1. General Provisions
1.1 These Regulations regulate the general managerial, economic, and legal foundations for the functioning of the Intersectoral Research Institute of Problems of Physical Modeling of Aircraft Flight Modes of the National Aerospace University «Kharkiv Aviation Institute» (hereinafter referred to as NDI PFM KhAI) and have been developed in accordance with the Laws of Ukraine «On Higher Education», «On Scientific and Scientific-Technical Activity», as well as the Statute of the University.
1.2 NDI PFM KhAI is a separate structural subdivision of the National Aerospace University «Kharkiv Aviation Institute» (hereinafter referred to as the University) with separate legal entity rights. NDI PFM KhAI is not subject to state registration. Information regarding it is entered into the University's registration file and included in the Unified State Register.
1.3 Full name of NDI PFM KhAI in English: Intersectoral Research Institute of Problems of Physical Modeling of Aircraft Flight Modes of the National Aerospace University «Kharkiv Aviation Institute».

1.4 The Research Institute of Problems of Physical Modeling of Aircraft Flight Modes under the Kharkiv Aviation Institute was created by a joint resolution of the CPSU Central Committee and the USSR Council of Ministers dated January 16, 1989, No. 45-6.
By a joint order of the Ministry of Education and Science of Ukraine dated May 19, 1994, No. 148 and the Ministry of Machine-Building, Military-Industrial Complex, and Conversion of Ukraine dated June 2, 1994, No. 870, it was granted the status of an Intersectoral Research Institute as a state-owned legal entity within the Kharkiv Aviation Institute.
By order of the Ministry of Education and Science of Ukraine dated June 3, 2005, No. 334, in coordination with the Ministry of Industrial Policy of Ukraine, the Intersectoral Research Institute of Problems of Physical Modeling of Aircraft Flight Modes was reorganized into a structural subdivision of the research department of the National Aerospace University «Kharkiv Aviation Institute».
1.5 NDI PFM KhAI has a separate balance sheet, staffing schedule, current and other accounts in bodies of the State Treasury Service of Ukraine and banking institutions, a round seal, a stamp, and letterheads with its own name, and conducts its personnel policy independently.
NDI PFM KhAI is established, reorganized, or liquidated by a decision of the Academic Council of the University, which is enacted by order of the Rector. The termination of NDI PFM KhAI's activity is carried out through its liquidation or reorganization. Upon reorganization, all documentation of NDI PFM KhAI regarding main activities must be promptly transferred for storage to the legal successor, and during liquidation - to the University archive.
The scope of rights and obligations granted to NDI PFM KhAI is determined by the Rector of the University in the manner prescribed by the legislation of Ukraine and is fixed in these Regulations and the power of attorney issued in the name of the Head of NDI PFM KhAI.
NDI PFM KhAI, within the powers specified in the power of attorney issued by the Rector of the University, may conclude agreements with counterparties on its own behalf in the manner and under the procedures established in the University to ensure its own activity.
1.6 Within the structure of the University, NDI PFM KhAI is part of the research department. The internal structure of NDI PFM KhAI is drafted by the Head of NDI PFM KhAI in coordination with the Vice-Rector for Research of the University and approved by the Rector. NDI PFM KhAI may include research departments, laboratories, sectors, groups, experimental production, etc. The management structure, principles of work organization, and procedure for the creation, reorganization, or liquidation of NDI PFM KhAI are regulated and carried out in the manner established by the University Statute for faculties. NDI PFM KhAI carries out its activity, provides relevant services, and performs works within a single organizational and technological process with the University.
1.7 NDI PFM KhAI is subordinated to the Rector of the University. Operational management and direct guidance of NDI PFM KhAI's activity are carried out by the Vice-Rector for Research of the University on behalf of the Rector.
Control over the activities of NDI PFM KhAI is exercised by the Rector, the Vice-Rector for Research, as well as, upon the Rector's delegation, the heads of University services (units) in accordance with specific areas of NDI PFM KhAI's activity. The Head of NDI PFM KhAI reports on their activities to the Academic Council of the University.
1.8 In its activities, NDI PFM KhAI is guided by the Constitution of Ukraine, the Laws of Ukraine «On Higher Education», «On Scientific and Scientific-Technical Activity», resolutions of the Cabinet of Ministers of Ukraine, decrees of the President of Ukraine, resolutions of the Verkhovna Rada of Ukraine, orders of the Ministry of Education and Science of Ukraine, the Statute of the University, orders and instructions of the Rector of the University, instructions of the Vice-Rector for Research, as well as other regulatory and legal acts of the University and these Regulations.
1.9 Staff positions of NDI PFM KhAI are determined in accordance with standards and preliminarily coordinated with the planning and financial department of the University. Staff positions of NDI PFM KhAI are annually reviewed and approved in accordance with the current legislation of Ukraine. The financial and economic activity of NDI PFM KhAI is carried out within the limits of the approved cost estimate.
2. Purpose of Activity, Main Tasks, and Functions
2.1 The purpose of NDI PFM KhAI's activity is:
- comprehensive execution of scientific and technical developments of new samples of aviation equipment;
- scientific research, development of fundamental, exploratory, research-and-development, and implementation works;
- training of scientific personnel in postgraduate and doctoral programs of the University.
2.2 The main tasks of NDI PFM KhAI are:
- performance of fundamental, research, research-and-development, scientific-production works and services in accordance with the thematic plan of fundamental and applied research works and applied developments carried out at the expense of the state budget, economic contracts, grants, and other sources not prohibited by the legislation of Ukraine;
- participation in the educational process of the University, in particular, industrial practice, diploma and course design, etc.;
- participation in the established manner in the implementation of the University's foreign economic relations;
- effective use of the creative potential of NDI PFM KhAI employees in solving pressing problems of science, engineering, and technology;
- other activities that contribute to the development of scientific and technical progress in various sectors of Ukraine's economy.
2.3 The main directions of activity of NDI PFM KhAI are developed by the Director of NDI PFM KhAI, coordinated with the Vice-Rector for Research, and approved by the Rector of the University, and agreed upon with customers if necessary.
2.4 The main directions of activity of NDI PFM KhAI are:
- execution of fundamental, exploratory, and applied scientific research with the aim of developing principles and methods that ensure the simulation of flight modes of aerospace engineering samples;
- design, manufacturing, and testing of dynamically similar models for studying the flight modes of aerospace engineering samples;
- execution of research and development works on the creation of manned and unmanned aerial vehicles for various purposes;
- execution of other research and development works that contribute to the scientific and technical development of Ukraine;
- implementation of scientific research into the educational process: scientific-methodological, organizational, and technological management of the development of course and diploma projects, conducting student research work, training postgraduate and doctoral students;
- consulting enterprises and organizations in the field of scientific and technical activity, conducting expert reviews of scientific and technical projects, developments, and ideas.
2.5 In accordance with the main directions of activity and in coordination with the Vice-Rector for Research, NDI PFM KhAI conducts:
- development of thematic plans for research, development, and technological works;
- development and introduction of proprietary programs of scientific and technical activity;
- implementation of the results of scientific and technical activities, inventions, and modern technologies in various sectors of the economy;
- preparation of reports on scientific and technical activities;
- ensuring state registration of developments;
- logistical, material, and informational support for research and development;
- provision of consulting services (of a scientific, technical nature, etc.) in the manner established within the University;
- organization of conferences, seminars, symposia, and exhibitions in the field of activity of NDI PFM KhAI.
2.6 Employees of NDI PFM KhAI participate in the following processes of the University's QMS:
- quality assurance of research works, fundamental, exploratory, and applied scientific research;
- quality assurance of research and development works for the creation of manned and unmanned aerial vehicles for various purposes.
The following mandatory QMS processes are also performed at NDI PFM KhAI:
- control of documented information;
- corrective actions;
- preventive actions;
- control of nonconformities.
3. Rights and Obligations
3.1 The rights and obligations of NDI PFM KhAI are realized through the rights and obligations of its head - the Director of NDI PFM KhAI.
3.2 The Director of NDI PFM KhAI has the right to:
- based on staffing standards, develop and submit the staffing schedule of NDI PFM KhAI for approval by the Rector of the University;
- based on current rules, develop and submit the draft cost estimate of NDI PFM KhAI for approval in the established manner;
- hire and dismiss employees in accordance with procedures agreed upon with the University, forms of employment contracts, and within the limits of the approved staffing schedule;
- issue orders, instructions, and assignments within their competence for the employees of NDI PFM KhAI and monitor their execution;
- approve job descriptions for employees of NDI PFM KhAI (job descriptions for deputy directors and heads of NDI PFM KhAI units are agreed upon by the Director of NDI PFM KhAI and approved by the Vice-Rector for Research of the University; job descriptions for the chief accountant and employees responsible for HR, planning and financial, and legal work of NDI PFM KhAI are also agreed upon with the chief accountant and heads of relevant University departments);
- open bank accounts in the established manner;
- organize labor and manage the activities of NDI PFM KhAI employees;
- carry out procurements, conclude contracts and agreements with counterparties in accordance with procedures agreed upon with the University;
- upon the Rector's delegation, represent NDI PFM KhAI in relations with enterprises, institutions, and organizations, including the activities of international organizations, on the basis of a power of attorney.
The procedure for interaction between NDI PFM KhAI and enterprises, organizations, and institutions is determined and controlled by the Vice-Rector for Research of the University.
3.3 The Director of NDI PFM KhAI has the obligation to:
- ensure proper execution of the approved cost estimate of NDI PFM KhAI, tasks of the University management, obligations to the State, state and other bodies, institutions, enterprises, as well as contractual obligations;
- annually report on performance results in the established manner;
- maintain operational and accounting records of activity results, and statistical reporting;
- upon the demand of the Vice-Rector for Research, the chief accountant, or heads of relevant University departments (services), provide necessary information and documents regarding the activities of NDI PFM KhAI for conducting an internal audit of the unit;
- conduct rational personnel selection within the limits of the approved staffing schedule, and create necessary conditions for improving the professional and qualification level of employees;
- determine the functional responsibilities of NDI PFM KhAI employees;
- to perform the functions, tasks, and obligations provided for by the University's Collective Agreement;
- to create safe and harmless working conditions, personally take measures to eliminate any situation that poses a threat to human life or health and the natural environment;
- to provide the research department, human resources department, planning and financial department, accounting department, and other University units with information on the status of budget-funded and economic contract research and development works, as well as other information necessary for drafting University reports to higher-level organizations.
4. Management and Labor Collective
4.1 NDI PFM KhAI is headed by the Director of NDI PFM KhAI, who is appointed and dismissed by the Rector of the University. The Rector of the University concludes a fixed-term employment contract for a term of up to 5 years with the Director of NDI PFM KhAI. The list of rights, obligations, labor functions, and qualification requirements for holding the position of Director of NDI PFM KhAI is determined by their job description, which is approved by the Rector. Simultaneously with the signing of the fixed-term employment contract with the Director of NDI PFM KhAI, in order to formalize powers for managing the activities of NDI PFM KhAI vis-a-vis counterparties and third parties for the term of this fixed-term employment contract, the Rector of the University issues a corresponding power of attorney to the Director of NDI PFM KhAI.
4.2 In addition to the list of rights and obligations specified in clauses 3.2 and 3.3 of these Regulations, the Director of NDI PFM KhAI may perform the following functions:
- independently or together with a collegial management body or public self-government body of NDI PFM KhAI, within the framework of the current legislation of Ukraine, these Regulations, and the power of attorney, resolve issues regarding the activities of NDI PFM KhAI;
- within their powers, issue orders and instructions that are mandatory for execution by all employees of NDI PFM KhAI;
- upon the Rector's delegation, represent NDI PFM KhAI in state and other bodies, and be responsible for the results of NDI PFM KhAI's activities;
- be a member of the Academic Council and the Scientific and Technical Council of the University ex officio;
- act as the administrator of lower-level property and funds of NDI PFM KhAI within the powers specified in these Regulations and the power of attorney issued by the Rector of the University;
- apply measures of moral and material encouragement, and bring to disciplinary and material liability in accordance with the current legislation of Ukraine, the Statute, and the Collective Agreement of the University;
- control the development, implementation, operation, and improvement of certain processes of the quality management system in the part concerning the activities of NDI PFM KhAI.
4.3 A Scientific and Technical Council has been established at NDI PFM KhAI, whose powers are determined by its respective regulations. The composition of the Scientific and Technical Council of NDI PFM KhAI is formed on the principles defined for the Scientific and Technical Council of the University. The Scientific and Technical Council of NDI PFM KhAI is a collegial management body of the unit and is established for a term of five years.
4.4 The body of public self-government of NDI PFM KhAI is the meeting of the labor collective. The procedure for convening, powers, and other issues of activity of the meeting of the labor collective of NDI PFM KhAI are resolved in accordance with the Statute and the Regulations on the Conference of the Labor Collective of the University.
4.5 The labor collective of NDI PFM KhAI consists of all employees who carry out activities on the basis of an employment contract (agreement). The labor collective of NDI PFM KhAI is part of the University's labor collective. Issues of social insurance and development, healthcare and pension provision, guarantees, and benefits of the labor collective are regulated by the collective agreement, the University's internal regulations, terms of contracts, agreements, and the current legislation of Ukraine.
5. Liability
5.1 The liability of NDI PFM KhAI is realized through the liability of its employees: the Director of NDI PFM KhAI, the chief accountant, and other employees of NDI PFM KhAI. At the same time, the liability of each employee is individual depending on the job duties assigned to them and is determined by their job description and the University's Internal Regulations.
5.2 The Director of NDI PFM KhAI bears personal responsibility for:
- the work of NDI PFM KhAI as a whole;
- the state of labor discipline in NDI PFM KhAI;
- order in the territories, classrooms, and offices assigned to NDI PFM KhAI;
- correct use of funds and material resources;
- timeliness of submitting statistical and financial reporting;
- compliance with internal regulations, equipment operation rules, sanitary and hygienic, environmental, and fire safety standards, labor legislation at NDI PFM KhAI;
- proper performance of their duties and use of granted rights, including for unlawful use of official powers, as well as their use for personal purposes.
5.3 The degree of responsibility of other employees is established by job descriptions.
6. Property and Financial-Economic Activity
6.1 Buildings, structures, property complexes, and other property necessary to ensure the activities of NDI PFM KhAI, the value of which is reflected on an independent balance sheet, may be assigned to NDI PFM KhAI under the right of operational management or economic management in order to ensure its activities provided for by these Regulations.
6.2 Own revenues of NDI PFM KhAI received as payment for works and services provided by it in accordance with its activities, charitable contributions, and grants are credited to special registration accounts opened in the territorial body of the central executive authority in the sphere of treasury maintenance of budget funds, or to current and/or deposit accounts of state banking institutions in the manner established by the Cabinet of Ministers of Ukraine.
6.3 Financing of NDI PFM KhAI is carried out in compliance with the principles of targeted and efficient use of funds, publicity, and transparency in decision-making.
Financing of NDI PFM KhAI is carried out at the expense of the state budget and other sources not prohibited by the legislation of Ukraine. NDI PFM KhAI is a lower-level budget funds administrator.
Additional sources of financing for NDI PFM KhAI may include:
- funds received for research, design and development works (services), and other works performed by NDI PFM KhAI under state orders, by order of enterprises, institutions, organizations, and citizens;
- income from the sale of products;
- subsidies from budgets;
- income from participation in foreign economic activity;
- voluntary monetary contributions and material assets received from enterprises, institutions, organizations, and citizens;
- other funds.
6.4 The material and technical base and funds of NDI PFM KhAI consist of fixed assets, working capital, and other material and financial assets, the value of which is reflected on an independent balance sheet.
6.5 The object of the material and technical base of NDI PFM KhAI is the "Complex of Research Facilities and Equipment for Physical Modeling of Aircraft Flight Modes of the Intersectoral Research Institute of Problems of Physical Modeling of Aircraft Flight Modes" assigned to the University, which is included in the State Register of Scientific Objects that Constitute a National Heritage in accordance with the Order of the Cabinet of Ministers of Ukraine dated August 19, 2002, No. 472-r. The Director of NDI PFM KhAI bears personal responsibility for maintaining this scientific object, which constitutes a national heritage of Ukraine, in proper condition, as well as for its correct use and preservation.
6.6 Relations of NDI PFM KhAI with other institutions, organizations, enterprises regardless of ownership form, and citizens in all spheres of activity are carried out on the basis of contracts, agreements, and other forms of relations established by the legislation of Ukraine.
6.7 Taxation of NDI PFM KhAI is carried out in accordance with the current legislation of Ukraine. NDI PFM KhAI is obliged to timely pay taxes and deductions in accordance with the current legislation of Ukraine.
6.8 Remuneration of labor, establishment and cancellation of allowances, bonuses, and staff salaries for employees, as well as the use of various remuneration systems, is carried out in accordance with the current legislation of Ukraine and the University's collective agreement within the limits of the approved cost estimate of NDI PFM KhAI.
6.9 The Director and the Chief Accountant of NDI PFM KhAI bear personal responsibility for compliance with financial discipline, adherence to record-keeping procedures, and the reliability of accounting and statistical reporting.
7. Interaction with Other Structural Units
7.1 To implement its functions and tasks, NDI PFM KhAI may, in the established manner, receive or provide information related to its competence, participate in initiating and implementing joint scientific, scientific-practical, and other events, and interact within its competence with other structural units of the University. The Director of NDI PFM KhAI, through interaction with other structural units of the University and external bodies, institutions, enterprises, and organizations, ensures the execution of orders from the Rector of the University and instructions from the Vice-Rector for Research concerning the activities of NDI PFM KhAI.
7.2 Internal relationships within NDI PFM KhAI are organized on the principle of combining collegial and one-man management principles. The Director of NDI PFM KhAI resolves issues concerning the activities of NDI PFM KhAI by holding operational meetings, issuing orders and instructions, written directives, etc.
7.3 The Director and employees of NDI PFM KhAI interact with other units of the University in accordance with organizational, administrative, and regulatory documents of the Rector's office and the University Statute:
- on issues of studying and exchanging work experience,
- conducting joint scientific research and other joint events,
- on issues of automation of document management of the scientific process, its information-analytical support and reporting, updating the information websites of NDI PFM KhAI and the University,
- on issues of performing the functions and tasks assigned to NDI PFM KhAI,
The Director of NDI PFM KhAI also participates in general meetings of the University, meetings of the Rector's office, and is a member of the Academic Council and the Scientific and Technical Council of the University.
8. Concluding Provisions
8.1 The Regulations on NDI PFM KhAI are prepared by the Director of NDI PFM KhAI in coordination with the Vice-Rector for Research of the University.
The Regulations on NDI PFM KhAI are approved by the Rector of the University.
8.2 Amendments and/or additions to these Regulations are made in the manner established for their adoption.
8.3 These Regulations enter into force from the moment of approval by the Rector of the University.
