
3. Procedure for Electing Delegates to the University Labor Collective Conference
3.1. The total number of delegates to the University Labor Collective Conference is 180 persons.
3.2. Ex-officio delegates to the conference include: the Rector, vice-rectors, deans, the academic secretary, the chief accountant, the heads of the planning and financial department, the legal department, the human resources department, the director of the scientific and technical library, the Rector's assistants, the head of the University’s primary trade union organization for employees, the head of the University’s primary trade union organization for students, postgraduates, and doctoral candidates, the head of the University Student Council, and the head of the University Scientific Society of Students, Postgraduates, Doctoral Candidates, and Young Scientists. In the event that a person ceases to hold such a position, their powers as a conference delegate are terminated, and the newly appointed person to said position acquires the powers of a delegate to the University Labor Collective Conference from the moment the decision on their appointment is made.
3.3. The remaining employee delegates to the conference are elected at general meetings of the labor collectives of the University’s structural units based on a quota proportional to the total number of employees in the respective categories:
3.3.1. At least 75 percent of the conference delegate composition (135 or more) must consist of scientific, scientific-pedagogical, and pedagogical staff of the University employed on a permanent basis.
3.3.2. At least 15 percent of the conference composition (27 or more) must consist of elected representatives from among the University students.
3.3.3. The remaining delegates (no more than 10 percent — 18 or fewer) shall consist of elected representatives from among other University employees (managerial, auxiliary educational, engineering and technical, administrative and support staff; hereinafter - other staff) working at the University on a permanent basis, as well as elected representatives of University postgraduates.
3.3.4. When determining quotas within a specific category, officials who are delegates to the University Labor Collective Conference ex-officio (Clause 3.2 of these Regulations) shall be taken into account.
3.3.5. If the number of candidates included in the voting list exceeds the established representation norms (quota) when electing delegates, the elected delegates shall be those who received the highest number of votes. If, during the election, multiple candidates receive an equal number of votes and not all can be accommodated within the quota, a repeat vote shall be held among those candidates.
3.4. Elected delegates to the University Labor Collective Conference from among scientific, scientific-pedagogical, and pedagogical staff are elected at general meetings of the labor collectives of the faculties, scientific and other structural units of the University where such staff work, in accordance with quotas, provided that more than 20% of the members from the list of the respective labor collectives are present at the time of the meeting, by open or secret ballot (the voting procedure is determined at the beginning of the meeting by the general meeting of the structural unit's labor collective by a simple majority). The quota for scientific, scientific-pedagogical, and pedagogical staff is distributed among faculties (other units) in proportion to the number of such staff working on a permanent basis according to the staffing table and is approved by the organizing committee in coordination with the University’s primary trade union organization for employees.
The procedure for nominating candidates for delegates to the University Labor Collective Conference from among scientific, scientific-pedagogical, and pedagogical staff and other matters regarding the election of such delegates are defined in Appendix A to these Regulations.
3.5. Elected delegates from among students are chosen according to the quotas of the respective faculty through direct secret ballot. The procedure for electing student delegates is defined in the Regulations on Student Self-Government of the University. All students enrolled at the University have equal rights and may elect and be elected as delegates. The student quota is distributed proportionally to the number of students in each faculty and is approved by the organizing committee upon the recommendation of the University Student Council. When a person ceases their studies at the University, their right to elect and be elected as a conference delegate terminates. Protocols with the results of the student delegate elections must be submitted to the organizing committee no later than two working days before the date of the conference.
3.6. Elected delegates from among other University staff (except those specified in Clause 3.4) are elected at general meetings of the labor collectives of the structural units where they work, in accordance with quotas, provided that more than 20% of members are present, by open or secret ballot (procedure determined by a simple majority at the meeting). It is possible to hold joint general meetings of several structural units to ensure the attendance of a sufficient number of employees to elect a delegate according to the quota. The quota for other staff is distributed among units in proportion to the total number of other staff and postgraduates (except those specified in Clause 3.4) and is approved by the organizing committee in coordination with the University’s primary trade union organization. The procedure for nominating candidates and other election issues for this category are defined in Appendix A. University postgraduates have the right to elect and be elected as delegates within their faculty under the quota for other staff.
3.7. To ensure proper organization, the Rector, by order, approves the composition of the organizing committee. The committee's main task is to prepare and hold the election of delegates, ensuring the democracy, openness, and transparency of the process. The powers of committee members begin when the Academic Council's decision on its composition enters into force and end when the University Labor Collective Conference begins its work.
3.8. When forming lists of persons entitled to participate in general meetings and determining quotas, the number of employees in certain categories as of the first day of the month in which the election is held is taken into account. The criterion for categorizing a staff member is their primary position at the University.
3.9. When forming student voter lists for direct secret elections and determining faculty quotas, the number of students as of the first day of the month of the election is taken into account. Students who are simultaneously staff members of the University participate in the election under the student quota.
3.10. Protocols with election results must be submitted to the organizing committee, which then transfers them to the Rector for approval of the personal composition of the conference delegates. The powers of elected delegates are established for the term of the University Labor Collective Conference and terminate simultaneously with the termination of the powers of the elected conference composition.
3.11. During the term of the elected conference composition:
3.11.1. in case of transfer/dismissal of a delegate from the position in the structural unit under whose quota they were elected, their powers are terminated from the moment employment at that position ends;
3.11.2. in case of completion of studies by a student delegate, their powers are terminated from the moment educational relations with the University end;
3.11.3. in case of prolonged illness, business trip (internship), or other reasons making it impossible to perform duties, such person may be recalled from the conference delegates by a decision of the general meeting of the respective structural unit or the student general meeting;
3.11.4. a new person shall be elected to replace the one whose powers were terminated, in the order specified in Clauses 3.4 - 3.6. The relevant protocol is submitted to the credential committee, which confirms the powers of the newly elected delegates.
3.12. A delegate may be recalled by a simple majority decision of the general meeting of the structural unit or student meeting from which they were delegated. The protocol is submitted to the credential committee, upon whose report the conference decides to terminate the delegate's powers. In this case, another person is elected to the vacant position no later than the next meeting of the University Labor Collective Conference in the order defined in Clauses 3.4 - 3.6.
4. Procedure for Convening the Conference
4.1. The University Labor Collective Conference is convened at least once a year and mandatorily for: hearing the report on the Rector's work and evaluating their performance, hearing the report by the parties on the fulfillment of the collective agreement conditions, and making amendments to it or adopting a collective agreement for a new term. A regular University Labor Collective Conference is convened by the University Rector. An extraordinary University Labor Collective Conference is convened at the request of at least 20 percent of the labor collective, or on the initiative of the Rector, the Academic Council, or the Supervisory Board of the University. An announcement regarding the convocation of the University Labor Collective Conference, as well as the time and place of its holding, is posted in advance on the official website of the University and on notice boards.
4.2. The decision to hold the University Labor Collective Conference is made with the specification of the date and time of the conference.
4.3. Prior to the commencement of the University Labor Collective Conference, at the first meeting of the newly elected composition of delegates, the organizing committee, based on the approved personal composition of the University Labor Collective Conference delegates:
1) prepares registration sheets for conference delegates and delegate identification card templates;
2) prepares drafts of the agenda, the composition of the presidium, and the working bodies of the conference;
3) notifies the University collective about the date, time, and venue of the conference;
4) prepares the premises for the conference;
5) prepares ballots for secret voting, if necessary;
6) organizes the registration of conference delegates.
4.4. When preparing the second and subsequent meetings of the current composition of the University Labor Collective Conference delegates, the duties specified in Clause 4.3 of these Regulations are performed by the credentials committee (if necessary, with the involvement of other representatives of the conference working bodies).
4.5. When preparing specific issues to be submitted for consideration by the University Labor Collective Conference, working groups may be formed, the composition of which is approved by a joint decision of the Rector and the primary trade union organization of the University employees.
5. Conference Procedure
5.1. The head of the organizing committee or a representative of the credentials committee reports to the University Rector on the results of the delegate registration and, provided that at least 2/3 of the elected delegates are present (i.e., the conference is quorum-compliant), the Rector opens the conference and proposes the election of a presidium.
5.2. The presidium elects a chair from among its members by a simple majority vote via open ballot, who:
5.2.1. Proposes the agenda and rules of procedure to the conference, and also proposes the election of the conference's working bodies (secretariat, editorial, credentials, and counting commissions). These issues are resolved by open ballot.
5.2.2. Grants the floor for reports and speeches, puts issues to a vote, and responds to statements and proposals submitted to the conference presidium.
5.3. Decision-making procedure.
5.3.1. The University Labor Collective Conference is authorized to consider issues and adopt decisions if at least 2/3 of the total number of delegates participate in its work.
5.3.2. A decision of the University Labor Collective Conference is considered adopted if at least 2/3 of the members present at the meeting voted for it.
5.3.3. The form of voting (open or secret) is determined by the conference.
5.3.4. Open voting may be conducted without a vote count in case of an obvious majority, unless any of the delegates demands otherwise.
5.4. The conference's working bodies are elected directly at the conference and remain active for the entire duration of the current delegate composition's mandate. The election procedure, powers, and form of voting for working bodies are determined by the conference. In the event a representative of a working body vacates their position, their replacement is carried out at the next conference meeting.
5.4.1. Secretariat:
- records speeches;
- accepts statements, complaints, and draft documents from delegates and submits them to the presidium.
5.4.2. Editorial Commission:
- prepares draft resolutions and finalizes them after discussion.
5.4.3. Credentials Commission:
- performs the functions of the organizing committee after its powers expire regarding the registration of delegates and reporting the results to the Rector;
- in case of changes in the personal composition of delegates, verifies the authenticity of their election based on protocols from general meetings of faculties, structural units, and student self-government, and reports to the conference on their legitimacy.
5.4.4. Counting Commission:
- upon instruction of the chair, counts votes during open or secret voting.
5.5. Preparation of the conference minutes.
5.5.1. The secretariat prepares the conference minutes, which shall specify:
- the date of the conference and its sequential number (numbering is maintained within the scope of the conference's mandate; the number of protocols must correspond to the number of conference convocations);
- the number of elected delegates by category:
- scientific, scientific-pedagogical, and pedagogical staff;
- other staff;
- students;
- the number of present delegates by category;
- the number of absent delegates;
- name, position of invited guests;
- name of the chair;
- names and positions of presidium members;
- composition of working bodies and commissions:
- credentials,
- editorial,
- counting,
- secretariat;
- agenda (topic title, reporter's name);
- heard: (reporter's name, topic, essence of the report);
- spoken: (names, positions, essence of speeches);
- resolution (text of the resolution, voting results).
5.5.2. If the conference considers several issues, the entry in the minutes is made accordingly. The minutes are signed by the chair and the head of the secretariat. The signatures of these persons are certified by the University's seal.
5.5.3. If a document is approved by a resolution of the conference, it is attached to the minutes.
5.5.4. The original minutes are kept by the University's Academic Secretary for three years, after which they are transferred to the University archive.
5.6. In the period between conferences, operational issues regarding the preparation and clerical work of the conference are managed by the chair of the University Labor Collective Conference and representatives of the conference's working bodies and commissions.
6. Final Provisions
6.1. These Regulations are approved by the Academic Council of the University and put into effect by the order of the University Rector.
6.2. Amendments, additions, and clarifications to these Regulations are made in the same order as provided for their adoption.
6.3. In case of amendments to regulatory acts that govern the relations defined in these Regulations, the norms of the legislation of Ukraine shall apply until the corresponding changes are made to these Regulations.
Appendix A
to the Regulations on the Conference of the Labor Collective
of the National Aerospace University
"Kharkiv Aviation Institute"
Procedure for Nominating and Electing Candidates for Delegates
to the University Labor Collective Conference from among Scientific, Scientific-Pedagogical
and Pedagogical Staff, as well as Other Employees
A1. The election of delegates from among the full-time staff of the National Aerospace University "Kharkiv Aviation Institute" (hereinafter - University) who are scientific, scientific-pedagogical, and pedagogical staff (hereinafter - SPS) or other employees (hereinafter - OE) to work at the University Labor Collective Conference, in accordance with the legislation of Ukraine, the Statute, and the Regulations on the University Labor Collective Conference, shall be conducted by open or secret ballot at general meetings of the labor collectives of the faculties or other structural units (hereinafter - Unit) where the SPS or OE work on a permanent basis in accordance with the staffing table. The voting procedure shall be determined at the beginning of the meeting by the participants of the general meeting by a simple majority vote through open ballot. If the open ballot procedure is chosen, it shall be conducted according to the rules established in this Appendix. If the secret ballot procedure is chosen, a recess shall be announced in the general meeting for the time necessary to produce ballots, place ballot boxes, etc., after which the work of the general meeting shall continue, taking into account the features established in Clause A18 of this Appendix.
A2. The election of delegates to the University Labor Collective Conference shall be organized and prepared by the organizing committee, the composition of which is approved by the University Rector (hereinafter - organizing committee). In exercising its powers, the organizing committee may involve other University officials and representatives of the University’s primary trade union organization in its work. Conference delegates from among SPS or OE must be elected no later than 2 working days before the date of the University Labor Collective Conference meeting.
A3. The organizing committee ensures the implementation of measures for the organization and conduct of the election of University Labor Collective Conference delegates, namely:
A3.1. Drawing up a schedule for holding general meetings of Units and determining quotas. The general quota for electing delegates to the conference from among SPS or OE is distributed among University Units in proportion to the total number of SPS or OE of the University in accordance with Clause A8 of this Appendix. When forming the quota assigned to a Unit, the organizing committee must take into account the quantitative composition of the SPS or OE working in the Unit in such a way as to ensure the possibility of electing one or more conference delegates at the Unit's general meeting, provided that the normal organization of the election procedure and proper proportional representation from various structural units are ensured.
A3.2. Informing SPS or OE about the election of delegates to the University Labor Collective Conference, the terms and procedure for nominating candidates for election as a conference delegate, and the date and place where the election of delegates by each Unit will take place.
A3.3. Determining the deadlines and procedure for submitting proposals regarding candidates for election as conference delegates, which must be submitted no later than 2 working days before the date of the Unit's general meeting. Candidates for election as a conference delegate shall be checked by the organizing committee for compliance with the conditions of Clause A6 of this Appendix. Proposals for candidates to be elected as delegates to the University Labor Collective Conference from among the staff specified in Clause A6 of this Appendix may be submitted by the Dean or other head of the Unit, the head of a structural unit that is part of the Unit, the Unit’s trade union bureau, or through self-nomination by a staff member who is a participant in the Unit's general meeting. The number of candidates whose names are submitted for voting cannot be less than the established quota for each Unit.
A3.4. Forming lists of SPS or OE of the Unit who have the right to vote for the purpose of electing conference delegates.
A4. SPS or OE of the Unit (as of the first day of the month in which the delegates' election is conducted) have the right to participate in the election of University Labor Collective Conference delegates. The criterion for categorizing a full-time University staff member is their primary position occupied at the University.
A5. A full-time University staff member from among SPS or OE who is on leave at the time of the delegates' election has the right to participate in the election of University Labor Collective Conference delegates and be elected as a conference delegate. If another person is holding the position occupied by such a full-time staff member during their leave, they also have the right to participate in the election of University Labor Collective Conference delegates and be elected as a conference delegate.
A6. Any full-time staff member from among SPS or OE who belongs to the category of scientific, scientific-pedagogical, and pedagogical staff or to the category of managerial, auxiliary educational, engineering and technical, or administrative and support staff, works at the University on a permanent basis, and has not expressed a wish to withdraw their candidacy, may be elected as a delegate to the University Labor Collective Conference.
A7. The organizing committee, with the involvement of the University's Human Resources Department staff, shall form lists of SPS or OE who have the right to vote for each Unit. Based on this list, members of the organizing committee responsible for organizing the election of delegates in the Unit, with the involvement of other Unit staff, shall admit participants of the general meeting of the Unit's SPS or OE to participate in the general meeting upon presentation of an identity document, a special status document, or proof of labor/educational relations with the University, including a pass. It is not prohibited to admit an SPS or OE from the specified list who does not have an identity document, a special status document, or proof of labor/educational relations with the University (including a pass) if their identity is confirmed by at least 3 participants of the general meeting who have the relevant documents available.
A8. Determination of the quota of delegates from each Unit from among SPS or OE is conducted in the following order:
A8.1. The general quota of delegates from among SPS, in accordance with Clause 3.3 of the Regulations, is at least 135 delegates, including relevant officials who are delegates to the University Labor Collective Conference ex-officio.
A8.2. The general quota of delegates from among OE, in accordance with Clause 3.3 of the Regulations, is no more than 18 delegates, including relevant officials who are delegates to the University Labor Collective Conference ex-officio.
A8.3. The number of delegates who have the authority of a conference delegate ex-officio is excluded from the 135 delegates from among SPS.
A8.4. The number of delegates who have the authority of a conference delegate ex-officio is excluded from the 18 delegates from among OE.
A8.5. The number of mandates remaining, in accordance with Clause A8.2 of this Appendix, constitutes the general quota for electing delegates from among SPS or OE at the general meetings of all Units from among SPS or OE.
A8.6. The quota for electing conference delegates from each Unit, within the limits of the number of mandates defined in Clause A8.3 of this Appendix, is determined based on the calculation of the number of full-time SPS or OE staff who have the right to elect conference delegates from an individual Unit in proportion to the total number of persons who have the right to participate in the election of conference delegates from among SPS or OE.
A9. Conference delegates from among SPS or OE who must be elected according to the quota specified in Clause A8.3 of this Appendix shall be elected at general meetings of the Units, provided that more than 20% of the members from the list of the respective labor collectives are present at the moment of the Unit's general meeting. One or more members of the organizing committee responsible for electing delegates from the given Unit must be present at this general meeting. A candidate who receives a majority of votes from the participants present at the general meeting is considered an elected conference delegate.
A10. A member of the organizing committee verifies the legitimacy of the general meeting (quorum), opens it, and proposes to elect by open ballot a chair and a secretary who will keep the minutes of the meeting, as well as a counting commission for vote counting.
A11. The counting commission for vote counting shall be elected in the number of 3 or 5 persons from among the participants of the Unit's general meeting by open ballot. The head of the counting commission shall be elected from among its members.
A12. The chair reports to the Unit's general meeting on the need to elect delegates to the conference, the determined quota for electing delegates from among the Unit's SPS or OE, and the list of candidates for election as conference delegates who submitted their candidacy within the established time to the organizing committee and meet the conditions of Clause A6 of this Appendix. Then, a vote on the procedure for electing conference delegates is conducted in accordance with Clause A1 of this Appendix.
A13. The chair, if necessary, repeats the list of candidates for election as conference delegates who submitted their candidacy within the established time to the organizing committee and meet the conditions of Clause A6 of this Appendix, and puts to an open vote the issue of determining the method of voting for candidates for conference delegates (nominative or by list). Furthermore, the chair draws the participants' attention to the fact that each participant of the Unit's general meeting may cast their vote for a number of candidates not exceeding the established quota.
A14. Open voting is conducted by a show of hands for "for" or "against" proposals regarding each candidate or the entire list of candidates. The results of the open vote may be determined without vote counting in the event of an obvious majority, unless any of the participants of the Unit's general meeting demands otherwise.
A15. If the number of candidates included in the voting list exceeds the established representation norms (quota), the elected delegates shall be those candidates who received the highest number of votes. In the event that candidates receive an equal minimum number of votes that exceeds the established quota for the Unit, a second round of elections shall be conducted among them in the same room, immediately after the vote count.
A16. The results of the vote count are entered into the minutes, which are compiled in two copies, each of which is signed by the head, the secretary, and the members of the counting commission. One copy of the minutes is handed over to a member of the organizing committee, the second copy is handed over for subsequent storage in the established order together with other documentation regarding the election of delegates and the work of the current convocation's labor collective conference.
A17. After the meetings are held in all Units, the organizing committee forms a general list of University Labor Collective Conference delegates from among SPS or OE and transfers it to the Rector no later than 2 days before the date of the first meeting of the current convocation's University Labor Collective Conference.
A18. Features of applying the secret ballot procedure when electing University Labor Collective Conference delegates from among SPS or OE.
A18.1. A member of the organizing committee responsible for the election of delegates from the Unit, in the event of a decision to apply the secret ballot procedure when electing conference delegates, must announce a recess for the time necessary to produce ballots, place ballot boxes, etc.
A18.2. Preparatory stage of the secret ballot procedure when electing University Labor Collective Conference delegates from among SPS or OE.
1) During the announced recess, the following is organized:
- preparation of the content of the ballot for voting according to the form established by the organizing committee, indicating the position and full name of each candidate for election as a delegate (the number of candidates whose names are included in the ballot cannot be less than the established quota of the Unit);
- production of ballots (the number of ballots must correspond to the number of participants in this Unit's general meeting);
- installation of ballot boxes for secret voting.
2) A member of the organizing committee ensures the voting process by providing the counting commission at the Unit's general meeting with:
- lists of staff members who have the right to vote for the purpose of electing conference delegates;
- ballots for voting;
- ballot boxes.
3) Before the start of voting, members of the counting commission verify:
- the correspondence of the number of ballots to the number of general meeting participants;
- the integrity of the ballot box.
A18.3. Voting stage when electing University Labor Collective Conference delegates from among SPS or OE.
1) Members of the counting commission, based on the list of persons who have the right to participate in voting, issue ballots against a signature to each staff member upon presentation of an identity document, a special status document, or proof of labor/educational relations with the University, including a pass. It is not prohibited to issue a ballot to a staff member from the specified list who does not have an identity document if their identity is confirmed by at least 3 participants of the general meeting who have the relevant documents available.
2) The ballot for voting is filled out by the person participating in the voting personally. On the ballot, the voting person makes a mark ("+") or another mark that confirms their will, after which they drop the completed ballot into the ballot box.
3) If the number of candidates included in the voting list exceeds the established representation norms (quota), the elected delegates shall be those candidates who received the highest number of votes. In the event that candidates receive an equal minimum number of votes that exceeds the established quota for the given Unit, a second round of elections shall be conducted among them in the same room, immediately after the vote count.
The member of the organizing committee and the counting commission re-produce the same number of ballots with the inclusion of the relevant candidates, after which the voting procedure is conducted similarly to the previous one.
A18.4. Stage of vote counting when electing University Labor Collective Conference delegates from among SPS or OE.
1) Vote counting begins immediately after the voting ends and is conducted without recess. Vote counting is carried out openly and publicly by members of the counting commission in the same room where the voting took place. After checking the integrity of the ballot box, it is opened by the counting commission. When the ballot box is opened, its contents are laid out on the table where the members of the counting commission are seated. The counting commission counts the total number of ballots issued for voting and the number of ballots found in the ballot boxes. It summarizes the voting results and compiles the minutes.
2) A ballot for voting may be declared invalid in the following cases:
- if more marks are made on the ballot than the established quota;
- if no mark is made;
- if it is impossible to establish the content of the will for other reasons.
In disputed cases regarding the classification of a ballot as invalid, the issue is resolved by a vote of the members of the counting commission.
3) The results of the vote count are entered into the minutes, which are compiled in two copies, each of which is signed by the head, the secretary, and the members of the counting commission.
