1. General Provisions

1.1 These Regulations are developed in accordance with the Laws of Ukraine “On Education”, “On Professional Pre-Higher Education”, “On Higher Education”, as well as the Charter of the National Aerospace University “Kharkiv Aviation Institute” (hereinafter referred to as the Charter), instructions “Procedure for the Preparation of Regulations on Structural Subdivisions” QMS KHAI-HRD-W/001:2015, and regulate the general managerial, economic, and legal foundations of the functioning of the Separate Structural Unit “Kharkiv Professional College of Information Technologies of National Aerospace University “Kharkiv Aviation Institute”” (hereinafter referred to as the College).

Pursuant to the directive of the Board under the People's Commissar of Posts and Telegraphs of the USSR (Minutes dated July 15, 1930, No. 2/43), the Kharkiv Electrotechnicum of Communications was established. In Soviet times, the Electrotechnicum of Communications was subordinated to the Main Directorate of Personnel, Educational Institutions, and Social Development of the Ministry of Communications of the USSR. In 1991, following the declaration of independence of Ukraine, the Kharkiv Electrotechnicum of Communications was subordinated to the Ministry of Communications of Ukraine, and subsequently to the State Committee for Communications and Information Technology of Ukraine. Due to the optimization of the sectoral network of higher educational institutions, pursuant to Order of the Cabinet of Ministers of Ukraine dated May 16, 2002 No. 261-r “On the Establishment of the State University of Information and Communication Technologies” and Order of the State Committee for Communications and Information Technology of Ukraine dated June 25, 2002 No. 126 and dated August 27, 2002 No. 178, the Kharkiv Electrotechnicum of Communications of the State Committee for Communications and Information Technology of Ukraine was reorganized by merging into the Kharkiv Technical School of the State University of Information and Communication Technologies. Pursuant to Order of the State Committee for Communications and Information Technology of Ukraine dated May 17, 2004 No. 103 “On Reorganization of Structural Subdivisions of the State University of Information and Communication Technologies” and Order of this University No. 106 dated May 20, 2004 “On Reorganization of Structural Subdivisions”, the Kharkiv Technical School was reorganized into the Kharkiv College of the State University of Information and Communication Technologies. Pursuant to Order of the Cabinet of Ministers of Ukraine dated June 26, 2013 No. 509-R, Order of the Ministry of Education and Science of Ukraine dated July 30, 2013 No. 1049, and Order of the State University of Telecommunications dated September 5, 2013 No. 11, a structural subdivision without legal personality was formed within the State University of Telecommunications — Kharkiv College of the State University of Telecommunications, which previously functioned as the Kharkiv College of the State University of Information and Communication Technologies and is its legal successor. Pursuant to Order of the Ministry of Education and Science of Ukraine dated June 11, 2020 No. 788 “On Renaming the Separate Structural Unit of the State University of Telecommunications” and Order of the State University of Telecommunications dated June 16, 2020 No. 126, the separate structural unit “Kharkiv College of the State University of Telecommunications” was renamed the Separate Structural Unit “Kharkiv Professional College of Information Technologies of the State University of Telecommunications”. Pursuant to Order of the Ministry of Education and Science of Ukraine dated July 13, 2021 No. 811, the College was reorganized by merging it into the National Aerospace University named after M. Ye. Zhukovsky “Kharkiv Aviation Institute” as the Separate Structural Unit “Kharkiv Professional College of Information Technologies of National Aerospace University named after M. Ye. Zhukovsky “Kharkiv Aviation Institute””. Pursuant to Order of the Ministry of Education and Science of Ukraine dated March 3, 2025 No. 401, the National Aerospace University named after M. Ye. Zhukovsky “Kharkiv Aviation Institute” was renamed the National Aerospace University “Kharkiv Aviation Institute” (hereinafter referred to as the University).

- in Ukrainian — Відокремлений структурний підрозділ «Харківський фаховий коледж інформаційних технологій Національного аерокосмічного університету «Харківський авіаційний інститут», abbreviated name: ВСП «ХФКІТ ХАІ»;

- in English — Autonomous Structural Unit «KHARKIV PROFESSIONAL COLLEGE OF INFORMATION TECHNOLOGIES OF NATIONAL AEROSPACE UNIVERSITY «KHARKIV AVIATION INSTITUTE» (abbreviated — ASU «KhPCIT KhAI»).

1.2 The College carries out its activities in accordance with the Constitution of Ukraine, Laws of Ukraine “On Education”, “On Complete General Secondary Education”, “On Professional Pre-Higher Education”, “On Higher Education”, “On Vocational (Vocational and Technical) Education”, “On Scientific and Scientific-Technical Activity”, regulatory acts of the President of Ukraine, the Cabinet of Ministers of Ukraine, the Ministry of Education and Science of Ukraine, other legislative and regulatory acts, the University Charter, orders (directives) of the Rector of the University, and these Regulations.

1.3 Staff positions of the College are determined in accordance with applicable standards. Staff positions of the College are reviewed and approved annually in accordance with the effective legislation of Ukraine. Financial and economic activities of the College are carried out within the approved budget (estimate) of the College.

1.4 The College, as a separate structural unit of the University acquiring the status of a professional pre-higher education institution, carries out educational activities related to obtaining complete general secondary education, professional pre-higher education, and higher education (initial level (short cycle) of higher education and/or first (Bachelor's) level of higher education) in accordance with the obtained licenses. The College may conduct scientific, research, creative artistic, and sports activities, as well as ensure the combination of theoretical learning with workplace training.

The activity of the College is conducted on the principles defined in the legislation of Ukraine on education. The educational process and office administration at the College are carried out in the state language, as defined by the Laws of Ukraine “On Ensuring the Functioning of the Ukrainian Language as the State Language”, “On Education”, “On Professional Pre-Higher Education”, and “On Higher Education”. The use of other languages is possible in cases provided for by the legislation of Ukraine and agreements on academic cooperation.

Educational activity is carried out by the College on the basis of licenses issued by the Ministry of Education and Science of Ukraine in the manner determined by the Cabinet of Ministers of Ukraine in accordance with the legislation of Ukraine. Types of activity requiring relevant permits and licensing are carried out by the College after receiving the necessary documents in accordance with the legislation of Ukraine.

1.5. The main areas of activity of the College are the training of qualified specialists for enterprises, institutions, and organizations of various ownership forms in the communications sector, in particular in the field of telecommunications and information technologies, in accordance with state orders and contractual obligations.

The College may carry out the following types of activity:

- educational activity, including for foreign citizens and stateless persons lawfully residing in the territory of Ukraine, under a license related to obtaining Professional Junior Bachelor and/or Bachelor degrees;

- provision of complete general secondary education;

- initial vocational training, vocational-technical training, retraining, and advanced training in blue-collar occupations;

- preparatory training for admission to professional pre-higher education institutions;

- professional development and staff retraining;

- scientific and practical activity;

- organization and holding of scientific, scientific-practical, and scientific-methodological events, including international ones;

- execution of external relations, international cooperation in education and science with educational institutions, scientific organizations, institutions, and foundations from foreign countries matching the College's profile;

- cultural, educational, methodological, editorial, and publishing activities;

- provision of paid services;

- financial, economic, and operational (production) activities;

- character-building and educational work;

- other types of activity in accordance with the legislation of Ukraine.

1.6 Management bodies, public self-governance bodies, and student self-governance bodies of the College are established in the College in accordance with the procedure established by the legislation of Ukraine, the Charter, and these Regulations. The structure of the College, the status, and functions of its structural subdivisions are determined by these Regulations and regulations on the respective structural subdivisions of the College. The structure of the College, as well as changes to it, form an integral part of the University structure, are considered and adopted by the governing bodies of the College, and, upon endorsement by the Academic Council of the University, are approved by the Rector of the University.

The main structural subdivisions of the College are: divisions, cycle commissions, professional education center, methodological office, preparatory division, information technology center, library, laboratories, educational and production workshops, academic affairs department, editorial and publishing department, international cooperation department, and other administrative and support subdivisions ensuring College operations: HR department, accounting, and administrative-facility support unit. In accordance with the main tasks of the College's activity, other structural subdivisions may be established and function therein in accordance with statutory procedures. Structural subdivisions of the College operate according to separate regulations signed by the Director

2. Tasks, Rights, and Duties of the College

2.1 The main tasks of the College are:

1) ensuring the realization of citizens' right to education;

2) carrying out high-level educational activities ensuring the training of applicants for professional pre-higher education, higher education (initial level, first (Bachelor's) level) of the corresponding degree according to educational and professional programs, majors, and specializations chosen by them;

3) organizing the educational process via distance learning mode if necessary;

4) organizing the educational process via dual education mode (combining theoretical education with workplace learning) if necessary;

5) participating in ensuring the social and economic development of the state through the formation of human capital;

6) fostering patriotism, social activity, civic stance and responsibility, academic integrity, legal and environmental culture, moral values, a healthy lifestyle, critical thinking, and self-organization skills in modern conditions among education seekers;

7) developing a comprehensive vocational guidance program among youth to encourage enrollment in the College;

8) ensuring an organic combination of educational, scientific, and innovative activities in the educational process;

9) creating necessary conditions for participants of the educational process to realize their abilities and talents, and preserving the health of participants in the educational process;

10) preserving and enhancing moral, cultural, and scientific values and achievements of society;

11) disseminating knowledge among the population, raising the educational and cultural level of citizens;

12) establishing international relations and implementing international activities in education, science, sports, art, and culture;

13) studying the labor market demand for specific majors and facilitating the employment of graduates;

14) retraining and professional development of personnel, as well as educational outreach activities;

15) facilitating the implementation of state-of-the-art teaching technologies into the educational process, organizing work on implementing standards of educational and methodological support in accordance with education standards;

16) interacting with employers, their organizations and associations, other social partners, professional associations, and promoting the employment of graduates;

17) effectively using property and funds for conducting educational activities.

2.2 The College has the right to:

1) develop and implement educational-professional and educational programs within licensed fields of study and majors, as well as introduce specializations;

2) independently determine modes of education and forms of educational process organization;

3) hire and dismiss teaching (academic) and other employees in accordance with the legislation of Ukraine;

4) form its own staffing table in accordance with legislation according to the procedures established at the University;

5) introduce incentive systems for participants of the educational process for educational, artistic, research, innovation, and sports achievements;

6) provide additional educational and other services in accordance with legislation;

7) independently develop and implement its own programs of educational, artistic, sports, and innovation activity;

8) independently determine the content and syllabi of academic disciplines;

9) award the educational and professional degree of Professional Junior Bachelor to applicants for professional pre-higher education, the higher education degree of Junior Bachelor (Junior Specialist) and/or Bachelor to applicants for higher education who have successfully passed the attestation procedure;

10) carry out publishing activities, including publishing textbooks, study guides, and developing its own printing facilities;

11) carry out joint activities with educational institutions, scientific institutions, and other legal entities on the basis of relevant contracts;

12) place its educational and educational-production subdivisions at enterprises, institutions, and organizations in accordance with the established procedure;

13) participate in the work of international organizations;

14) organize and hold scientific-practical and scientific-methodological conferences, meetings, seminars, Olympiads, presentations, including international ones, scientific tournaments, etc.;

15) carry out financial, economic, and other activities in accordance with legislation and these Regulations;

16) manage its own income, including revenue from the provision of paid services, in accordance with the established procedure;

17) open current and deposit accounts in banks in national and foreign currencies in accordance with legislation;

18) form educational-scientific, production complexes or other associations not prohibited by the legislation of Ukraine, jointly with scientific institutions, educational institutions, and enterprises;

19) conclude contracts and agreements with enterprises, organizations, institutions of all forms of ownership, and individuals in Ukraine and abroad in accordance with legislation;

20) carry out international relations and foreign economic activity on the basis of contracts with foreign legal entities and individuals in accordance with legislation;

21) use property assigned to the College under the right of commercial management, including for conducting economic activity, and lease and/or transfer it for use in accordance with legislation;

22) create its own or use, under contract, other material and technical bases for conducting educational, research, innovation, economic, sports, or cultural and artistic activities;

23) create and develop its own base of social and welfare facilities, a network of sports and health, medical and preventive, and cultural and artistic structural subdivisions;

24) carry out construction, reconstruction, and capital repairs of fixed assets upon approval with the University;

25) carry out routine repairs of fixed assets;

26) receive property under operational management (commercial management), funds, and material assets, including buildings, structures, equipment, and vehicles, from state bodies, local self-government bodies, legal entities, and individuals, including as charitable aid;

27) use assigned land plots and exercise rights to land in accordance with the Land Code of Ukraine;

28) enjoy tax and other benefits established by current legislation for educational institutions;

29) exercise other rights that do not contradict legislation.

2.3 In accordance with legislation, the University Charter, and these Regulations, the College may provide paid services to physical persons and legal entities, provided that a proper level of educational services is ensured.

The College has the right to provide additional paid educational and other services exclusively beyond the volumes established by the state standard and outside activities funded by the respective budgets.

Paid educational services may be provided by the same structural subdivisions that carry out the educational process under state orders, or by separate structural subdivisions of the College created for providing paid services, operating on the basis of regulations approved in accordance with legislation.

Paid educational and other services are provided by the College provided that the material and technical base complies with legislative requirements, and in cases where licensing or permits are required for providing a paid service, after obtaining the necessary authorization documents.

2.4 The College is obliged to:

1) comply with the licensing conditions for conducting educational activities;

2) maintain an internal quality assurance system for educational activities and the quality of professional pre-higher and higher education, including an approved policy for ensuring compliance with academic integrity by educational process participants (code of academic integrity), which meets the requirements and forms an integral part of the University's system for quality assurance of educational activity and higher education;

3) create necessary conditions for individuals with special educational needs to receive education;

4) take measures, including through the introduction of appropriate modern technologies, to prevent and detect violations of academic integrity in scientific and methodological works of teaching and other employees, individual assignments of professional pre-higher education seekers, and, if violations are detected, bring the guilty parties to academic liability;

5) have an official website, publish on the official website (web page), on information boards, and in any other manner information specified by legislation;

6) carry out educational activity based on the principles of student-centered learning;

7) ensure timely payment of taxes, fees (mandatory payments), and other deductions to budgets and state target funds in accordance with the legislation of Ukraine;

8) maintain accounting records, submit statistical, tax, and financial reporting in accordance with the legislation of Ukraine and in the manner established by the University;

9) carry out procurement of goods, works, and services in compliance with the requirements of the legislation of Ukraine on public procurement and procurement planning and organization procedures existing at the University;

10) adhere to financial discipline, ensure the preservation of state property assigned to the College under operational management;

11) comply with environmental requirements in accordance with the legislation of Ukraine;

12) ensure opportunities for professional development of academic, scientific, and teaching staff;

13) ensure proper implementation of the approved budget (estimate) of the College, assignments of the University management, obligations of the College to the State, state and other bodies, institutions, enterprises, as well as contractual obligations;

14) facilitate the activity of public self-governance bodies of the College;

15) ensure an adequate level of occupational safety, industrial sanitation, and work hygiene;

16) execute decisions of the Academic Council of the University and orders (instructions) of the Rector of the University;

17) comply in its activity with the requirements of the Constitution of Ukraine, the Laws of Ukraine «On Education», «On Complete General Secondary Education», «On Professional Pre-Higher Education», «On Higher Education», other regulatory legal acts, the University Charter, and these Regulations, participate in the work of governing bodies, public self-governance bodies, and student self-governance bodies of the University, adhere to the principles and requirements for educational, scientific, economic, financial, international, and other types of activity established at the University;

18) ensure timely payment of wages and scholarships, payment of taxes and other deductions in accordance with the legislation of Ukraine.

3. Legal Status of the College

3.1 The College is a separate structural unit of the University, enjoys financial autonomy, may acquire property and personal non-property rights on its own behalf, bear duties, and act as a plaintiff and defendant in court.

3.2 The College carries out its activity in accordance with the effective legislation of Ukraine, the University Charter, and these Regulations.

3.3 The College has an independent balance sheet, current and operational accounts in banking institutions, and registration accounts in the State Treasury Service of Ukraine, a seal displaying the State Emblem of Ukraine and its name, stamps, a logo, and letterheads with its printed name and identification code.

3.4 The College holds certain rights of a legal entity as defined by the effective legislation of Ukraine, the University Charter, and these Regulations. Within the powers granted by the power of attorney issued by the Rector of the University, the College may, on its own behalf and according to procedures established at the University, enter into civil law contracts with counterparties to support its operations. The College is not subject to state registration as a separate legal entity. Information regarding the College is entered into the registration file of the University and included in the Unified State Register of Legal Entities, Individual Entrepreneurs, and Public Formations.

3.5 For the purpose of carrying out its activity, the University endows the College with fixed and current assets, as well as other property, grants the right to manage them in accordance with effective legislation, as well as the right to independently maintain accounting records and pay taxes and fees at the location of the College.

3.6 The scope of rights and obligations granted to the College is determined by the Rector of the University in accordance with the procedure provided for by the legislation of Ukraine, and is formalized in these Regulations and the power of attorney issued in the name of the Director of the College. The College is subordinate to the Rector of the University. Supervision over the activities of the College is exercised by the Rector, as well as by Vice-Rectors managing relevant areas of work upon authorization of the Rector, and heads of University departments (units) according to specific lines of activity of the College. The Director of the College submits reports on their activity to the Rector of the University upon request.

4. Concept of Educational Activity of the College

4.1 The concept of educational activity of the College is a policy document containing the goals and principles of the educational activity of the College, aimed at ensuring through the educational process the comprehensive development of a person as an individual and the highest value of society, their ability for lifelong learning, and the fostering of moral values.

4.2 The educational activity of the College is based on the principles of the National Doctrine of Education Development, approved by the Decree of the President of Ukraine dated April 17, 2002, No. 347/2002, the Laws of Ukraine «On Education», «On Complete General Secondary Education», «On Professional Pre-Higher Education», «On Higher Education», the State National Program «Education» («Ukraine 21st Century»), approved by the Resolution of the Cabinet of Ministers of Ukraine dated November 3, 1993, No. 896 (as amended), the Concept of National-Patriotic Education of Children and Youth, Measures for the Implementation of the Concept of National-Patriotic Education of Children and Youth, and Methodological Recommendations on National-Patriotic Education in General Education Institutions (Order of the Ministry of Education and Science of Ukraine dated June 16, 2015, No. 641), as well as other legislative acts on education. The implementation of concepts is supported by existing and potential capacities of the College's staffing, scientific-methodological, and material-technical resources.

4.3 The goals of the educational activity of the College are: providing conditions for the comprehensive development of intellectual, physical, and scientific abilities of individuals studying at the College, necessary for acquiring their education, fostering high moral qualities, patriotism, and social consciousness in them, and providing educational services for training highly qualified specialists to meet the needs of Ukraine.

4.4 Specialist training is based on a systems approach, relevance, and necessity. The implementation of a systems approach to training education seekers of various levels is carried out taking into account a set of conditions (needs, market demands, socio-economic conditions, development of domestic and global education standards, etc.) and the impact of internal factors of the College's development (staff potential, material resources, information and methodological support of the educational process, etc.). The educational system of the College is modernized considering modern requirements, in accordance with the principles of humanization, democratization, continuity, practical focus, adaptability, and updating educational content according to new state and sectoral education standards, new educational-professional programs, and academic discipline syllabi.

4.5 The specialist training system at the College is defined by the principles of accessibility and equality in obtaining professional pre-higher education and higher education, independence of acquiring professional pre-higher education and higher education from political parties, public, and religious organizations, international integration and integration into the European Higher Education Area while preserving and developing the achievements and progressive traditions of the national higher school, openness in forming the structure and volume of educational and professional training of specialists, scientific rigor, continuity, information availability, humanization, and priority of social and spiritual values.

4.6 The main tasks of the College in the field of educational activity are:

- ensuring the competitiveness of the College through high guaranteed quality of educational services;

- adapting educational-professional and educational programs of the College to professional standards and employers' requirements, taking into account growing competition in the educational services market;

- implementing distance learning technologies into the educational process;

- organizing the educational process based on the principles of flexibility, consistency, scientific rigor, impartiality, and professionalism;

- defining clear benchmarks and transparent criteria for the effectiveness of educational activity;

- establishing a clear internal system for quality assurance of educational activity and the quality of professional pre-higher education and higher education;

- organically combining educational and scientific activities to ensure advanced innovative development of education;

- aligning educational programs with the needs of society according to the National Qualifications Framework and their competency orientation toward the labor market;

- developing educational activity standards for educational-professional degrees and degrees of professional pre-higher education and higher education;

- ensuring a high scientific-theoretical and methodological level of teaching academic disciplines in relevant areas and majors;

- introducing innovative teaching technologies and methods into the educational process;

- ensuring compatibility of educational programs with international classifications and standards of higher education;

- partnership and active participation of College employees (administration, teaching (academic) staff, teaching support staff) in supporting the educational activity of the College;

- facilitating the employment of College graduates by providing adequate practical training;

- cooperating with employers through concluding agreements to ensure the implementation of College graduates' right to work;

- promoting academic mobility of teaching (academic) staff and education seekers;

- carrying out measures to prevent academic plagiarism;

- conducting educational outreach activities.

4.7 The system of quality assurance of educational activity and quality of education of the College (internal quality assurance system) includes:

1) defining and publishing the policy, principles, and procedures for quality assurance of education integrated into the general management system of the College, aligned with its strategy, and involving internal and external stakeholders;

2) defining and consistently adhering to procedures for the development of educational-professional and educational programs that ensure the compliance of their content with education standards (professional standards), declared goals, consideration of stakeholders' positions, and clear definition of awarded and/or conferred qualifications, which must be aligned with the National Qualifications Framework;

3) conducting monitoring and periodic review of educational-professional and educational programs with the participation of education seekers to guarantee the achievement of set goals and their compliance with the needs of education seekers and society, including student surveys;

4) ensuring compliance with the requirements of legal certainty, publication, and consistent adherence to the College's regulatory documents governing all stages of training of education seekers (admission to study, organization of the educational process, recognition of learning outcomes, transfer, dismissal, attestation, etc.);

5) ensuring the relevance, reliability, transparency, and objectivity of assessment carried out within the framework of the educational process;

6) defining and consistently adhering to competence requirements for teaching (academic) staff, applying fair and transparent recruitment rules, and continuous professional development of personnel;

7) ensuring the necessary funding for educational and teaching activities, as well as adequate and accessible educational resources and support for education seekers under each educational-professional program;

8) ensuring the collection, analysis, and use of relevant information for effective management of educational-professional programs and other activities of the College;

9) ensuring public, clear, accurate, objective, timely, and easily accessible information about the College's activities and all educational-professional programs, terms, and procedures for awarding professional pre-higher education and higher education degrees;

10) ensuring compliance with academic integrity by College staff and education seekers, including the creation and operation of an effective system for preventing and detecting academic plagiarism and other violations of academic integrity, and bringing violators to academic liability;

11) undergoing external quality assurance procedures periodically;

12) engaging education seekers and employers as full partners in quality assurance procedures and measures;

13) ensuring adherence to student-centered learning in the educational process;

14) carrying out other procedures and measures defined by legislation.

4.8 Ensuring academic integrity is carried out in accordance with the Law of Ukraine «On Education», taking into account the specifics defined by the Law of Ukraine «On Professional Pre-Higher Education» and the Law of Ukraine «On Higher Education».

4.9 Every participant in the educational process is obliged to adhere to the principles of academic integrity.

4.10 Fostering academic integrity among education seekers is one of the tasks of the College.

4.11 The Director of the College and the collegial governing body of the College ensure compliance with the principles of academic integrity in the College within their competence.

4.12 Violations of academic integrity in the College, in addition to those provided for by the Law of Ukraine «On Education», include:

1) unauthorized collaboration - assistance provided to education seekers by teaching (academic) staff, parents, or other persons that is not envisaged by the task requirements;

2) academic fraud - the use of unapproved reference materials and/or technical devices during assessment events, passing learning outcome control procedures by proxies, or submitting works completed by other persons (including custom-made works) as the results of one's own work;

3) biased assessment - deliberate overestimation or underestimation of the learning outcomes of education seekers, their creative achievements, as well as the competencies of teaching (academic) staff of the College during their attestation or certification.

4.13 The procedure for detecting and establishing facts of academic integrity violations, as well as types of liability for specific violations, are determined by the collegial governing body of the College.

4.14 Decisions on the academic liability of teaching (academic) staff are made by the collegial governing body of the College or the attestation commission of the appropriate level.

4.15 Decisions on the academic liability of education seekers provided for by the Laws of Ukraine «On Professional Pre-Higher Education» and «On Higher Education» are made by the teaching (academic) staff member who detected the violation. In other cases, decisions may be made by the head and/or collegial governing body of the College upon approval with the student self-government bodies.

5. Powers of the Ministry of Education and Science of Ukraine and the University

5.1 The Ministry of Education and Science of Ukraine, as the authorized central body of executive power in the field of education and science:

- exercises control over the financial and economic activities of the College, as well as the efficient use of property assigned to the College under operational management in accordance with legislation;

- exercises control over compliance with the regulations on the College and the University Charter within the College;

- carries out licensing and accreditation of majors in which the College provides training, retraining, and professional development of specialists;

- provides funding for the College in accordance with established norms and activity areas;

- provides the College with necessary regulatory documents, as well as information on the status and directions of education development in Ukraine, key trends, domestic and international experience in organizing and conducting the educational process, etc.;

- exercises other powers provided for by legislation.

5.2 The rights and duties of the University regarding the management of the College are determined by the Laws of Ukraine «On Professional Pre-Higher Education», «On Higher Education», and other laws of Ukraine, the University Charter, as well as these Regulations.

5.3 The University, as a higher education institution with national status, within whose structure the College operates as a separate structural unit:

- manages the College based on the principles of autonomy and self-governance, demarcation of rights, powers, and responsibilities of the Ministry of Education and Science of Ukraine and the University management, a combination of collegial and sole management principles, and independence from political parties, public, and religious organizations;

- exercises control over the financial and economic activities of the College and the efficient use of property assigned to the College under operational management in accordance with legislation;

- appoints the Director of the College on a competitive basis in accordance with the procedure established by legislation, the University Charter, and these Regulations;

- dismisses the Director of the College in accordance with the established procedure;

- approves the appointment of deputy directors and the chief accountant of the College upon recommendation of the Director of the College;

- approves the composition of the Supervisory Board of the College;

- issues powers of attorney to represent the interests of the College and the University;

- develops, approves in accordance with established procedures, and implements university-wide rules and requirements for educational, scientific, innovation, economic, financial, and other activities that are mandatory for the College, including in the field of public procurement;

- reviews and recommends manuscripts of textbooks, study guides, and monographs for publication;

- approves regulations on the College and approves regulations on its structural units;

- makes decisions on the creation, reorganization, and closure of structural units of the College, and approves regulations on structural units of the College;

- initiates petitions before the Ministry of Education and Science of Ukraine and other authorities regarding the award of departmental incentive distinctions or state awards to teaching (academic) staff and employees;

- issues orders and instructions mandatory for execution by all employees of the College;

- exercises other powers regarding the management of the College.

5.4 The University may delegate certain powers regarding the management of the College to the Supervisory Board, the Director, and/or another governing body of the College.

6. Governing Bodies and Public Self-Governance Bodies of the College

6.1 The management of the College is carried out based on the principles of:

- autonomy and self-governance;

- demarcation of rights, powers, and responsibilities of the Ministry of Education and Science of Ukraine, the management of the University, the College, and structural units;

- combination of collegial and sole management principles;

- independence from political parties and religious organizations.

6.2 Management of the College within the powers defined by current legislation and these Regulations is exercised by:

1) the Rector of the University;

2) the Director of the College;

3) the collegial governing body of the College — the Pedagogical Council;

4) the highest body of public self-governance of the College — the General Meeting (Conference) of the College staff;

5) student self-government bodies of the College;

6) the Supervisory Board of the College;

7) other bodies defined by these Regulations.

6.3 Management of the College is exercised by the Rector of the University. Direct management of the College's activities is carried out by the Director of the College.

6.4 In accordance with legislation, the Rector of the University appoints to position (dismisses from position) the Director of the College, enters into a contract with them for a term of up to 5 years, and issues a power of attorney for the right to perform legal actions on behalf of the College and/or the University.

6.5 The exclusive competence of the Rector of the University includes:

- management and disposal of the College's property;

- execution of agreements and contracts, except for those the Director of the College has the right to conclude, and issuance of authorizations;

- supervision over the execution of the College's budget (estimate);

- issuance of orders on the creation of new structural units of the College;

- appointment of the Director of the College, approval of the appointment of deputy directors and the Chief Accountant;

- initiation of an unscheduled audit or inventory of the College's activities.

The Rector of the University may also resolve other matters regarding the College's operations in accordance with these Regulations, the University Charter, and effective legislative and regulatory acts, including those within the powers of the Director of the College.

6.6 Management of the College's activities is exercised by the Director, who acts in accordance with their powers approved by the Rector of the University and these Regulations, taking into account decisions of collegial and advisory bodies.

6.7 Direct management of the educational, pedagogical, administrative, and economic activities of the College is carried out by the deputy directors of the College and leading specialists responsible for these areas of activity in accordance with their job descriptions.

6.8 Teaching (academic) staff and other employees of the College are hired and dismissed by the Director of the College in accordance with current legislation.

6.9 The Chief Accountant of the College is appointed to position and dismissed from position in accordance with labor legislation, taking into account requirements for their professional and qualification level, by the Director of the College upon prior approval with the Rector of the University.

The Chief Accountant of the College:

1) organizes accounting work and ensures the fulfillment of tasks assigned to the accounting department of the College in accordance with the Regulations on the Accounting Department;

2) holds signature authority on all banking documents of the College;

3) bears personal responsibility for the correctness of calculations and timely transfer of funds, as well as correct, complete, and timely payment of taxes, fees, and mandatory payments;

4) prepares and submits financial statements to relevant authorities within statutory deadlines;

5) carries out instructions of the Chief Accountant of the University in the field of organizing the work of the University's accounting department and the College's accounting service, and provides information and reports to the Chief Accountant of the University upon their request;

6) performs other duties provided for by legislation.

6.10 Working bodies are established to resolve routine operational issues of the College — the directorate, administrative council, methodological council, admissions committee, scholarship committee, etc.

In order to develop the strategy and directions for educational and other activities of the College, the Director of the College has the right to initiate the creation of advisory (advisory-consultative) bodies on a voluntary basis — scientific-methodological council, employers' council, etc.

6.11 The Pedagogical Council is a collegial governing body of the College, the composition of which is approved annually by an order of the Director of the College.

The Pedagogical Council of the College:

1) defines the strategy and prospective development directions of the College;

2) approves, upon recommendation of the Director of the College, the draft Regulations on the College, as well as proposals for amendments thereto, for further consideration by the governing bodies of the University;

3) considers the draft budget (financial plan) of the College and the annual financial report of the College;

4) adopts decisions, in accordance with legislation, on placing the College's own revenues in territorial bodies of the central executive authority in the field of treasury service of budget funds or in banking institutions;

5) determines the system and approves procedures for internal quality assurance of education, including the system and mechanisms for ensuring academic integrity;

6) gives consent, upon recommendation of the Director of the College, to the appointment of heads of departments and chairs of cyclic commissions;

7) approves regulations on the organization of the educational process;

8) approves, upon recommendation of the Director of the College, for further consideration by the governing bodies of the University:

- decisions on the creation, reorganization, transformation (change of type), or liquidation of structural units of the College;

- other issues that require consideration by the Academic Council of the University;

9) submits proposals to the Academic Council of the University regarding the approval of the template and manufacturing procedure of its own education document;

10) has the right to submit a motion for the recall of the Director of the College on grounds provided for by legislation, the University Charter, these Regulations, and the contract, which is considered by the General Meeting (Conference) of the College staff and the governing bodies of the University;

11) discusses issues and determines measures to advance the qualifications of teaching (academic) staff and develop their creative initiative, and approves, in coordination with relevant departments of the University, the annual professional development plan for teaching (academic) staff;

12) adopts decisions and/or recommendations on the introduction of best pedagogical practices and innovations into the educational process, participation in research, experimental, and innovative activities, and cooperation with other educational institutions, scientific entities, physical and legal entities that contribute to the development of professional pre-higher education;

13) has the right to initiate an unscheduled institutional audit of the College;

14) adopts decisions on matters of improving methodological support of the educational process;

15) adopts decisions on issues concerning the liability of participants in the educational process for violations of academic integrity;

16) adopts decisions and/or recommendations on matters delegated for consideration by the Academic Council of the University, as well as on other issues in accordance with legislation, the University Charter, and these Regulations.

6.12 The Pedagogical Council of the College is headed by its Head, who is the Director of the College. The Pedagogical Council of the College ex officio includes: the Director of the College, deputy directors, heads of departments, head of the library, chairs of cyclic commissions, heads of laboratories, Chief Accountant, head of the elected body of the primary trade union organization of the College, as well as other teaching (academic) staff members, representatives of student self-government, who are elected to the Pedagogical Council according to the quotas defined by the Regulations on the Collegial Governing Body of the College. At the same time, at least 75 percent of the total composition of the Pedagogical Council must consist of teaching and/or academic staff members of the College, and at least 10 percent — elected representatives from among the students of the College. Elected representatives of education seekers are elected by the highest body of student self-government of the College. Elected representatives from among the students of the College participate in the work of the Pedagogical Council of the College during the consideration of issues concerning the study, living conditions, and recreation of education seekers. During the consideration of other issues falling within the powers of the Pedagogical Council of the College, the rule regarding mandatory participation in the work of the collegial governing body of the College of at least 10 percent of elected representatives from among the students of the College does not apply.

6.13 Decisions of the Pedagogical Council of the College, adopted in accordance with legislation, are mandatory for execution by all participants in the educational process at the College.

6.14 Decisions of the Pedagogical Council of the College are put into effect by orders of the Director of the College, unless a different approval procedure is provided for by these Regulations and/or the University Charter. In such case, decisions of the Pedagogical Council are put into effect according to the procedure established at the University by orders of the Rector of the University.

6.15 The Supervisory Board of the College is created and its personal composition (3 persons) is approved for a term of five years by the Academic Council of the University.

6.16 A person cannot be a member of the Supervisory Board if they:

- have been declared legally incompetent or whose legal capacity has been restricted by a court decision;

- have a criminal record for committing a crime, if such criminal record has not been expunged or canceled in accordance with the procedure established by law;

- have been deprived of the right to hold relevant positions pursuant to a court sentence;

- have been found guilty of committing a corruption offense or a corruption-related offense by a court decision — within one year from the day the relevant court decision entered into force;

- have been subjected to an administrative penalty for a corruption offense or a corruption-related offense — within one year from the day the relevant court decision entered into force;

- fall under Part 3 of Article 1 of the Law of Ukraine «On Government Cleansing» (Lustration).

Employees and education seekers of the College cannot be members of the Supervisory Board.

6.17 The Supervisory Board of the College contributes to resolving prospective tasks of its development, attracting financial resources to support its activities in key development areas and monitoring their utilization, and fostering effective interaction between the College and state bodies, local self-government bodies, the public, public associations, and business entities in the interest of development, improving the quality of educational activity, and its competitiveness.

6.18 The Supervisory Board has the right to:

- facilitate the attraction of additional funding sources;

- participate in the work of the Pedagogical Council of the College with an advisory vote;

- participate in defining and approving the development strategy of the College;

- monitor compliance with the founding documents of the College;

- participate in the competitive selection process for the position of the Director of the College;

- consider annual reports of the Director on the implementation of the College's development strategy;

- initiate an unscheduled institutional audit of the College's activities (no more than once during the term of office of the Supervisory Board);

- track and resolve potential conflicts of interest in the activities of the Director of the College;

- submit motions to the Rector of the University regarding incentives for or recall of the Director of the College on grounds defined by legislation, these Regulations, or the contract;

- exercise other rights defined by the legislation of Ukraine regarding the powers of supervisory boards of professional pre-higher education institutions, the University Charter, and these Regulations.

6.19 The Supervisory Board of the College is guided in its activity by the principles of transparency and accountability. Minutes, video broadcasts, and/or verbatim transcripts of the Supervisory Board meetings are published on the official website (web page) of the College within one week from the date of the respective meeting.

6.20 The Supervisory Board elects its Head and Secretary at its meeting.

6.21 Meetings of the Supervisory Board are held at least once a year. The decision to hold a meeting is made by the Head of the Supervisory Board individually or at the request of at least two of its members. A meeting is deemed quorate if at least 2 members participate in it. A decision of the Supervisory Board is deemed adopted if at least 2 present members vote in favor of it. Minutes are taken during the Supervisory Board meeting.

6.22 The work of the members of the Supervisory Board is carried out on a voluntary basis. Expense reimbursement for members of the College's Supervisory Board may be carried out in accordance with the procedure established by the Cabinet of Ministers of Ukraine.

6.23 The Academic Council of the University has the right to terminate early the powers of the Supervisory Board or its individual members.

6.24 Decisions of the Supervisory Board are brought in writing to the attention of the Director of the College within a five-day period and are mandatory for consideration and appropriate response.

6.25 The highest collegial body of public self-governance of the College is the General Meeting (Conference) of the College staff, including elected representatives from among the students.

6.26 The General Meeting (Conference) is held at least once a year. The organization of preparation and conduct is carried out by the College management and the Trade Union Committee as the body authorized by the College staff.

6.27 All categories of participants in the educational process of the College must be represented at the General Meeting (Conference) of the staff. At the same time, at least 75 percent of the delegates to the General Meeting (Conference) of the College staff must consist of teaching (academic) staff members who work at the College as their primary place of employment, and at least 10 percent — elected representatives from among the students of the College, who are elected by the highest body of student self-government. Delegates from among the employees are elected by meetings of individual structural units of the College in accordance with the quotas established by the Pedagogical Council.

The procedure for nominating candidates and other matters regarding the election of delegates to the General Meeting (Conference) of the College staff are determined by separate regulations.

6.28 The General Meeting (Conference) of the College staff performs the following functions:

1) approves, upon recommendation of the Pedagogical Council of the College, the Regulations on the College and amendments and additions thereto;

2) considers the draft collective agreement within the scope of competence of the College, approves it, and authorizes the Trade Union Committee to sign the agreement with the Director on behalf of the staff; approves internal work rules of the College and the collective agreement;

3) elects the Labor Dispute Commission in accordance with labor legislation;

4) hears the annual report of the Director and evaluates their performance;

5) considers, upon reasoned recommendation of the Pedagogical Council of the College, the issue of early termination of powers of the Director and submits the relevant motion to the Rector of the University;

6) adopts decisions on other issues concerning College activities in accordance with the legislation of Ukraine and regulatory documents of the University.

6.29 A meeting of the General Meeting (Conference) of the College staff is quorate if 51% or more of the total number of delegates are present. Decisions are adopted by a simple majority of votes.

6.30 Decisions of the General Meeting (Conference) of the College staff are recorded in the minutes and, if necessary, put into effect by orders (instructions) of the Director. The Secretary of the General Meeting (Conference) of the College staff keeps minutes of the General Meeting (Conference) session. The Director of the College ensures the accounting and preservation of minutes of the General Meeting (Conference) of the College staff.

6.31 Student self-government operates in the College, being an integral part of public self-governance of the College. Student self-government is the right and opportunity of College students to resolve issues of study and living conditions, protection of their rights and interests, as well as to participate in the management of the College.

Student self-government unites all students of the College, including minors. All enrolled students of the College have equal rights regarding participation in student self-government, and may elect and be elected to its bodies.

Student self-government is exercised by College students directly, as well as through student self-government bodies elected in accordance with the procedure established by the Law of Ukraine «On Professional Pre-Higher Education».

6.32 In their activities, student self-government bodies are guided by the legislation of Ukraine, these Regulations, and the regulations on student self-government of the College.

6.33 The regulations on student self-government of the College shall define:

1) the structure of student self-government bodies, the procedure and frequency of their election and reporting, division of powers, and the procedure for carrying out their activities;

2) powers of student self-government bodies, in particular the approval procedure for decisions specified by the Law of Ukraine «On Professional Pre-Higher Education»;

3) the procedure for terminating the powers of College students elected to student self-government bodies, in particular regarding the initiation and conduct of a vote on their recall;

4) the procedure for exercising student self-government in the structural units of the College;

5) the procedure for holding elections of student representatives of the College to the student self-government bodies of the College and its structural units;

6) the principles for the establishment and functioning of the student research society.

6.34 Student self-government bodies operate on the principles of:

1) voluntariness, collegiality, and openness;

2) electability and accountability;

3) equality of rights of College students to participate in student self-government;

4) independence from the influence of political parties and religious organizations;

5) academic integrity.

6.35 Student self-government is exercised at the level of the academic group, department, and College.

Delegates to the general meeting (conference) of students are elected by College students through direct secret ballot for a term specified by the regulations on student self-government of the College, which cannot exceed one calendar year.

Heads of student self-government bodies and their deputies cannot hold office for more than two terms.

Upon termination of a person's studies at the College, their participation in the student self-government body is terminated in according with the procedure provided for by the regulations on student self-government of the College.

6.36 Student self-government bodies of the College:

1) participate in the management of the College in according with the procedure established by the Law of Ukraine «On Professional Pre-Higher Education» and these Regulations;

2) participate in discussing and resolving issues regarding the improvement of the educational process, research work, scholarship assignment, organization of leisure, health improvement, living conditions, and catering;

3) conduct organizational, educational, scientific, sports, health-improving, cultural, artistic, and other activities;

4) participate in measures (processes) ensuring the quality of education;

5) protect the rights and interests of students studying at the College;

6) delegate their representatives to working, advisory, and consultative bodies, as well as governing bodies of the College and the University;

7) adopt acts regulating their organization and activities;

8) participate in resolving issues of providing proper living conditions for students in dormitories and organizing student catering;

9) manage the funds of the student self-government body and the property provided to them in accordance with legislation; when forming the budget (financial plan) of the College, submit proposals mandatory for consideration regarding the development of its facilities and resources, including issues related to study, living conditions, and leisure of students;

10) submit proposals regarding the content of educational-professional programs;

11) have the right to declare protest actions;

12) have the right to unite into regional and all-Ukrainian organizations whose activities are non-political and non-religious;

13) perform other functions provided for by the Law of Ukraine «On Professional Pre-Higher Education» and the regulations on student self-government of the College.

6.37 Decisions are adopted upon agreement with the student self-government body of the College regarding:

1) dismissal of College students and their reinstatement for study (except for cases provided for by the Law of Ukraine «On Professional Pre-Higher Education»);

2) transfer of students studying at the College from one source of funding to another;

3) accommodation of persons studying at the College in dormitories and their eviction from dormitories;

4) approval of the regulations on the organization of the educational process at the College.

6.38 A decision on issues provided for in paragraph 6.37 of these Regulations may be made without approval if, within one month after receipt of the relevant submission, the student self-government body has not expressed its position.

6.39 The highest body of student self-government is the general meeting (conference) of students of the College.

6.40 The executive body of student self-government is the Student Council of the College.

6.41 The General Meeting (Conference) of students:

1) approves the regulations on student self-government of the College;

2) elects the head and members of the executive body of student self-government and evaluates their activities;

3) approves the procedure for using the property and funds of student self-government bodies, and for supporting student initiatives on a competitive basis;

4) approves the annual estimate of expenses (budget) of student self-government bodies, makes amendments to it, and hears the report on its execution;

5) elects an audit commission from among the students to exercise ongoing control over activities, the state of property use, and execution of the budget of student self-government bodies;

6) forms student election commissions from among the students of the College to organize and conduct elections to student self-government bodies;

7) elects representatives of College students to the highest collegial body of public self-governance and the collegial governing body of the College;

8) hears reports of executive, working, and audit bodies of student self-government, and evaluates their activities;

9) exercises other powers provided for by the Law of Ukraine «On Professional Pre-Higher Education» and the regulations on student self-government of the College.

6.42 The administration of the College has no right to interfere in the activity of student self-government bodies (except for issues related to the safety of participants in the educational process, as well as the use of budget funds and College property).

6.43 Decisions of student self-government bodies, adopted within their competence and brought to the attention of the administration, do not require approval, endorsement, or putting into effect by the head or other governing bodies of the College.

6.44 The financial basis of student self-government consists of:

1) funds of the special fund of the College in the amount determined by applicable legislation;

2) membership fees of students, the amount of which is established by the highest body of student self-government of the College.

The funds of student self-government bodies are directed toward fulfilling their tasks and exercising their powers in accordance with the estimates approved by them.

Student self-government bodies publicly report on the use of funds and execution of estimates at least once a year.

6.45 Subject to the availability of funds, the Director of the College shall comprehensively facilitate the creation of proper conditions for the operation of student self-government bodies, regarding which a relevant agreement is executed.

7. Director of the College

7.1 Direct management of the activities of the College is exercised by its Director. Rights, duties, and responsibilities of the Director of the College are defined by the legislation of Ukraine, these Regulations, contract, and power of attorney.

7.2 The Director of the College:

1) organizes the activities of the College;

2) is ex officio a member of the Academic Council of the University;

3) resolves issues of financial and economic activities of the College, forms and submits for approval its structure, forms the staffing table in accordance with legislation, establishes official salary rates for College employees according to tariff grades, manages property and funds, and ensures compliance with staff and financial discipline;

4) ensures the development of, and is responsible for the implementation of the approved development strategy of the College;

5) ensures compliance with applicable legislation, the University Charter, these Regulations, and the execution of decisions of the highest body of public self-governance and the collegial governing body of the College;

6) submits the draft regulations on the College to the highest collegial body of public self-governance of the College for approval;

7) issues orders and instructions within their powers, and gives assignments that are binding on all participants in the educational process and structural units of the College;

8) represents the College in state and other bodies, and is responsible for the results of the College's activities to the State and the University;

9) ensures the execution of the budget (financial plan), and enters into contracts (agreements, arrangements);

10) hires and dismisses employees according to procedures agreed upon with the University, standard employment contract forms, and within the limits of the approved staffing table;

11) applies moral and material incentive measures, and imposes disciplinary sanctions in accordance with applicable legislation;

12) appoints heads of departments and cyclic commissions upon the consent of the collegial governing body of the College;

13) ensures occupational safety and health, health and safety, and compliance with law and order;

14) defines functional duties and approves job descriptions of College employees (job descriptions of deputy directors and heads of structural units of the College are subject to approval by the University Vice-Rector overseeing the relevant line of work; job descriptions of the Chief Accountant/Accountant, as well as employees responsible for HR, financial planning, and legal work of the College are also subject to approval by the Chief Accountant and heads of respective University services);

15) forms the student body of education seekers;

16) dismisses from the College and reinstates for study individuals who are studying (studied) at the College and other educational institutions in accordance with the procedure established by legislation;

17) ensures the organization of the educational process and monitoring of the implementation of educational-professional programs;

18) develops and, upon agreement with the collegial governing body of the College, initiates decisions on the establishment, reorganization, transformation (change of type), or liquidation of structural units of the College;

19) organizes the operation of the internal quality assurance system for education;

20) exercises control over the quality of work of teaching (academic) and other employees;

21) upon request of the Rector, the Vice-Rector overseeing the relevant line of work, the Chief Accountant, or heads of relevant departments (services) of the University, provides reports, necessary information, documents, and explanations regarding the activity of the College to facilitate activity monitoring;

22) provides information on the status of fulfillment of the College's obligations, as well as other information necessary for compiling consolidated reports of the University, to the accounting department, HR department, financial planning department, tender committee, authorized procurement personnel, and other units of the University;

23) ensures the creation of conditions for effective and open public control over the activity of the College;

24) facilitates and creates conditions for the activity of public self-governance bodies and trade union organizations operating at the College;

25) promotes a healthy lifestyle at the College, strengthens the sports and health facilities of the College, and creates proper conditions for mass sports activities;

26) jointly with elected bodies of primary trade union organizations of the College, submits internal work rules and the collective agreement for approval to the highest collegial body of public self-governance of the College, and signs them following approval;

27) carries out foreign economic activities in accordance with established procedures;

28) participates in the work of the Council of Directors of Professional Pre-Higher Education Institutions;

29) exercises other powers provided for by these Regulations, contract, and power of attorney.

7.3 The Director of the College is responsible for the conduct and results of educational, economic, and other types of activities at the College, as well as the state and preservation of real estate and other property of the College.

7.4 The Director of the College reports to the University, the highest collegial body of public self-governance of the College, and the Supervisory Board (as necessary).

The Director of the College is obliged to publish an annual report on the implementation of the College's development strategy on the official website (web page) of the College.

7.5 The Director of the College may delegate part of their powers to their deputies, as well as to the heads of structural units.

7.6 The Director of the College has the right to raise the issue of non-compliance of deputy directors, department heads, and heads of structural units with their position at a meeting of the Pedagogical Council of the College before the expiration of their term of office.

7.7 The Director of the College is appointed to office under the terms of a contract for a term of up to 5 years based on the results of a competitive selection process and is dismissed from office by decision of the Rector of the University on grounds defined by labor legislation, the University Charter, and the contract.

7.8 A candidate for the position of Director of the College must be a citizen of Ukraine, hold a Specialist/Master's degree, be fluent in the state language, and have at least five years of work experience in teaching and/or academic positions. Up to three years of work experience in managerial positions may be counted toward the specified experience.

7.9 The same person cannot serve as Director of the College for more than two consecutive terms.

7.10 The Director of the College may be dismissed from office by the Rector of the University upon submission by the Supervisory Board or the General Meeting (Conference) of the College staff on grounds defined by legislation, for violation of local regulatory documents of the College or University, and/or terms of the contract.

A submission to the Rector of the University regarding the recall of the Director of the College is adopted if supported by the Supervisory Board or a majority vote of the members of the General Meeting (Conference) of the College staff.

7.11 In cases specified by legislation, the Rector of the University, upon submission by the Supervisory Board, may appoint an Acting Director of the College under a contract for the purpose of implementing crisis management measures.

8. Participants in the Educational Process at the College

8.1 Participants in the educational process at the College are:

1) persons studying at the College;

2) teaching (academic) and other employees of the College who work at it as their primary place of employment;

3) persons who, at their primary place of employment in enterprises, institutions, organizations, or establishments, combine performance of their official duties with practical training of education seekers for acquiring professional competencies, and evaluate its quality;

4) employees of enterprises, institutions, and organizations, as well as figures of science, arts, and sports, who are involved in the educational process to deliver individual lectures or participate in the work of attestation commissions;

5) parents (legal representatives) of education seekers.

8.2 Employers and specialists of enterprises, institutions, organizations, and establishments, including those of foreign states, military personnel of the Armed Forces of Ukraine, other military formations, and law enforcement officers may be involved in the educational process.

8.3 Persons studying at the College are:

1) seekers of professional pre-higher education;

2) other persons studying at the College.

8.4 Seekers of professional pre-higher education are students, that is, persons enrolled in the College for the purpose of acquiring professional pre-higher education.

Other persons studying at the College include:

1) pupils acquiring complete specialized secondary or professional (vocational-technical) education;

2) students acquiring higher education;

3) non-degree attendees (trainees) receiving additional or separate educational services at the College, including under preparatory admission programs, postgraduate education, continuous professional development, particularly under adult education programs.

The persons specified in this part are subject to the special laws determining the specifics of acquiring specialized secondary, professional (vocational-technical), higher, and out-of-school education.

8.5 Persons studying at the College have the right to:

1) choice of institution, educational-professional program, and mode of study upon admission to the College and/or during studies;

2) safe and harmless conditions for learning, work, and living;

3) quality educational services;

4) fair and objective assessment of learning outcomes;

5) work activity during non-study hours;

6) free use of libraries, information funds, educational, research, and sports facilities of the College, as well as access to information resources and communications used in the educational process in accordance with established legislation;

7) free provision of information for learning in accessible formats using technologies that account for functional limitations caused by health conditions (for persons with special educational needs);

8) provision of dormitory accommodation, where possible, for the duration of studies in accordance with the procedure established by legislation;

9) use of the College's industrial, cultural, educational, domestic, sports, and health facilities, as well as services of its structural units in accordance with the procedure established by legislation;

10) freedom of creative, sports, health-improving, cultural, educational, research, scientific-technical, and other activities;

11) participation in educational, research, scientific-research, sports, artistic, and public activities conducted at the College, University, in Ukraine, and abroad in accordance with the procedure established by legislation;

12) participation in public associations;

13) participation in the activities of public self-governance bodies of the College, departments, the Pedagogical Council of the College, and student self-government bodies;

14) simultaneous acquisition of education under several educational-professional programs at the College, as well as at several institutions of professional pre-higher (higher) education under different modes of study, provided that only one professional pre-higher education is received at the expense of state and/or local budget funds;

15) participation in discussing and resolving issues of improving the educational process, awarding scholarships, organizing leisure time, living conditions, and health improvement;

16) submission of proposals regarding the terms and amount of tuition fees;

17) participation in shaping an individual study plan, selection of study disciplines within the limits provided for by the relevant educational-professional program and curriculum, in an amount of at least 10 percent of the total number of ECTS credits allocated for the educational-professional program of professional pre-higher education. At the same time, seekers of professional pre-higher education have the right to select study disciplines offered to higher education seekers, upon agreement with the Director of the College;

18) independent extension (in case of self-funded studies) or extension upon agreement with the relevant individual or legal entity (in case of studies funded by individuals or legal entities) of the duration of completing the educational-professional program upon agreement with the College, which shall be reflected in the agreement on the provision of educational services;

19) lifelong learning and academic mobility, including international mobility, for recognition of learning outcomes and credits obtained during mobility;

20) provision of scholarships in accordance with the procedure established by the Cabinet of Ministers of Ukraine;

21) receipt of social assistance in cases established by legislation;

22) retention of the place of study for the period of military service under military call-up and/or during mobilization, for a special period;

23) inclusion of full-time study periods at the College into insurance coverage in accordance with the Law of Ukraine «On Mandatory State Pension Insurance», subject to voluntary payment of insurance contributions;

24) academic leave or a break in studies while retaining certain rights of an education seeker, as well as reinstatement for study in accordance with the procedure established by the central executive authority in the field of education and science;

25) moral and/or material encouragement for academic success and community work, artistic and sports achievements, etc.;

26) respect for human dignity, protection during the educational process from humiliation of honor and dignity, any forms of violence and exploitation, discrimination on any grounds, propaganda and campaigning that harm the health of the education seeker;

27) free completion of practical training at enterprises, institutions, establishments, and organizations, as well as remuneration for work performed while executing production functions in accordance with legislation;

28) vacation leave lasting at least eight calendar weeks per academic year, and for persons acquiring professional pre-higher education under the dual mode of study and at the workplace (in production), a break in theoretical study lasting at least eight calendar weeks per academic year;

29) receipt of targeted preferential state loans for acquiring professional pre-higher education in the manner determined by the Cabinet of Ministers of Ukraine;

30) appealing the actions of the governing bodies of the College and their officials, teaching (academic) and other employees;

31) special educational and rehabilitation support and free access to the infrastructure of the College in accordance with medical and social indications in the presence of functional limitations caused by health conditions;

32) other necessary conditions for learning, including for persons with special educational needs and from socially vulnerable groups of the population;

33) additional paid leave in connection with studies at the primary place of employment, reduced working hours, and other benefits provided for by legislation for persons combining work with study (except for the dual mode of study and workplace training (in production)).

8.6 Education seekers also have other rights provided for by legislation and these Regulations.

8.7 Persons acquiring education at the College are obliged to:

1) fulfill the requirements of the educational-professional program and individual study plan, adhering to the principle of academic integrity, and achieve the learning outcomes provided for by the professional education standard and educational-professional program;

2) respect the dignity, rights, freedoms, and legitimate interests of all participants in the educational process, and comply with ethical norms;

3) adopt a responsible and caring attitude toward their own health, the health of others, and the environment;

4) comply with occupational health and safety, life safety, industrial sanitation, and fire safety requirements provided for by the relevant rules and instructions;

5) comply with the requirements of legislation, these Regulations, internal work rules of the College, as well as the terms of the agreement on the provision of educational services.

8.8 Education seekers also have other duties provided for by legislation and these Regulations.

8.9 Grounds for dismissal (expulsion) of an education seeker are:

1) completion of study under the relevant educational-professional program;

2) voluntary decision;

3) transfer to another institution of professional pre-higher education or to an institution of professional (vocational-technical) education or general secondary education (for seekers of professional pre-higher education admitted on the basis of basic secondary education, during the first and second years of study);

4) failure to fulfill the individual study plan;

5) violation of the terms of the agreement on the provision of educational services, which serves as the basis for enrollment;

6) violation of academic integrity;

7) health condition (in the presence of an appropriate medical conclusion);

8) other cases specified by the legislation of Ukraine.

8.10 College graduates are free to choose their place of employment, except in cases provided for by the Laws of Ukraine «On Professional Pre-Higher Education» and «On Higher Education». The College is not obliged to provide employment for graduates.

8.11 Persons studying at the College may interrupt their studies due to circumstances that make it impossible to fulfill the educational or educational-professional program (health condition, call-up for regular military service upon loss of deferment right, family circumstances, study or internship at educational institutions (including foreign countries), unless otherwise provided for by international acts or agreements between educational institutions, etc.).

Persons who have interrupted their studies at the College are granted academic leave in accordance with established procedures.

8.12 Reinstatement for study of persons who were dismissed (expelled) from the College or granted academic leave, as well as the transfer of education seekers, is generally carried out during vacations.

Regulations on dismissal (expulsion), interruption of studies, reinstatement, and transfer of persons studying at professional pre-higher education institutions, as well as the procedure for granting them academic leave, are approved by the Ministry of Education and Science of Ukraine.

8.13 Teaching staff at the College carry out educational, methodical, innovative, and organizational activities related to the provision of educational services.

Academic staff at the College carry out educational, methodical, innovative, scientific (scientific-technical), and organizational activities related to the provision of educational services in the field of higher education. Positions of academic staff at the College may be occupied by employees who conduct scientific activity and execute at least 60 percent of their wage rate at the College with students pursuing higher education degrees. Positions of academic staff are determined by the Law of Ukraine «On Higher Education». The hiring and dismissal of academic staff of the College, as well as their professional development, are carried out in the manner determined by the Law of Ukraine «On Professional Pre-Higher Education» for teaching staff.

8.14 The main positions of teaching staff of the College are: Director; Deputy Director whose activity is directly related to the educational process; Head of Department; Chair of the Cyclic Commission; Lecturer, Senior Lecturer; Methodologist; Head of Practical Training; Director of Physical Education; Head of the Educational and Methodological Office, Head of the Educational (Educational and Production) Laboratory, Master of Production Training, Educator.

8.15 Positions of teaching staff are, as a rule, occupied by persons with a Master's degree. Up to 30 percent of teaching staff positions at the College may be occupied by persons with first-level higher education (Bachelor's degree).

8.16 Teaching and other employees are hired and dismissed by the Director of the College.

8.17 Teaching staff of the College undergo attestation every five years. Based on the results of the attestation, the employee's suitability for the position held is determined, and qualification categories and pedagogical titles are assigned or confirmed.

8.18 The procedure for conducting attestation of teaching (academic) staff of the College is established by the Ministry of Education and Science of Ukraine.

8.19 The list of qualification categories and pedagogical titles of teaching staff, as well as the procedure for their assignment, are determined by the Cabinet of Ministers of Ukraine.

8.20 In case of inability to ensure the educational process with existing full-time staff, vacant positions of teaching (academic) staff may be filled under a fixed-term employment contract pending the filling of these positions in the manner established by legislation.

8.21 A person in the College cannot simultaneously hold two or more positions involving administrative and managerial functions.

8.22 The working hours of teaching (academic) staff of the College are determined by the volume of their educational, methodical, innovative, organizational work, and other pedagogical activities provided for in the employment contract. The working time of teaching (academic) staff shall not exceed 36 hours per week (reduced working hours).

8.23 Time standards for educational work at the College are determined by the Ministry of Education and Science of Ukraine.

The teaching load per full rate for the teaching staff of the College is 720 hours per academic year.

8.24 Time allocations for methodical, innovative, organizational work, and other pedagogical activities of teaching (academic) staff are determined by the College.

8.25 The list of types of educational, methodical, innovative, organizational work, and other pedagogical activities of teaching (academic) staff is established by the Ministry of Education and Science of Ukraine.

8.26 Types of educational work of teaching (academic) staff in accordance with positions are established by the College in agreement with the elected bodies of primary trade union organizations in accordance with established procedures.

8.27 The working time schedule of teaching (academic) staff is determined by the timetable of classroom sessions and consultations, the schedule of methodical, educational, and control activities, and other types of work provided for in the individual work plan and teacher's working schedule.

A lecturer is obliged to adhere to the working time schedule established for them.

8.28 Involving teaching (academic) staff in work not provided for in the employment contract may be carried out only with their consent or in cases specified by legislation.

8.29 Teaching (academic) staff have the right to:

1) academic freedom, including freedom of teaching, freedom from interference in teaching and academic activities, free choice of forms, methods, and means of instruction that correspond to the educational-professional program;

2) pedagogical initiative;

3) development and implementation of author's curricula, projects, educational methods and technologies, methods and means, primarily methods of competency-based learning;

4) use of the library, educational, production, cultural, sports, domestic, and health infrastructure of the College, as well as the services of its structural units in the manner established by the College in accordance with legislation;

5) access to information resources and communications used in the educational process and research activities;

6) recognition of achievements in professional activity;

7) fair and objective assessment of their professional activity;

8) protection of professional honor and dignity;

9) professional development and internships, free choice of modes of study, educational institutions, entities, and organizations, as well as other subjects of educational activity carrying out professional development for teaching (academic) staff;

10) obtaining housing with all utilities, including official housing, in accordance with the procedure established by legislation;

11) receiving preferential long-term loans for individual and cooperative construction (reconstruction) and acquisition of housing in accordance with the procedure established by legislation;

12) extended paid leave;

13) participation in the public self-governance of the College;

14) individual educational (research, creative, artistic, and other) activity outside the College;

15) social security and pension coverage in accordance with the procedure established by legislation.

8.30 Teaching (academic) staff also have other rights provided for by legislation, the collective bargaining agreement, employment contract, and/or these Regulations and internal regulatory legal acts of the College and the University.

8.31 The rights of other persons involved in the educational process are determined by legislation, relevant agreements, and/or these Regulations and internal regulatory legal acts of the College.

8.32 Teaching (academic) staff are obliged to:

1) continuously improve their professional and general cultural level as well as pedagogical skills, and ensure continuous professional development;

2) fulfill the educational-professional program to enable education seekers to achieve the learning outcomes provided for therein;

3) foster the development of education seekers' abilities, the formation of healthy lifestyle skills, and take care of their physical and mental health;

4) adhere to academic integrity and ensure its observance by education seekers during the educational process and research activities; comply with pedagogical ethics;

5) respect the dignity, rights, freedoms, and legitimate interests of all participants in the educational process;

6) uphold respect for public morality and societal values, in particular truth, justice, patriotism, humanism, tolerance, and diligence, through guidance and personal example;

7) instill in education seekers an awareness of the need to comply with the Constitution and laws of Ukraine, and to defend the sovereignty and territorial integrity of Ukraine;

8) cultivate in education seekers respect for the state language and state symbols of Ukraine, national, historical, and cultural values of Ukraine, as well as a caring attitude toward the historical and cultural heritage of Ukraine and the natural environment;

9) foster in education seekers a striving for mutual understanding, peace, and harmony among all peoples, ethnic, national, and religious groups;

10) protect education seekers during the educational process from any forms of physical and psychological violence, humiliation of honor and dignity, discrimination on any grounds, propaganda and campaigning that harm the health of the education seeker, and prevent the use of alcoholic beverages, narcotic substances, and other harmful habits by them and other persons on the premises of the College;

11) develop independence, initiative, and creative abilities in persons studying at the College;

12) abide by the constituent documents and internal work rules of the College, and perform their official duties.

8.33 Teaching (academic) staff also have other duties provided for by legislation, the collective bargaining agreement, employment contract, and/or these Regulations and internal regulatory legal acts of the College and the University.

8.34 The duties of other persons involved in the educational process are determined by legislation, relevant agreements, and/or these Regulations and internal regulatory legal acts of the College.

8.35 The Director of the College, in accordance with legislation, these Regulations, and the collective bargaining agreement, establishes the amounts of additional payments, allowances, material assistance, and incentives for teaching (academic) and other employees of the College.

8.36 Attestation of teaching (academic) staff of the College is conducted on the principles defined by the Laws of Ukraine «On Education» and «On Professional Pre-Higher Education».

8.37 Continuous professional development, including qualification enhancement of teaching (academic) staff of the College, is carried out on the principles defined by the Law of Ukraine «On Education».

8.38 Positions of teaching (academic) staff who enhance their qualifications or undergo internships on leave from main work may be temporarily filled by other persons under fixed-term employment contracts for that period.

8.39 The results of qualification enhancement are taken into account:

1) during the attestation of teaching (academic) staff;

2) during appointment to a position or conclusion of an employment contract.

9. Labor Collective

9.1 Rights and duties of College employees are determined by their job descriptions, internal labor regulations, the collective bargaining agreement of the College, and these Regulations.

9.2 All members of the College's labor collective have the right to:

1) proper conditions for conducting professional activity, legal and social protection;

2) elect and be elected as delegates to the general meeting (conference) of the College's labor collective and to the governing bodies of the College and University;

3) participate in the discussion and resolution of all major issues regarding the College's activity;

4) receive information, regulatory, and other materials pertaining to the College's activity;

5) use the premises and equipment of the College free of charge for the performance of their official duties;

6) have a trade union at the College and be members of it;

7) organize and be members of any political, public, religious, and other associations and groups operating outside the College whose activities do not contradict the Constitution of Ukraine and applicable legislation. Membership in these organizations and groups, as well as activity within them, cannot serve as a ground for any restriction of the rights of College employees;

8) use all types of services that the College can provide, as well as other opportunities of the College for prompt and effective resolution of educational and methodological problems;

9) perform work on the conditions of secondary part-time employment, hourly pay, labor agreements, and other forms of employment relations provided for by applicable legislation;

10) participate in the work of other organizations, including foreign ones, under conditions specified by agreements with such organizations in accordance with applicable legislation and these Regulations;

11) other rights defined by applicable legislation.

9.3 All members of the College's labor collective are obliged to:

1) work honestly, conscientiously, and be disciplined;

2) execute orders and directives of the Director of the College or a person authorized by them in a timely manner and at a high professional level;

3) comply with these Regulations, internal labor regulations, the collective bargaining agreement of the College, and other local regulatory documents;

4) ensure a high level of performance of official duties;

5) continuously raise their professional level and general culture;

6) care for strengthening the authority of the College;

7) execute in a timely manner decisions of the general meeting (conference) of the College's labor collective, other governing bodies of the College, and orders and directives of the Rector of the University;

8) adhere to the established operating mode and labor discipline, productively use working time, and take measures to eliminate causes that impede normal execution of work or complicate its process;

9) comply with occupational health and safety rules, fire safety, industrial sanitation, and occupational hygiene, and use necessary personal protective equipment;

10) keep their workplace, equipment, and devices in order, clean, and in proper working condition, and maintain cleanliness and order in the premises of the College and on its territory;

11) perform other duties provided for by applicable legislation of Ukraine.

9.4 The representative body of the interests of the College's labor collective is the Trade Union Committee of the College.

9.5 Employees of the College are provided with:

1) proper conditions for labor, everyday life, and rest;

2) legal, social, and professional protection;

3) establishment of base salaries in accordance with applicable legislation within the wage fund;

4) establishment of allowances and bonuses to base salary in accordance with the collective bargaining agreement and applicable legislation;

5) other guarantees defined by legislation.

9.6 For special labor achievements, teaching (academic) and other employees of the College may be awarded state awards of Ukraine, commended with certificates, badges, and other types of moral and material encouragement.

10. International Relations and Foreign Economic Activity

10.1 The College carries out international cooperation, concludes agreements on cooperation, and establishes direct links with educational institutions and enterprises of foreign states, international organizations, foundations, etc., in accordance with legislation.

10.2 Main areas of international cooperation of the College are:

1) participation in programs of bilateral and multilateral interstate exchange of students, teaching (academic) staff;

2) organization of international conferences, symposiums, congresses, and other events;

3) participation in international educational programs;

4) joint publishing activity;

5) provision of services related to foreign citizens acquiring education in Ukraine;

6) creation of joint educational programs with foreign educational institutions;

7) sending teaching (academic) staff abroad for pedagogical and academic work in accordance with international treaties of Ukraine, as well as agreements between educational institutions and foreign partners;

8) engaging teaching (academic) staff of foreign educational institutions to participate in pedagogical and academic work at the College;

9) sending persons studying at the College for study at foreign educational institutions;

10) promoting academic mobility of teaching (academic) staff and education seekers;

11) other areas and forms not prohibited by law.

10.3 Foreign economic activity of the College is conducted in accordance with legislation by concluding agreements with foreign legal entities and natural persons.

10.4 The main areas of foreign economic activity of the College are:

1) organization of training for foreign citizens preparing for admission to the College;

2) conducting educational activity related to teaching foreign students, as well as training personnel for foreign states;

3) organization of academic mobility of participants in the educational process;

4) organization of practical training, internships abroad for teaching (academic) staff and education seekers.

11. Sources of Funds and Property and the Procedure for Their Use by the College

11.1 In order to ensure the activity provided for by these Regulations, buildings, structures, property complexes, as well as other property necessary to support the activity of the educational institution, the value of which is reflected on an independent balance sheet, are assigned to the College under the right of operational management or commercial management.

11.2 Land use and the implementation of land rights are carried out by the College in accordance with the Land Code of Ukraine.

11.3 Property (except for land plots) is assigned to the College under the right of operational management or commercial management and cannot be subject to pledge, nor is it subject to withdrawal or transfer into the ownership of legal entities and natural persons without the consent of the Ministry of Education and Science of Ukraine, the University, the Supervisory Board, and the general meeting (conference) of the College's labor collective, except in cases provided for by legislation. The conditions for providing property assigned to the University to support the educational process of the College are determined by the Rector of the University in accordance with legislation.

11.4 Own revenues of the College received as payment for services provided by it in accordance with its main and supplementary (economic) activities, charitable contributions, and grants, pursuant to the decision of the Academic Board of the College, are credited to special registration accounts opened with the territorial body of the central executive body in the field of treasury service of budget funds, or to current and/or deposit accounts of state bank institutions in accordance with the procedure established by the Cabinet of Ministers of Ukraine. These revenues, as well as interest received from placing the College's funds in deposit accounts with state bank institutions, are included in the financial plan (budget estimate) of the College and may be used for remuneration, employee incentives, acquisition and use of property, capital construction and renovation of premises, improvement of material and technical, educational-laboratory, and educational-methodological support of the educational process, etc., in accordance with these Regulations.

11.5 The leasing of property objects assigned to the College under the right of operational management or commercial management is carried out without the right of redemption in accordance with legislation.

11.6 Land plots are transferred to the College for permanent use in accordance with the procedure established by the Land Code of Ukraine.

11.7 Funding of the College is carried out from the state budget, including through the provision of relevant educational subventions, as well as from local budgets and other sources not prohibited by the legislation of Ukraine. The procedure and conditions for providing educational subventions are established by the Cabinet of Ministers of Ukraine.

A general fund for the training of specialists within the state order and a special fund are created at the College, which is formed through:

1) funds received for the training, retraining, advanced training of specialists, and provision of additional educational services in accordance with contracts concluded with legal entities and natural persons;

2) revenues from leasing premises, equipment, etc.;

3) gratuitous and charitable contributions from legal entities and natural persons, including from other states;

4) receipts from the execution of work under contracts with enterprises, institutions, organizations, and natural persons;

5) funds obtained from carrying out other types of economic activity not prohibited by applicable legislation.

11.8 Funding of the College is carried out in compliance with the principles of targeted and effective use of funds, publicity, and transparency in decision-making.

11.9 Funds received by the College as payment for the provision of educational or other services, as well as funds received from other sources of own revenues, cannot be withdrawn into the revenue of the state or local budget.

11.10 If the College receives funds from other sources, its budget allocations are not reduced.

11.11 Alienation of property assigned to the College is carried out upon agreement with the Ministry of Education and Science of Ukraine in accordance with the procedure established by applicable legislation.

11.12 Remuneration of labor at the College is carried out in accordance with the legislation on labor remuneration, the Labor Code of Ukraine, and the Law of Ukraine «On Education» according to salary scales and tariff rates established by the Cabinet of Ministers of Ukraine, under contracts, employment, and civil law agreements.

Forms and systems of labor remuneration, terms and criteria for employee bonuses at the College, as well as the procedure for establishing allowances and bonuses for employees, are determined in the collective bargaining agreement or a separate regulation approved by the Director of the College.

11.13 Relations of the College with other institutions, organizations, enterprises regardless of ownership form, and citizens in all spheres of activity are carried out on the basis of agreements, accords, contracts, and other forms of relations established by the legislation of Ukraine.

12. Procedure for Reporting and Control Over the Financial and Economic Activity of the College

12.1 In accordance with the Budget Code of Ukraine, Laws of Ukraine «On Accounting and Financial Reporting in Ukraine», «On the State Budget of Ukraine», Resolution of the Cabinet of Ministers of Ukraine «On Approval of the Regulations on the State Treasury Service of Ukraine», and other regulatory legal acts of the State Treasury Service of Ukraine and the Ministry of Finance of Ukraine regarding accounting of funds and settlements of budget-funded institutions, the College prepares approved monthly, quarterly, and annual reporting forms and submits them to the Ministry of Education and Science of Ukraine, the University, bodies of the State Treasury Service of Ukraine, the State Fiscal Service of Ukraine, the State Statistics Service of Ukraine, the Pension Fund of Ukraine, Social Insurance Funds of Ukraine, etc.

12.2 The College independently carries out operational, accounting, and financial reporting of its own activities, maintains statistical reporting according to established standards, and submits it in accordance with the established procedure to bodies granted the right of control over relevant areas of activity by the legislation of Ukraine.

12.3 Income (profits) of the College are used to finance expenses for its maintenance and to achieve the goals (purposes, tasks) and areas of activity defined by these Regulations.

12.4 Audit of the College's activities is carried out in accordance with applicable legislation of Ukraine.

12.5 The Director and the Chief Accountant of the College bear personal responsibility for the accuracy of accounting and statistical reporting.

13. Procedure for Reorganization and Liquidation of the College

13.1 A decision on the separation of the College by creating a legal entity of the same ownership form in the status of a professional pre-higher education institution, initiated by the general meeting (conference) of the College's labor collective, is adopted by the Academic Council of the University, agreed upon by the conference of the labor collective of the University, and approved by the Ministry of Education and Science of Ukraine.

The University ensures the preservation and transfer of the integral property complex of the relevant structural unit to the newly formed professional pre-higher education institution as a separate legal entity.

13.2 Liquidation and reorganization (merger, accession, division, transformation) of the College are carried out in accordance with applicable legislation of Ukraine.

13.3 Termination of the College's activities is carried out by a liquidation commission formed by order of the Ministry of Education and Science of Ukraine upon submission by the Rector of the University.

The liquidation commission includes representatives of the Ministry of Education and Science of Ukraine, the University, and the College. The procedure and deadlines for liquidation, as well as the period for presenting claims by creditors, are determined by the Ministry of Education and Science of Ukraine.

13.4 From the moment of appointment of the liquidation commission, powers to manage the College pass to it. The liquidation commission prepares the liquidation balance sheet of the College and submits it to the Ministry of Education and Science of Ukraine.

Creditors and other legal entities and natural persons having contractual relations with the College are notified of its liquidation, merger, accession, division, or transformation in writing.

13.5 In case of termination of the College's activities (as a result of its liquidation, merger, division, accession, or transformation), assets of the College are subject to transfer to one or more non-profit organizations of the corresponding type or credited to budget revenue, unless otherwise provided by law.

13.6 Upon liquidation or reorganization of the College, observance of rights and interests of persons studying in it and released employees is guaranteed in accordance with applicable legislation of Ukraine.

13.7 The College is considered liquidated from the date of entry into the Unified State Register of Legal Entities, Individual Entrepreneurs, and Public Formations of the record of termination of its activity.

14. Procedure for Adoption of the Regulations and Making Amendments Thereto

14.1 Regulations on the Separate Structural Unit «Kharkiv Professional College of Information Technologies of National Aerospace University «Kharkiv Aviation Institute»» are developed by specialists of the University and the College, agreed upon by the Academic Board, the general meeting (conference) of the College's labor collective, approved by the Academic Council of the University, and brought into effect by order of the Rector of the University.

14.2 Amendments and additions to these Regulations are adopted, approved, and agreed upon in the same manner as the Regulations themselves.

14.3 These Regulations enter into force upon approval by order of the Rector of the University.
