1. General Provisions
1.1 These Regulations regulate the scientific and scientific-technical activities (hereinafter referred to as SSTA) of the Research Division (hereinafter referred to as RD) of National Aerospace University «Kharkiv Aviation Institute» (hereinafter referred to as the University), developed in accordance with the Charter of National Aerospace University «Kharkiv Aviation Institute» (hereinafter referred to as the Charter), and define the legal status of the RD, its structure, tasks, functions, rights, executive authority, responsibility, and interaction with other structural units.
1.2 The RD is a structural unit of the University and directly reports to the Vice-Rector for Research.
1.3 In its activities, the RD is guided by the Constitution and laws of Ukraine, in particular «On Education», «On Higher Education», «On Scientific and Scientific-Technical Activity», decrees of the President of Ukraine, resolutions of the Verkhovna Rada of Ukraine, orders of the Ministry of Education and Science of Ukraine, the University Charter, as well as other regulatory documents, legal acts, and these Regulations.
1.4 The RD consists of:
- Department of Organization and Implementation of Research Works;
- Department of Intellectual Property Rights;
- Laboratory of Electron Microscopy, Optics, and Laser Technologies;
- Center for Collective Use of Scientific Equipment «Creation and Research of Aerospace Objects and Systems».
1.5 The RD interacts with educational and scientific laboratories of the University's departments on issues related to the organization of SSTA, performance monitoring, and reporting for state-budget and contract-based research works, as well as international grants.
1.6 The RD is created, reorganized, or liquidated by order of the Rector of the University.
Termination of the RD's activities is carried out through its liquidation or reorganization. In the event of reorganization, all documentation of the RD must be timely transferred for retention to the legal successor, and in the case of liquidation — to the University archives.
2. Main Tasks
2.1 The main tasks of the RD in the field of SSTA are:
2.1.1 Development of fundamental research for its further application in advancing priority areas of science and technology, social development, and national economic growth. Execution of applied research and development to effectively utilize and expand scientific potential.
2.1.2 Support for existing scientific schools and establishment of new ones.
2.1.3 Implementation of measures to support research by young scientists and gifted students, and their integration into scientific schools.
2.1.4 Facilitation of the training of qualified specialists, as well as highly qualified scientific and academic staff at the University based on the latest achievements in scientific and technological progress.
2.1.5 Effective utilization of the scientific and scientific-technical potential of the University to address priority tasks in updating production and executing socio-economic transformations.
2.1.6 Development of new, progressive forms of scientific and technical cooperation with foreign and domestic centers of academic and sectoral science to jointly address key scientific and technical challenges, create advanced technologies, and expand the industrial implementation of the University's scientific developments.
2.1.7 Development of innovation activities aimed at creating knowledge-intensive scientific and technical products and competitive models of new equipment and materials tailored to the high-tech market.
2.1.8 Facilitation of the protection of intellectual property and researchers' copyrights as a foundation for strengthening and advancing science, and entering the global market for high-tech products.
2.1.9 Modernization, upgrading, and efficient use of the University's research and experimental facilities.
2.1.10 Organization of information and publishing activities, popularization of higher education science achievements through the mass media and the Internet.
2.1.11 Conducting market research on the scientific services market, patent and licensing work, providing marketing and information support, and transferring scientific and technical products in accordance with international standards.
2.1.12 Organization, preparation, and holding of scientific, scientific-technical, and scientific-methodological conferences, seminars, and exhibitions to exchange experience in scientific activity and facilitate the implementation of scientific and technical results.
2.1.13 Coordination and organization of SSTA of educational and scientific laboratories of University departments, monitoring of performance and reporting on state-budget and commercial contract research works, as well as grants from international organizations.
3. Functions
3.1 The main function of SSTA of the University's RD is obtaining and utilizing new scientific knowledge to create socially useful scientific results, ensuring high-quality training of specialists for key sectors of the economy, as well as highly qualified scientific and academic staff; solving comprehensive tasks in scientific and technological development; and implementing and applying scientific and practical results in Ukraine and on the global market.
3.2 The main activity direction of the RD is organizational support of SSTA at the University.
3.3 To achieve its tasks, the RD performs the following functions by areas of activity:
3.3.1 Department of Organization and Implementation of Research Works:
- prepares the staffing table with relevant amendments, income and expenditure estimates, notices of changes to general and special fund estimates, general fund allocation plans, and summaries of special fund indicators in accordance with the performance of scientific and research works;
- ensures proper application of tariff rates, salaries, allowances, and bonuses, as well as correct job grading and skill level assignment for workers engaged in scientific and research activities;
- prepares and coordinates with the Ministry of Education and Science of Ukraine the budget request, calculations for the payroll fund, and other expenses of scientific units for the upcoming year;
- monitors funding inflows and expenditure of funds according to contract estimates;
- enters and summarizes information in the national database of Ukraine on the execution of contracts for service provision and sales of goods, pursuant to the Law of Ukraine «On the Openness of the Use of Public Funds»;
- ensures the proper procedure for executing commercial contracts for research and development work with enterprises and organizations of various ownership forms;
- collects, analyzes, and summarizes information submitted by departments, research laboratories, centers, and structural units of the University;
- organizes internal competitions for scientific research and development projects;
- prepares and updates the thematic plan for state-budget research projects;
- prepares and updates the thematic plan for research projects conducted at departments within faculty working hours;
- provides quarterly and annual reporting on SSTA (execution of state-budget and commercial contract research and experimental development works) to governmental and regional organizations;
- provides annual reporting on the execution of research works conducted at departments within faculty working hours to governmental and regional organizations;
- manages service contracts for facilities designated as National Assets of Ukraine (Aerodynamic Complex based on the T-6 supersonic wind tunnel and the Research Installation and Equipment Complex for Physical Simulation of Aircraft Flight Modes of the Inter-industry Research Institute for Flight Mode Physical Simulation Problems);
- organizes the submission of documents for young University scientists applying for scholarships and awards from the President of Ukraine, Cabinet of Ministers of Ukraine, Verkhovna Rada of Ukraine, and Kharkiv Regional State Administration, as well as evaluation materials for the scientific work of young scientists;
- manages organizational matters for Rounds I and II of All-Ukrainian and Kharkiv Regional Competitions of Student Research Papers in natural, technical, and human sciences;
- prepares information and handles organizational matters regarding annual scientific and technical councils on research project outcomes;
- prepares information for directives and orders of the Ministry of Education and Science of Ukraine;
3.3.2 Department of Intellectual Property Rights:
- analyzes market needs for intellectual property objects whose economic rights belong to the University when searching for potential partners and concluding agreements for research and development activities;
- jointly with relevant University departments, conducts analysis and forecasting of planned research projects to timely identify patentable intellectual property objects with commercial potential and determine the expediency of their legal protection in Ukraine and abroad;
- provides methodological assistance to University structural units in conducting patent and patent-market research during scientific and research works, as well as in preparing proposals on the expediency of patenting their results;
- provides consultations and methodological assistance in searching for and utilizing patent materials;
- participates in the preparation of agreements regarding the disposal of intellectual property rights to which the University is a party;
- participates in the preparation and submission of application documents for intellectual property objects to statutory authorities for patenting in Ukraine and foreign countries in accordance with national and international procedures;
- provides methodological assistance with reasoned correspondence with the State Intellectual Property Service regarding applications for patents on industrial property objects and certificates of copyright registration for works at all stages of examination;
- participates in drafting statutory agreements with authors of intellectual property objects created as part of official duties; facilitates compliance with the law regarding the enforcement of authors' personal moral and economic rights, including royalty payments;
- takes measures to prevent the infringement of the University's intellectual property rights by third parties and prevents the University from infringing third-party intellectual property rights;
- monitors and processes fee payments for actions related to maintaining legal protection for industrial property objects and state registration of copyrights;
- submits materials to register intellectual property objects created at the University as intangible assets on the balance sheet, pursuant to the procedure established by the applicable legislation of Ukraine;
- maintains records and systematization of applications, patents, and certificates for intellectual property objects created at the University;
- submits proposals within its scope of authority regarding participation in international cooperation in the field of intellectual property;
- facilitates the organization of training and professional development for University employees, students, and postgraduate students in the field of intellectual property;
- annually prepares cost estimates to support the operations of the department;
- prepares state statistical and departmental reports within the scope of the department's competence regarding its activities;
- carries out the acquisition, storage, accounting, and use of archival documents generated during the department's activities in accordance with Ukrainian legislation;
- provides University employees and students with legal, consultative, and information assistance in exercising their personal moral and economic rights to intellectual property objects and associated benefits under Ukrainian regulations and University policies, including inventor-employees' rights to royalties for the use of job-related intellectual property;
- facilitates the participation of University inventors in competitions and exhibitions of patented inventions and utility models to promote University inventions, encourage the implementation of intellectual work into production, identify high-potential developments, and attract domestic and foreign investors; selects and prepares documents for participation in competitions for significant inventions and utility models developed at the University;
- subscribes to leading publications in the state system of legal protection of intellectual property in Ukraine.
3.3.3 Laboratory of Electron Microscopy, Optics, and Laser Technologies:
- performs electron-microscopic studies of objects of various natures. Determines the elemental composition of objects using X-ray microanalysis, including determination of elemental composition in local regions of objects, high-precision analysis of chemical element distribution, and generation of element distribution maps across a specified sample area;
- conducts structural studies of metallic and non-metallic materials;
- carries out electron-microscopic studies of metals and coatings, weld features, fracture processes, etc.
3.3.4 Center for Collective Use of Scientific Equipment «Creation and Research of Aerospace Objects and Systems»:
- performs work related to measuring the velocities of gases, liquids, and solid particles, including applications in the study of boundary layers, vortex, turbulent, subsonic, supersonic, and two-phase flows;
- performs diagnostics of combustion processes, injection modes, and ignition phenomena, flame visualization, and measurement of emission concentrations in research on combustion processes in aircraft and rocket engines, methods for reducing environmentally hazardous compound concentrations, and technological processes in the chemical industry;
- determines surface displacements and deformations of products under various types of loading, including tension, torsion, bending, and combined loading during strength testing of aircraft and rocket-space equipment structures, as well as large-scale civil engineering structures;
- conducts three-dimensional vibration analysis of structures in the aerospace industry, electronics, power engineering, and structural design and testing;
- performs non-destructive testing of large-scale aerospace components made of composite materials to detect impact damage, fiber core defects, wrinkles, and other flaws;
- inspects the geometry and alignment of large-scale aerospace components, including aircraft and helicopter fuselage and wing sections, rocket hulls, and other mechanical engineering structures;
- determines the dynamic characteristics of precision equipment used in manufacturing aerospace components, such as accelerations, velocity, vibrations, settling time, resonance, and vibration decay time, for application in programming computer numerical control (CNC) systems;
- develops concept profiles for advanced aerospace-based electronic systems, including the development, quality control, and diagnostics of prototype models;
- develops and researches control systems for aerospace vehicles and their individual subsystems;
- provides access for research activities to scientific and academic staff, students of National Aerospace University «Kharkiv Aviation Institute», and researchers from other higher education institutions;
- provides fee-based research services in accordance with established procedures within the Center's scope of activities.
4. Rights and Responsibilities
4.1 The rights and responsibilities of the Research Division are exercised through the rights and responsibilities of its Head and personnel.
4.2 The Head of the RD is granted the following rights and responsibilities:
- submit proposals to the University leadership regarding the improvement of RD operations;
- organize knowledge sharing and promote professional development of RD personnel;
- participate in drafting and reviewing draft instructions, regulations, and other regulatory documents of the University concerning RD activities;
- report identified shortcomings and issues in RD operations to direct line management;
- submit proposals to the University leadership regarding the improvement of RD operations;
- represent the University's interests in relevant institutions and organizations on matters within the scope of authority of the division;
- maintain correspondence with relevant institutions and organizations on matters related to RD activities;
- request materials required to perform the functions assigned to the RD from other structural units of the University;
- submit proposals regarding commendations for achievements at work and disciplinary measures for violations of labor discipline and Internal Work Rules by personnel;
- participate in the consideration of issues related to the operations of the department, as well as regarding the transfer or dismissal of staff members.
4.3 The rights of department employees are determined by the current legislation of Ukraine, the Charter, the Internal Work Rules of the University, and relevant job descriptions.
5. Leadership
5.1 The Research Division is headed by the Head of the RD, who is appointed to and dismissed from office by order of the Rector of the University upon submission by the Vice-Rector for Research.
The Head of the RD may be dismissed from office on grounds specified by labor legislation, as well as for violation of the University Charter, in accordance with applicable law.
5.2 The Head of the RD must know the Constitution of Ukraine, laws of Ukraine, acts of the President of Ukraine, the Verkhovna Rada of Ukraine, the Cabinet of Ministers of Ukraine concerning the educational sector; orders and instructions of the Ministry of Education and Science of Ukraine; other legislative and regulatory acts on scientific and scientific-technical activities; internal work rules, safety and occupational health regulations, and fire safety standards.
5.3 A person holding a higher education degree at the educational qualification level (Master's, Specialist), an academic degree (Doctor of Sciences, Candidate of Sciences), an academic title (Professor, Associate Professor, Senior Researcher), and at least 5 years of scientific or scientific-pedagogical work experience shall be appointed to the position of Head of the RD.
5.4 The Head of the RD issues orders regarding the operations of the department, which are binding for its employees and may be canceled by the senior management of the University if they contradict legislation, the Charter, or harm the interests of the University.
5.5 In their work, the Head of the RD is guided by the provisions set forth in the relevant job description.
5.6 The Head of the RD:
- coordinates the activities of the RD in accordance with legislation on scientific and scientific-technical activities;
- plans the work of the RD;
- exercises control over the work of RD employees;
- implements measures to improve the organizational structure of the RD.
6. Responsibility
6.1 The Head of the RD bears responsibility for the high-quality and timely execution of the tasks and functions assigned under these Regulations.
6.2 The degree of responsibility of other employees is established by their respective job descriptions.
7. Interaction with Other Structural Units
7.1 To fulfill its functions and tasks, the RD may, through established procedures, receive or provide information pertaining to its competence, participate in initiating and implementing joint activities, and interact within its competence with other structural units of the University.
7.2 To carry out its functions, the RD interacts with:
- faculties, departments, educational and scientific units of university departments, administrative and maintenance services, and other University units — in connection with fulfilling the corresponding functions assigned to the RD staff and the need to provide current information on the status and prospects of activities in accordance with established University procedures;
- the Ministry of Education and Science of Ukraine, the Department of Scientific and Technological Development, higher education institutions, and entities subordinate to the Ministry of Education and Science of Ukraine, as well as other organizations of the city, region, and country, whenever necessary to resolve issues related to scientific and scientific-technical activities at the University.
8. Final Provisions
8.1 Regulations on the Research Division are signed by the Head of the RD and approved by the Vice-Rector for Research, the Head of Human Resources, and the Head of the Legal Department of the University.
8.2 Regulations on the RD are approved by the Rector of the University and enacted by Rector's order.
8.3 Amendments and/or additions to these Regulations are made following the procedure established for their adoption.
