1. General Provisions
1.1. Regulations on the Procedure for Providing Paid Services (Except Educational) is a document regulating the procedure for providing paid services provided in accordance with legislation and related to the performance of functions and tasks of National Aerospace University «Kharkiv Aviation Institute» (hereinafter – University).
1.2. Regulations on the Procedure for Providing Paid Services (Except Educational) (hereinafter – Regulations) of the University were developed in accordance with:
- Law of Ukraine «On Education» dated 05.09.2017 No. 2145-VIII (as amended);
- Law of Ukraine «On Higher Education» dated 01.07.2014 No. 1556-VII (as amended);
- Budget Code of Ukraine dated 08.07.2010 No. 2456-VI (as amended);
- Tax Code of Ukraine dated 02.12.2010 No. 2755-VI (as amended);
- Resolution of the Cabinet of Ministers of Ukraine «On Approval of the List of Paid Services That May Be Provided by Educational Institutions, Other Establishments, and Institutions of the Education System Belonging to State and Municipal Forms of Ownership» dated 27.08.2010 No. 796 (as amended);
- Procedure for Providing Paid Educational Services by State and Municipal Educational Institutions and the Procedure for Providing Other Paid Services by State and Municipal Educational Institutions, approved by Joint Order of MON, Minekonomiky, and Minfin dated 23.07.2010 No. 736/902/758;
- Charter of the University (hereinafter – Charter);
- other regulatory acts of Ukraine regulating the activities of higher education institutions in the field of paid services, and relevant licenses (other permit documents) of the University.
1.3. In these Regulations, the terms below are used in the following meaning:
Customer – a natural or legal person who, on the basis of an agreement (contract, application), orders a paid educational service for themselves or another person, assuming financial obligations for its (service) payment.
Inflation Index – the official inflation index for the previous calendar year determined in accordance with the procedure established by legislation.
Service – the term is used in the meaning defined by the Law of Ukraine «On Consumer Rights Protection».
2. List of Paid Services (Except Educational)
2.1. When providing paid services that do not belong directly to the sphere of educational activity, regulatory acts regulating the provision of services in the corresponding field of activity are applied.
2.2. The University has the right to provide paid services to legal entities and natural persons in accordance with current regulatory acts, resolutions of the Cabinet of Ministers of Ukraine, and orders of the Ministry of Education and Science of Ukraine, provided that an adequate level of educational services as the primary statutory activity of the University is ensured, and provided that the material and technical base of the University complies with legal requirements, and where legislation establishes requirements regarding the need for licensing or obtaining permits for providing a paid service – after obtaining such permit documents. Paid services shall be provided exclusively in excess of volumes established by state order and outside activities funded by relevant budget funds, by the same structural units that carry out the educational process under state order, or by separate structural units of the University created for providing paid services acting on the basis of regulations approved in accordance with legislation and the University Charter.
The list of paid services (except educational) that may be provided by the University is approved by the Cabinet of Ministers of Ukraine and defined in these Regulations, namely:
2.2.1. In the field of scientific and scientific-technical activity:
1) conducting scientific research, experimental development, design and engineering, technological, exploratory, and design-and-exploratory work;
2) carrying out work on diagnostics, standardization, and certification of technological processes, equipment, and materials, metrological support, and technical protection of information;
3) conducting research on the development of individual sectors;
4) conducting scientific, scientific-technical, and other types of expertise in accordance with the procedure established by legislation;
5) designing, developing, and manufacturing experimental samples and test batches of materials, substances, devices, and equipment;
6) testing equipment, structures, products, substances, and materials;
7) providing consultations on matters of scientific research (including dissertation research), its organization, and scientific servicing;
8) conducting courses, consultations, seminars, workshops, training sessions, and internships;
9) information and analytical support for scientific activities;
10) providing access to local and corporate computer networks, the Internet, automated databases, and search engines via segments of local and corporate networks;
11) implementation, production, and sale of pilot, industrial, scientific, scientific-technical, and innovative products, machinery, equipment, devices, and hardware manufactured using proprietary technologies;
12) carrying out operations related to the transfer of technologies developed at the expense of the State Budget;
13) conducting laboratory analyses and sample testing;
14) supporting the operations of technology and science parks;
15) supporting the development of state standards and technical specifications for product manufacturing, and conducting its certification testing;
16) developing scientific and technical documentation;
17) granting permissions (issuing licenses) for the use of intellectual property objects;
18) designing, developing, configuring, implementing, testing, selling, modifying, supporting, and maintaining software (in particular, system, application, and database software);
19) organization and holding of scientific events (congresses, seminars, conferences, etc.), unless provided for by the curricula for personnel training and not belonging to activities funded from the general fund of state and local budgets;
20) development of computer programs (systems) to support and organize the processes of creating, editing, populating, and managing website content;
21) provision of access services to scientific equipment for conducting scientific research and scientific-technical (experimental) developments, as well as services for conducting scientific research using scientific equipment;
22) provision of electronic communication networks for use;
23) provision, in accordance with the Law of Ukraine «On Electronic Communications», of services for voice electronic communications, interpersonal electronic communications, signal transmission, access to electronic communication networks, interconnection of electronic communication networks, maintenance, operation, installation, reconstruction, and repair of electronic communication networks, including the development of technical specifications and approval of designs for electronic communication networks, access for placement of technical equipment for electronic communications, electronic communications (development and issuance of technical specifications, approval of working designs, reservation and provision of space in duct systems and their use), and provision of other electronic communication services;
24) performing calculations, providing information, consultations, and clarifications related to astronomical phenomena and tools of practical astronomy.
2.2.2. In the field of international cooperation:
1) providing assistance to international students in obtaining visas;
2) providing organizational, protocol-informational, consulting services, and translation services, except when such services are provided to a person who works or studies at the educational institution (establishment) and is sent by such educational institution (establishment) abroad for study, internship, or work using budget funds.
2.2.3. In the field of healthcare, recreation, adaptation, rest, leisure, health recovery, tourism, physical culture, and sports:
1) provision of accommodation, rest, and health recovery in sports and health camps, children's tourist centers, preventoriums, and recreation centers, including transportation;
2) conducting group and individual physical culture and sports classes using the corresponding material and technical base of the University, unless provided for by the curricula and not belonging to activities funded from the general fund of state and local budgets;
3) providing temporary use of sports equipment and gear, personal belongings, and leisure items, unless provided for by the curricula and not belonging to activities funded from the general fund of state and local budgets;
4) organization and holding of sports, physical-culture, and health-improving events (including international ones) using the corresponding material and technical base of the University, unless provided for by the curricula and not belonging to activities funded from the general fund of state and local budgets;
5) serving tour groups and individual visitors on the territories and premises of the University;
6) organization and holding of concert and entertainment events;
7) organization and holding of social, rehabilitation, and adaptive events aimed at the integration of veterans and persons with disabilities into civilian life.
2.2.4. In the field of personal services:
1) construction, repair, and arrangement of housing, utility, and household structures and premises;
2) repair, maintenance, diagnostics, adjustment, and re-equipment of household, computer, telecommunication, peripheral, copying, and office equipment, technical learning aids, devices, equipment, and multifunctional equipment, as well as photo, TV, video, and audio equipment; manufacturing, sales, and repair of metal products;
3) manufacturing, sales, and repair of furniture, household joinery, and garden equipment;
4) provision of services related to photography, filming, video recording, and audio recording, as well as the production, processing, and editing of film, video, TV, and audio products;
5) manufacturing, sales, and repair of footwear, garments, haberdashery items, consumer goods, and proprietary souvenir products;
6) provision of bath and laundry services, and dry cleaning services;
7) providing temporary use of cultural and household items, inventory, audio and video equipment, theatrical and stage costumes, theatrical props, tools and equipment, audio and video recordings, exhibition equipment, video facilities, video editing suites, photo studios, sound labs, video viewing classrooms, and other areas, inventory, and equipment;
8) provision of hairdressing services.
2.2.5. In the field of housing and communal services:
1) provision of specially equipped buildings and premises on the University's balance sheet for temporary residence;
2) provision of vacant, specially equipped dormitory premises during vacations for temporary residence;
3) provision of specially equipped dormitory premises of the University for accommodation of:
- persons studying or working at the University;
- applicants to the University during entrance examinations;
- persons on official business trips to the University;
- persons studying at another higher education institution residing in University dormitories by decision of the Rector;
- employees of other educational institutions, establishments, and organizations;
4) provision of communal services, as well as operational and maintenance services for buildings and premises, to citizens using permanent or temporary residence services;
5) replacement of plumbing fixtures, gas, electrical, and other equipment in case of damage or destruction through the fault of users, or upon request of citizens using permanent or temporary residence services for installing upgraded or new equipment prior to the expiration of the standard service life of the installed equipment;
6) provision of communal services to users of premises and buildings not on the University's balance sheet;
7) provision of other services for the arrangement and maintenance of buildings and premises upon request of persons residing in specially equipped buildings and premises on the University's balance sheet.
8) production of thermal energy (except for thermal energy production activities at combined heat and power plants, thermal power plants, nuclear power plants, cogeneration units, and units using non-traditional or renewable energy sources), its transportation via trunk and local (distribution) heat networks, and supply of thermal energy;
9) provision by the University, as the owner of electrical networks, of the technical capability for transmission (transit) of electrical energy to the point of connection of electrical installations of a consumer (sub-consumer) in specified volumes within the allowed capacity of the consumer (sub-consumer).
2.2.6. In the field of other services:
1) leasing of buildings, structures, individual temporarily vacant premises and spaces, and other movable and immovable property or equipment that is temporarily not used in educational, instructional, training-production, or scientific activities, provided that this does not worsen the social and living conditions of persons studying or working at the University;
2) operational and maintenance services for premises, spaces, property, and equipment provided under lease;
3) provision of printing services (editing, translation of scientific, reference, technical, educational, instructional-methodological, and fiction literature, development of graphic design); computer typesetting, layout of texts; advertising services, sales of proprietary printed products, including informational, advertising, and form products (except for the publication and sale of educational literature, methodological, scientific-methodological, scientific, and scientific-technical publications, printed mass media (newspapers, magazines, almanacs, etc.), publication and placement on websites of banners and other advertising products in electronic form;
4) printing, copying, scanning, laminating, and recording information onto media;
5) production and sale of catering products, organization of their consumption, including the supply of other prepared dishes;
6) providing the issuance of certificates of associate professor, professor, senior researcher, certificates of completion of postgraduate studies, doctoral studies, other educational and academic title documents, and their duplicates in accordance with the procedure established by law;
7) providing the issuance of certificates of passing candidate examinations for graduates of previous years;
8) providing the issuance of student and pupil ID cards, record books for persons studying under contracts concluded with individuals and legal entities; and their duplicates for all categories of persons studying at the University;
9) providing the issuance of educational documents in accordance with the procedure established by law;
10) execution of bookbinding and brochure-making work;
11) provision of services to banking institutions by placing temporarily free own revenue of the University on current and deposit accounts in public sector banks in accordance with the procedure established by law;
12) execution of measures related to exhibition and fair activities in accordance with legislation;
13) providing access to the Internet, local and corporate computer networks, automated databases, and search engines, and the use of email for persons who do not work or study at the University;
14) production and sale of products of educational-production workshops, subsidiary farms, and other educational-production, production, and research units, produced outside of study hours and not funded by state and local budget funds allocated for educational activities;
15) provision of services by educational-production, production, and research units that correspond to the training field, including repair, restoration, and technical maintenance of vehicles and technological equipment;
16) providing short-term (one-time, round-the-clock for up to one week, or no more than six hours per week during a calendar year) use of space and/or individual premises to physical and legal entities that are temporarily not used in educational, instructional, training-production, or scientific activities for holding educational, scientific, sports, ceremonial, cultural, and other events (except for events held for religious purposes or events of political parties), as well as other movable and immovable property or equipment, provided that this does not worsen learning or social and living conditions for persons studying or working at the University;
17) providing short-term (up to one month) use, in accordance with legislation, of locations for basing and storing vehicles, including piers, berths, airfields, and parking spaces, provided that this does not worsen learning or social and living conditions for persons studying or working at the University;
18) transportation of goods by special transport, including marine, river, and air vessels, as well as individual passengers or organized groups of the population;
19) execution of loading and unloading work;
20) provision of airport servicing of aircraft, including aviation security, air traffic management, provision of airspace in the area of responsibility, provision of aeronautical information, as well as meteorological, medical, search, and rescue support for flights;
21) performance of aerial work within the territory of Ukraine and abroad in accordance with the procedure established by law;
22) provision of temporary use of space for storing equipment, property, fuel and lubricants, and other valuables belonging to other legal entities or physical persons;
23) laboratory analysis of fuel and lubricants in accordance with the procedure established by law;
24) testing of electrical equipment and electrical wiring, verification of water and energy metering devices, other technical instruments, equipment, and systems in accordance with the procedure established by law
; carrying out work on water quality control, analysis of wastewater and sludge;
25) carrying out design, development, installation, diagnostics, repair, adjustment, and maintenance of video surveillance systems, internal alarms, structured cabling systems, telephone networks, synchronized clock systems, and bells in accordance with the procedure established by law;
26) development, implementation, and maintenance of multimedia classroom, conference hall, and Internet cafe projects.
3. Requirements for organizing the provision of paid services
3.1. The University is obliged to provide the customer with full, accessible, and reliable information free of charge regarding the procedure and terms for providing a specific paid service, its cost, and the procedure and timeframe for payment.
3.2. Structural units of the University may be designated to provide paid services, reflecting these functions in their regulations.
3.3. Paid services defined by this Regulation are provided on the basis of:
- a written application for a physical person, drawn up in free form;
- a contract (agreement) for a physical person or legal entity;
- upon payment for the paid service in accordance with the procedure established by law;
- accession to a public agreement (public offer) on the provision of services by performing actions that indicate acceptance of its terms (in particular, payment for the service) and documentary confirmation of the provision of the service (relevant receipt, application for accession to the public agreement, etc.).
If, in accordance with applicable regulatory legal acts, the customer has the right to make payment for the service in installments or solely upon the provision of the service, all step-by-step amounts and payment terms are specified in the relevant agreement (contract).
4. Procedure for establishing the cost of paid services
4.1. Establishing the cost of paid services provided by the University is carried out on the basis of economically justified expenses related to their provision.
4.2. For each type of paid service, an appropriate cost calculation (costing sheet) is drawn up and approved by the Rector of the University.
4.3. The components of the cost expenses are:
- employee remuneration costs;
- accruals on the payroll fund in accordance with legislation;
- direct expenses and payment for services of third-party organizations;
- capital expenditures.
5. Providers of paid services
5.1. Paid services may be provided by the same structural units that carry out activities aimed at fulfilling the state order.
5.2. University employees involved in providing paid services receive monetary remuneration for the work performed in accordance with applicable legislation.
5.3. In cases where the University's resources are insufficient to provide a specific type of service, specialists from third-party organizations may be engaged on the basis of concluded commercial contracts for work performance (provision of services).
6. Procedure for the execution of paid services
6.1. The organization of providing a specific paid service and its documentation must be carried out by the structural unit of the University responsible for its provision, acting on the basis of regulations approved in accordance with legislation and the University Statute.
6.2. Based on the demand for the relevant paid service, its content, scope, and term of provision are determined.
6.3. Taking into account the content, timeframe, and involved material, technical, and labor resources necessary to provide the paid service, the planning and finance department, upon submission by the responsible person, calculates the cost of this service in accordance with applicable legal norms.
7. Procedure for settlement for provided paid services
7.1. Payment for paid services provided to individuals is made prior to the start of their provision. The procedure, terms, and types of payment for providing services to legal entities may be provided for by the terms of the relevant contract.
7.2. Payment for paid services is deposited into the University's account through banking institutions.
7.3. Funds received for providing paid services are credited to the special fund of the University's budget as payment for services provided by budgetary institutions in accordance with applicable legislation.
8. Use of funds
8.1. Revenues received by the University from providing paid services are credited to an account opened with the State Treasury Service of Ukraine or to current accounts opened in banking institutions in accordance with applicable legislation.
8.2. Revenues received by the University from providing paid services are used in accordance with Article 13 of the Budget Code of Ukraine and are directed toward covering the University's expenses.
8.3. Accounting for revenues from fees for services provided by the University in accordance with its functional authority, as well as the expenditure of these funds, is maintained in accordance with the Law of Ukraine "On Accounting and Financial Reporting in Ukraine" dated July 16, 1999, No. 996-XIV (as amended).
9. Final provisions
9.1. The Regulation on the procedure for providing paid educational services is approved by the Academic Council of the University and brought into effect by the order of the Rector.
9.2. Amendments and/or additions to this Regulation are made in the procedure established for its adoption.
