1. General Provisions
1.1. Regulations on the Procedure for Providing Paid Educational Services is a document regulating the procedure for providing paid services provided in accordance with legislation and related to the performance of the main functions and tasks of National Aerospace University «Kharkiv Aviation Institute» (hereinafter – University).
1.2. Regulations on the Procedure for Providing Paid Educational Services (hereinafter – Regulations) of the University were developed in accordance with:
- Law of Ukraine «On Education» dated 05.09.2017 No. 2145-VIII (as amended);
- Law of Ukraine «On Higher Education» dated 01.07.2014 No. 1556-VII (as amended);
- Budget Code of Ukraine dated 08.07.2010 No. 2456-VI (as amended);
- Tax Code of Ukraine dated 02.12.2010 No. 2755-VI (as amended);
- Resolution of the Cabinet of Ministers of Ukraine «On Approval of the List of Paid Services That May Be Provided by Educational Institutions, Other Establishments, and Institutions of the Education System Belonging to State and Municipal Forms of Ownership» dated 27.08.2010 No. 796 (as amended);
- Procedure for Providing Paid Educational Services by State and Municipal Educational Institutions and the Procedure for Providing Other Paid Services by State and Municipal Educational Institutions, approved by Joint Order of MON, Minekonomiky, and Minfin dated 23.07.2010 No. 736/902/758;
- Charter of the University (hereinafter – Charter);
- other regulatory legal acts of Ukraine regulating the activities of higher education institutions in the field of paid educational services, and relevant licenses (other permit documents) of the University.
1.3. In these Regulations, the terms below are used in the following meaning:
Customer – a natural or legal person who, on the basis of an agreement (contract, application), orders a paid educational service for themselves or another person, assuming financial obligations for its (service) payment.
Inflation Index – the official inflation index for the previous calendar year determined in accordance with the procedure established by legislation.
University – a higher education institution conducting innovative educational activities across various higher education degrees (in particular, Doctor of Philosophy), conducting basic and/or applied scientific research, serving as a leading scientific and methodological center, possessing a developed infrastructure of educational, scientific, and scientific-production units, fostering the dissemination of scientific knowledge, and conducting cultural and educational activities.
Learners – higher education candidates (students, postgraduate students, doctoral students) and others (listeners, other citizens) to whom the University provides paid educational services.
Service – the term is used in the meaning defined by the Law of Ukraine «On Consumer Rights Protection».
1.4. The purpose of providing paid educational services is to obtain own revenue for the special fund of the state budget to strengthen the material and technical base of the University and ensure the educational process in accordance with modern requirements.
2. List of Paid Educational Services
2.1. The University, in accordance with legislation and these Regulations, may provide natural persons and legal entities with paid educational services, provided that an adequate level of educational services as the main statutory activity is ensured.
The list of paid educational services that may be provided by the University is approved by the Cabinet of Ministers of Ukraine and defined in these Regulations, namely:
1) tuition in excess of the state order within the licensed capacity in accordance with contracts concluded with natural persons or legal entities, higher education candidates (students, postgraduate students, and doctoral students);
2) tuition of students to obtain a second higher education of a certain level in cases where higher education of such level has already been obtained (is being obtained) by the person under a state order (except in cases where the right to obtain a second higher education free of charge is granted by legislation);
3) teaching one or more disciplines (subjects) to higher education candidates in English and/or other foreign languages alongside teaching the specified discipline (subject) in the state language according to the curriculum, except in cases where such teaching is provided for by the curricula;
4) provision of an educational service to another higher education institution involving the teaching of the academic discipline «Basic General Military Training» to higher education candidates of such institution;
5) teaching individual disciplines (educational components) to higher education candidates in excess of the volumes established by the curriculum of the corresponding educational program, or for them to complete (clear) an academic difference resulting from curriculum discrepancies during transfer or reinstatement of such candidates to the corresponding educational program;
6) teaching individual disciplines (educational components) to persons for the purpose of their subsequent recognition as periods and learning outcomes acquired through non-formal and informal education;
7) conducting assessment measures to evaluate acquired learning outcomes for the purpose of their subsequent recognition;
8) advanced training, retraining, and other training for obtaining postgraduate education in excess of the state order within the licensed capacity;
9) conducting special courses, seminars, workshops, internships, and professional competence enhancement in another form that does not require obtaining a corresponding license;
10) recognition of qualifications obtained through non-formal or informal education;
11) certification of aviation personnel in accordance with the obtained licenses;
12) recognition of qualifications, learning outcomes, and periods of study within the vocational pre-higher or higher education system obtained in the temporarily occupied territory of Ukraine after February 20, 2014;
13) training at the educational level of a skilled worker in excess of the state order within the licensed capacity, except in cases where obtaining the educational level of a skilled worker is provided for by the training curriculum at the educational level of vocational pre-higher or higher education;
14) preparation for admission to vocational pre-higher and higher education institutions and for external independent testing;
15) retraining, advanced training, and other training ordered by employment centers;
16) tuition of higher education candidates who are lawfully residing in Ukraine, from among foreigners and stateless persons permanently residing in Ukraine; persons who have been granted refugee status in Ukraine; persons in need of additional or temporary protection; persons who have been granted the status of an overseas Ukrainian (except in cases where their right to receive higher education free of charge is provided for by legislation);
17) internships for foreigners and stateless persons lawfully residing in Ukraine, except in cases where their right to a free internship is provided for by legislation;
18) administering candidate examinations, publishing and distributing extended abstracts of dissertations, dissertations, shorthand reporting during dissertation defense, organizing, preparing for, and conducting dissertation defenses for the degree of Doctor of Philosophy (Candidate of Sciences) and Doctor of Sciences for persons studying (who studied) under contracts concluded with natural persons or legal entities, including for persons not studying (who did not study) at the University (except for paying for the meeting time of specialized academic council members and paying for the participation time of official opponents in such meetings);
19) providing scientific support and internships for individuals who independenty improve their qualifications;
20) conducting lectures, courses, consultations, trainings, practical sessions, master classes, club activities, electives, seminars, and other forms of educational sessions (on the preparation and retraining of vehicle drivers for categories A, A1, B, B1, C, C1, D, D1, E, E1) in excess of the volumes established by curricula, with or without issuing relevant educational documents;
21) organizing and conducting events outside of academic hours (including during holidays, festive days, and weekends) in educational, scientific, technical, artistic, tourist, ecological, sports, wellness, and humanitarian areas, except for those funded from the general fund of the state budget;
22) compiling bibliographic lists for term papers, graduation theses, and scientific papers, catalogs for personal libraries, as well as libraries of enterprises, institutions, and organizations, and preparing factual, analytical, and bibliographic references;
23) providing access to library collections for individuals who do not work or study at the University;
24) publishing and selling educational literature, methodological, scientific-methodological, scientific, and scientific-technical publications, and printed mass media (newspapers, journals, almanacs, etc.);
25) developing, implementing, and supporting electronic learning materials and distance learning courses;
26) providing organizational services related to licensing, attestation, and accreditation processes.
3. Requirements for the Organization of Providing Paid Educational Services
3.1. The University has the right to provide additional paid educational services exclusively in excess of the volumes established by the state standard and outside activities funded by the relevant budget funds.
3.2. Paid educational services are provided by the University on the condition that the material and technical base meets legislative requirements, and in cases where legislation establishes requirements for licensing or obtaining permits to provide a paid service – after obtaining such permit documents.
3.3. Paid educational services are provided on a voluntary basis upon:
- a written application – for a natural person,
- an agreement (contract) – for a natural or legal person.
3.4. Paid educational services under sub-items 1 – 11, 13, and 15–18 of item 2.1 of Section 2 of these Regulations are provided on the basis of an agreement (contract). The agreement (contract) is concluded on the basis of a personal application of a natural person or an official request of a legal person using forms approved by the Rector's orders, taking into account the provisions of the Standard Agreement on the Provision of Paid Educational Services for Specialist Training, approved by Order of the Ministry of Education and Science of Ukraine dated 07.09.2020 No. 1113 (as amended by Order of the Ministry of Education and Science of Ukraine dated 23.01.2025 No. 87).
The agreement between the Customer and the University obligatorily includes:
- subject (type) of the paid service;
- rights and obligations of the parties;
- procedure for providing the paid service;
- cost and payment terms for its provision;
- term of validity of the agreement;
- liability of the parties.
3.5. Paid educational services under sub-items 10, 14, and 19–26 of item 2.1 of Section 2 of these Regulations are provided on the basis of a written application submitted by the Customer – a natural person.
3.6. Paid educational services are provided by the University on the condition that funds are transferred to the University's account as an advance payment in the amount and within the timeframe specified in the agreement when providing services listed in sub-items 1–11, 13, and 15–19, or specified in the regulation on the provision of an individual service according to the list provided in sub-items 10, 14, and 19–26 of item 2.1 of Section 2 of these Regulations.
3.7. The University undertakes to provide the Customer free of charge with complete, accessible, and reliable information regarding the procedure and terms for providing a specific paid educational
service, its cost, and the procedure and timeframe of payment.
3.8. The University is obligated to publish the cost of the paid educational service determined in accordance with the established procedure within the time limits set by current legislation:
- the cost of a paid educational service provided for obtaining a corresponding degree of education (for the first year/course of study and for the calculated period of completing the educational program to obtain a corresponding degree of higher education broken down by educational programs (competitive proposals) and forms of higher education study) – no later than two months before the start of receiving applications from applicants wishing to receive it (sub-item 1 of item 2.1);
- the cost of other paid educational services – no later than 15 calendar days before the start of their provision.
4. Procedure for Establishing the Cost of Paid Educational Services
4.1. Establishing the cost of paid educational services provided by the University is carried out on the basis of economically justified expenses associated with their provision.
The University may differentiate the amount of fee for providing a paid educational service based on the licensed capacity, and the balance of demand and supply for specific specialties (specializations) receiving special support from the state.
The University may establish a maximum (minimum) fee limit for providing a paid educational service based on the licensed capacity for specialties (specializations) listed in the «List of Specialties (Specializations) for Which Maximum (Minimum) Prices Are Established for Paid Services in Specialist Training Across Higher Education Levels» approved by Resolution of the Cabinet of Ministers of Ukraine «Certain Issues Regarding the Implementation of Indicative Cost» dated 03.03.2020 No. 191 (as amended).
The amount of the fee for providing an educational service may change annually, taking into account the inflation index for the previous year. The amount of the fee for providing other paid services is established based on the cost of each specific service, which is set for the entire period of its provision in full.
4.2. For each type of paid educational service (upon submission by the responsible person – service executor), a corresponding cost calculation (costing sheet) is drawn up and approved by the Rector of the University.
4.3. The components of cost expenses are:
- employee remuneration costs;
- accruals on the payroll fund in accordance with legislation;
- direct expenses and payment for services of third-party organizations;
- capital expenditures, etc.
5. Providers of Paid Services
5.1. Paid educational services may be provided by the same structural units of the University that train citizens under the state order.
5.2. University employees involved in providing paid educational services receive monetary remuneration for the work performed in accordance with applicable legislation.
5.3. In cases where the University's resources are insufficient to provide a specific type of educational service, specialists from third-party organizations may be (additionally) engaged on the basis of concluded commercial contracts for work performance (provision of services).
6. Procedure for the Execution of Paid Services
6.1. The organization of providing a specific paid educational service and its documentation (support) is carried out by the structural unit of the University responsible for its provision, acting on the basis of regulations approved in accordance with legislation and the University Statute.
6.2. Based on the demand for the relevant paid educational service, its content, scope, and term of provision are determined. Draft regulations on the provision of an individual paid educational service and a draft curriculum are prepared, coordinated with the Vice-Rector of the relevant direction, and submitted to the Rector for approval.
6.3. Pursuant to the approved curriculum and in accordance with the approved regulations, the responsible person of the unit providing the specified educational service prepares a draft order indicating the content, scope, term, customers, and providers of the services. Upon coordination with the Vice-Rector of the relevant direction, the draft order is submitted to the Rector for approval.
6.4. Taking into account the academic load, timeframe, material, technical, and labor resources required to provide the paid educational service, the planning and finance department calculates the cost of this service in accordance with applicable legal norms.
6.5. Upon completion of the provision of the paid educational service, taking into account the learning outcomes, the University provides the customer with the relevant document provided for in the approved regulation for an individually specified educational service or in the agreement.
7. Procedure for Settlements for Provided Paid Educational Services
7.1. The procedure, terms, and types of payment for provided educational services are specified by the conditions of the relevant regulation on the provision of a specified paid educational service.
7.2. Payment for educational services is deposited into the University's account through banking institutions in non-cash form on terms of advance payment for the period specified in the relevant regulation on the provision of a specified paid educational service or in the agreement (contract).
7.3. Funds received for providing paid services are credited to the special fund of the University's budget as payment for services provided by budgetary institutions in accordance with their main activity.
8. Use of Funds
8.1. Revenues received by the University from providing paid educational services are credited to an account opened with the State Treasury Service of Ukraine or to current accounts opened in banking institutions in accordance with applicable legislation.
8.2. Revenues received by the University from providing paid educational services are used in accordance with Article 13 of the Budget Code of Ukraine and are directed toward covering expenses associated with organizing and providing services supplied by budgetary institutions in accordance with their main activity, namely educational services.
8.3. Accounting for revenues from fees for services provided by the University in accordance with its functional authority, as well as the expenditure of these funds, is maintained in accordance with the Law of Ukraine "On Accounting and Financial Reporting in Ukraine" dated July 16, 1999, No. 996-XIV (as amended).
9. Final Provisions
1. The Regulations on the Procedure for Providing Paid Educational Services are approved by the Academic Council of the University and brought into effect by the order of the Rector.
2. Amendments and/or additions to these Regulations are made in the procedure established for their adoption.
