1. General Provisions
1.1 The Regulations on the Educational and Certification Department (hereinafter – ECD) of the National Aerospace University “Kharkiv Aviation Institute” (hereinafter – University) have been developed in accordance with the Laws of Ukraine: “On Education” dated 05.09.2017 No. 2145-VIII (as amended), “On Higher Education” dated 01.07.2014 No. 1556-VII (as amended), “On Scientific and Scientific-Technical Activity” dated 26.11.2015 No. 848-VIII (as amended), “On Metrology and Metrological Activity” dated 05.06.2014 No. 1314-VII, “On Standardization” dated 05.06.2014 No. 1315-VII (as amended); the instruction on the “Procedure for Preparing Regulations on Structural Units” QMS KHAI-VK-RI/001:2015; the Charter of the University (hereinafter – Charter); and other normative acts regulating scientific, scientific-technical, and innovative activities in Ukraine and at the University. These Regulations govern the general managerial, economic, and legal principles of the ECD’s functioning, its educational, educational-methodical, and scientific-technical activities, structure, tasks, functions, rights, leadership competencies, responsibilities, and interaction with other structural units.
1.2 The ECD is a structural unit of the University, subordinated to the Rector, with direct management exercised by the Vice-Rector for Research of the University. By order of the Rector, the ECD may also be directly subordinated to and operationally managed by another University official, based on the corresponding Rector’s order.
1.3 In accordance with clause 1.6.3 of the Charter, the ECD engages in educational activities for additional elective disciplines (minor), educational-methodical work in accordance with the requirements of the “Rules for Approval of Organizations for Training in Aircraft Maintenance” (PART-147), “Rules for Issuance of Aircraft Maintenance Personnel Certificates” (PART-66), “Rules for Approval of Aircraft Maintenance Organizations” (PART-145), “Rules for Continuing Airworthiness” (PART-M), as well as scientific-technical, innovative activities, and the certification of aviation equipment and its components.
1.4 The ECD is established, reorganized, or liquidated by the Rector’s order based on the decision of the University Academic Council. The termination of the ECD’s activities is carried out through its liquidation or reorganization. In the event of reorganization, all documentation of the ECD related to its core activities must be timely transferred to the legal successor, and in the case of liquidation – to the University archive.
1.5 The activities of the ECD are organized and conducted in accordance with the requirements of current Ukrainian legislation, in particular the Laws of Ukraine “On Higher Education,” “On Scientific and Scientific-Technical Activity,” “On Metrology and Metrological Activity,” “On Standardization,” resolutions of the Cabinet of Ministers of Ukraine, decrees of the President of Ukraine, resolutions of the Verkhovna Rada of Ukraine, orders of the Ministry of Education and Science of Ukraine, orders of the State Aviation Service of Ukraine, the University Charter, the Collective Agreement, the University Internal Regulations, orders and directives of the Rector, decisions of the University Academic Council, as well as these Regulations.
2. Main tasks
2.1 Purpose of the ECD:
- ensuring the training of students (within the block of elective disciplines – minor) for further work as personnel in the maintenance of civil aircraft, as well as components intended for installation on such aircraft in accordance with the requirements of the “Rules for Approval of Organizations for Training in Aircraft Maintenance” (PART-147), “Rules for Issuance of Aircraft Maintenance Personnel Certificates” (PART-66), “Rules for Approval of Aircraft Maintenance Organizations” (PART-145), “Rules for Continuing Airworthiness” (PART-M);
- conducting research, experiments, forming conclusions and expert evaluations on the certification of aviation equipment and its components;
- implementing a unified technical policy in the field of metrology and metrological activities, ensuring the quality and competitiveness of scientific and scientific-technical products created at the educational institution, developing regulatory, legal, scientific-technical, and organizational foundations for ensuring measurement uniformity for all laboratories of the University’s units, protecting researchers and laboratory staff at all levels from the consequences of inaccurate measurement results, supporting the educational process and attesting educational laboratory complexes at the University, ensuring that standardization objects correspond to their purpose and managing the diversity, applicability, compatibility, and interchangeability of standardization objects.
2.2 Main tasks of the ECD:
- organizing the educational process, which includes the preparation of courses and their teaching within the block of elective disciplines (minor) under existing educational programs, as well as providing additional educational services for training specialists in civil aircraft maintenance with subsequent certification and issuance of corresponding certificates in accordance with PART-147 and PART-66 (upon request and upon successful completion of the program according to PART-147 and PART-66 standards);
- performing work related to the approval of aircraft maintenance organizations in accordance with PART-145 and issuing or confirming the Approval Certificate;
- conducting research, scientific-production work, and providing services in accordance with PART-M requirements;
- providing metrological support for scientific, research, and educational activities at the University;
- developing and reviewing standards, codes of established practice, technical specifications and amendments thereto, and establishing procedures for their development, review, and application;
- participating, in the prescribed manner, in the University’s foreign economic activities;
- conducting research, experiments, forming conclusions, and expert evaluations on the certification of aviation equipment and its components;
- implementing other projects related to the certification of enterprises, organizations, equipment, and specialists within the University’s areas of activity;
- other activities that contribute to the development of scientific and technological progress in various sectors of Ukraine’s economy.
3. Functions
3.1 To achieve its purpose, the ECD performs the following functions:
- organization of the educational process and certification of students in accordance with the requirements of PART-147, PART-66;
- organization of work related to the approval of aircraft maintenance organizations in accordance with PART-145 and the issuance or confirmation of the Approval Certificate;
- performance of research and scientific-production work and provision of services in accordance with the conditions of PART-M;
- organization of the educational process and other types of work related to the certification of enterprises, organizations, equipment, and specialists within the University’s areas of activity;
- organization of research, experiments, formation of conclusions, and expert evaluations on the certification of aviation equipment and its components;
- ensuring the uniformity and required accuracy of measurements, improving the level of metrological support in the University’s activities, implementing modern measurement methods and tools in practice, aimed at increasing the level of scientific and scientific-technical research, efficiency of educational process support, technical level and quality of scientific and scientific-technical products, as well as other work performed by the University;
- ensuring regulatory and legal regulation in the field of standardization;
- interaction with foreign educational institutions and organizations on the implementation of ECD tasks;
- participation in the creation, equipment, and updating of thematic laboratories in accordance with the requirements set out in PART for the permitted type of activity.
3.2 In accordance with the main areas of activity and with the approval of the Rector, the ECD conducts:
- certification of students who have completed the requirements of the relevant training program and successfully passed final exams, with the issuance of the corresponding certificate;
- development and coordination with the State Aviation Service of Ukraine of the necessary documentation in accordance with the requirements of the Aviation Regulations and the legislation of Ukraine;
- development of curricula and formation of proposals regarding the staff of certified instructors in accordance with legislative acts;
- formation and execution of contracts for scientific, scientific-technical, and experimental work with clients;
- conclusion and monitoring of the execution of thematic contracts with organizations and enterprises in accordance with the legislation of Ukraine;
- provision of consulting services (scientific, technical, etc.) in the manner established at the University.
3.3 ECD staff participate in the following processes of the University’s QMS (Quality Management System):
- ensuring the quality of the educational process, research work, and applied scientific studies;
- ensuring the quality of work in accordance with the requirements of Aviation Regulations, which complement the University’s QMS.
The ECD also performs mandatory QMS processes:
- management of documented information;
- corrective actions;
- preventive actions;
- management of nonconformities.
4. Rights and Responsibilities
4.1 The rights and responsibilities of the ECD are exercised through the rights and responsibilities of its head – the Department Chief.
4.2 The Head of the ECD has the right to:
- submit proposals to the University administration and the University Academic Council regarding the improvement of planning and organization of the ECD’s work;
- submit proposals regarding the staffing schedule of the ECD;
- initiate with the Rector the hiring and dismissal of ECD employees according to procedures agreed upon by the University, employment contract forms, and within the approved staffing schedule;
- submit, in accordance with current regulatory documents, including the University Charter, Internal Regulations, and the Collective Agreement, petitions regarding encouragement of ECD employees or application of disciplinary or public measures, as well as other measures provided by current legislation and the University Internal Regulations;
- require all ECD employees to comply with the University Internal Regulations, job descriptions, employment contract, and this Regulation;
- issue orders regarding the activities of the ECD, which are mandatory for all ECD employees and may be revoked by the University Rector if they contradict the law, the University Charter, or harm the University’s interests, and to monitor compliance with orders, directives of the University administration, and own directives;
- develop job descriptions for ECD employees;
- organize and manage the work and activities of ECD staff;
- receive necessary information from the University’s structural units to perform the functions assigned to the ECD;
- organize meetings on ECD-related matters;
- initiate with the Rector the conclusion of contracts and agreements with counterparties in accordance with procedures approved by the University;
- represent the ECD in interactions with enterprises, institutions, and organizations, including in activities of international organizations, based on the Rector’s order and assignment.
The procedure for interaction of the ECD with enterprises, organizations, and institutions is determined and controlled by the Rector of the University.
4.3 The Head of the Department has the following responsibilities:
- to ensure proper fulfillment of the main tasks and functions of the ECD in accordance with this Regulation, the tasks assigned by the University administration, obligations to the State, state and other bodies, institutions, enterprises, as well as contractual obligations;
- to report annually on the results of the Department’s work in the established manner;
- at the request of the Rector, Chief Accountant, or heads of relevant University departments (services), to provide the necessary data and documents regarding the activities of the ECD for conducting an internal audit of the unit;
- to create the necessary conditions for improving the professional and qualification level of employees;
- to specify the functional duties of ECD employees;
- to fulfill the functions, tasks, and obligations stipulated by the University’s Collective Agreement;
- to create safe and harmless working conditions, and personally take measures to eliminate any situation that poses a threat to the life or health of people or to the environment;
- to provide the Human Resources Department, the Planning and Finance Department, the Accounting Office, and other University units with information on the status of budget-funded and contract-based research and development work, as well as other information required for preparing reports submitted by the University to higher-level organizations.
4.3 The Head of the Department has the following responsibilities:
- ensure the proper fulfillment of the main tasks and functions of the ECD in accordance with this Regulation, assignments from the University administration, obligations to the State, state and other bodies, institutions, enterprises, as well as contractual obligations;
- report annually on the results of work in the established manner;
- at the request of the Rector, Chief Accountant, or heads of relevant departments (services) of the University, provide necessary information and documents on the activities of the ECD for conducting an internal audit of the unit;
- create the necessary conditions for improving the professional and qualification level of employees;
- specify the functional responsibilities of ECD employees;
- fulfill functions, tasks, and obligations provided for in the University Collective Agreement;
- establish safe and non-hazardous working conditions, personally take measures to eliminate any situation that poses a threat to life or health of individuals or the environment;
- provide the Human Resources Department, Planning and Finance Department, Accounting Office, and other University units with information regarding the status of budget-funded and contract-based research work, as well as other information required for preparing University reports submitted to higher-level organizations.
5. Management
5.1 The ECD is headed by a Department Chief who is appointed and dismissed by the Rector of the University.
5.2 A person appointed to the position of Department Chief must have a higher education of the master’s degree (or specialist qualification level) in an aviation-related field and at least two years of professional experience. The Department Chief may delegate part of their authority to a deputy or other ECD employees. The Department Chief may be dismissed on the grounds provided for by labor legislation, as well as for violating the University Charter or the requirements of the job description. The decision on dismissal of the Department Chief is made by the Rector.
5.3 The Department Chief performs the following functions:
- together with the collegial management body or the body of public self-governance, within the limits of the current legislation of Ukraine, this Regulation, and assigned duties, resolves issues related to the ECD’s activities;
- within their authority, issues orders mandatory for execution by all ECD employees;
- by assignment of the University Rector, represents the ECD in state and other bodies and is responsible for the results of the ECD’s activity;
- initiates the application of moral and material incentives, disciplinary and material liability in accordance with the legislation of Ukraine, the University Charter, and the University Collective Agreement;
- monitors the development, implementation, functioning, and improvement of certain quality management system processes relevant to the ECD’s activities.
5.4 The body of public self-governance of the ECD is the meeting of the labor collective. The procedure for convening, the powers, and other matters regarding the activity of the labor collective meetings of the ECD are determined in accordance with the University Charter and the Regulation on the Conference of the University Labor Collective.
6. Responsibility
6.1 The responsibility of the ECD is exercised through the responsibility of its employees and the Department Chief. In this regard, the responsibility of each employee is individual, depending on the duties assigned to them, and is defined in the job description and the University Internal Regulations.
7. Interaction with Other Structural Units
7.1 To fulfil its functions and tasks, the Educational and Certification Department (ECD)may, in the established manner, receive or provide information within its area of competence, participate in initiating joint activities, and interact within its competence with other structural units of the University, companies, higher education institutions, international organizations, and state institutions, in accordance with assignments, organizational and administrative documents, regulatory documents of the Rectorate, the University Statute, and the applicable legislation of Ukraine.
7.2 For training in accordance with PART-147 requirements, trainees submit an application to the ECD, conclude a contract with the University represented by the Rector, and, after payment of the invoice, commence training. According to the training program, theoretical and practical classes are conducted by certified instructors in the University's classrooms, while practical training in aircraft maintenance is undertaken by trainees at PART-145 organizations on a contractual basis. The class and room schedule is developed by the University Dispatching Service jointly with the ECD. The training program, workload, examinations, etc., are defined in the PART-147 and PART-66 Organisation Exposition, which is approved and validated by the State Aviation Administration of Ukraine or authorized EASA units.
8. Final Provisions
8.1 The Regulation on the ECD is approved by the Academic Council of the University and enacted by order of the Rector of the University.
8.2 Amendments and/or additions to this Regulation shall be introduced in accordance with the procedure established for its adoption, reviewed and approved by the Academic Council of the University, and enacted by order of the Rector of the University.
8.3 The Regulation on the ECD is signed by the Head of the Department and approved by the Vice-Rector for Research, the Head of the Human Resources Department, the Chief Accountant, and the Head of the Legal Department of the University.
