1. General Provisions

1.1. These Regulations determine the legal and organizational foundations for the establishment and operation of the Commission for the Recognition of Learning Outcomes Achieved in the Temporarily Occupied Territory of Ukraine (hereinafter referred to as the Commission) at National Aerospace University «Kharkiv Aviation Institute» (hereinafter referred to as the University), its composition, powers, procedure for organizing work and documenting its activities.

1.2. The Commission is a collegial working body of the University, established in accordance with the Procedure for the Recognition of Learning Outcomes Achieved in the Temporarily Occupied Territory of Ukraine at the levels of vocational (vocational-technical), professional pre-higher, and higher education, approved by Resolution of the Cabinet of Ministers of Ukraine dated July 15, 2025, No. 871 (hereinafter referred to as the Procedure), as well as Orders of the Ministry of Education and Science of Ukraine dated October 23, 2025, No. 1390 «On approval of document forms for the recognition of learning outcomes at higher education levels, achieved in the temporarily occupied territory of Ukraine» and dated November 27, 2025, No. 1559 «On approval of the list of authorized higher education institutions capable of carrying out the procedure for recognition of learning outcomes achieved in the temporarily occupied territory of Ukraine in 2026», with the aim of organizing and conducting the procedure for recognition of learning outcomes within the scope of authority of the University.

1.3. The Commission carries out the procedure for the recognition of learning outcomes in accordance with the requirements of a specific educational (educational-professional) higher education program of the University.

1.4. In its activities, the Commission is guided by the Constitution of Ukraine, the Laws of Ukraine «On Education», «On Higher Education», other regulatory legal acts of Ukraine, the Procedure, the University Statute, and these Regulations.

1.5. The Commission operates on the principles of legality, objectivity, impartiality, equal rights of applicants, compliance with the requirements of legislation on personal data protection, confidentiality of information, and academic integrity.

1.6. The Commission exercises its powers within the scope of competence defined by the legislation of Ukraine, the Procedure, and these Regulations.

1.7. The terms used in these Regulations are applied in the meanings defined by the legislation of Ukraine and the Procedure.

2. Establishment and Composition of the Commission

2.1. The Commission is established by order of the Rector of the University for the relevant educational (educational-professional) higher education program in accordance with the requirements of the Procedure.

2.2. The personal composition of the Commission is approved by order of the Rector of the University.

2.3. The Commission consists of the Head of the Commission, the Secretary, and members of the Commission. The Commission includes at least three academic and/or teaching staff members of the University who meet the requirements of the Procedure.

2.4. The Rector or Vice-Rector of the University is appointed as the Head of the Commission in accordance with the requirements of the Procedure.

2.5. The Commission includes employees of the University who have experience in evaluating identical or similar learning outcomes.

2.6. Representatives of employers, enterprises, institutions, and organizations, staff from other educational institutions, as well as experts in the relevant field may be involved in the work of the Commission in cases and according to the procedure defined by the Procedure.

2.7. The numerical and personal composition of the Commission is determined taking into account the requirements of the Procedure and ensures the possibility of an objective and impartial recognition procedure of learning outcomes.

2.8. In case of need to amend the personal composition of the Commission, the Rector of the University issues a corresponding order.

2.9. Powers of a member of the Commission are terminated on the basis of an order of the Rector of the University, in particular in the event of termination of employment relations with the University or the occurrence of other circumstances making their participation in the work of the Commission impossible.

3. Powers of the Commission

3.1. The Commission, within the powers established by the legislation of Ukraine, the Procedure, and these Regulations, ensures the organization and execution of the procedure for recognition of learning outcomes achieved in the temporarily occupied territory of Ukraine.

3.2. The powers of the Commission include:

- review of applications and documents submitted by applicants in accordance with the Procedure;

- verification of the completeness of submitted documents and their compliance with the requirements of the Procedure;

- organization and execution of the recognition procedure of learning outcomes in cases and order defined by the Procedure;

- determination of the necessity for conducting an assessment of learning outcomes in cases provided for by the Procedure;

- making decisions based on the results of reviewing documents and carrying out the procedure for recognition of learning outcomes in accordance with the Procedure;

- registration of evaluation results and activities of the Commission according to the forms provided in Appendices 1-4 to these Regulations, which correspond to the forms approved by the Ministry of Education and Science of Ukraine, and in accordance with the requirements of the Procedure;

- transfer of materials and adopted decisions to the Admissions Committee of the University or another structural unit designated by legislation or by order of the Rector for further processing of the procedure results.

3.3. In order to exercise its assigned powers, the Commission has the right to:

- obtain information and documents necessary for reviewing materials from structural units of the University;

- involve staff members from structural units of the University, as well as other specialists, in the review of materials in cases provided for by the Procedure;

- receive consultations and clarifications on matters required for the recognition procedure from structural units of the University;

- apply in accordance with the procedure established by law to state bodies and local self-government bodies to obtain information and documents necessary for conducting the recognition procedure, if obtaining such information is provided for by the legislation of Ukraine and falls within the powers of the relevant body;

- submit proposals to the Rector of the University regarding the improvement of the Commission's organization and activities;

- exercise other powers provided for by the legislation of Ukraine, the Procedure, and these Regulations.

3.4. The Commission shall:

- act strictly within the scope of powers defined by the legislation of Ukraine, the Procedure, and these Regulations;

- ensure objective, impartial, and timely consideration of applicants' documents;

- ensure equal rights for applicants during the learning outcomes recognition procedure;

- ensure compliance with the requirements of the legislation of Ukraine on personal data protection and restricted access information;

- ensure proper documentation of the results of its activities;

- ensure the preservation of the Commission's documents in accordance with the requirements of the legislation of Ukraine, record-keeping rules, and the University's index of files;

- fulfill other duties provided for by the legislation of Ukraine, the Procedure, and these Regulations.

4. Procedure for Conducting the Recognition of Learning Outcomes

4.1. The procedure for recognition of learning outcomes achieved in the temporarily occupied territory of Ukraine (hereinafter referred to as the recognition procedure) is carried out by the Commission in accordance with the legislation of Ukraine, the Procedure, and these Regulations.

4.2. The recognition procedure is carried out upon application of a person seeking recognition of learning outcomes achieved in the temporarily occupied territory of Ukraine (hereinafter referred to as the applicant).

4.3. The recognition procedure of learning outcomes begins upon an application submitted by the applicant to the Admissions Committee of the University in paper or electronic form. Together with the application, an educational declaration prepared according to the form in Appendix 1 to these Regulations, as well as documents and information specified by the Procedure, shall be submitted.

4.4. Documents submitted by the applicant are accepted and registered in accordance with the established procedure at the University. Within 10 working days from the date of registration of the application, the Commission reviews the application, educational declaration, documents, materials, and information submitted by the applicant in accordance with paragraph 11 of the Procedure. The Secretary of the Commission ensures the preparation of materials for consideration by the Commission.

4.5. In cases specified by paragraph 11 of the Procedure, documents submitted by the applicant are returned without consideration within 5 working days from the date of registration of the application, of which the applicant is notified indicating the grounds for such decision.

4.6. The educational declaration submitted by the applicant is the main document containing information on the learning outcomes achieved by the applicant in the temporarily occupied territory of Ukraine and is used by the Commission during the recognition procedure.

4.7. The Commission carries out a preliminary review of the submitted documents and determines the possibility of conducting the recognition procedure in accordance with the requirements of the Procedure.

4.8. During the preliminary review, the Commission verifies:

- compliance of the submitted documents with the requirements of the Procedure;

- completeness of the information specified in the educational declaration;

- compliance of the declared learning outcomes with the relevant educational (educational-professional) program of the University;

- possibility of conducting the recognition procedure taking into account the requirements of the legislation of Ukraine and the Procedure;

- other circumstances, verification of which is directly provided for by the Procedure or the legislation of Ukraine.

4.9. Based on the results of the preliminary review of documents, the Commission decides to continue the recognition procedure or on the impossibility of conducting it in cases provided for by the legislation of Ukraine and the Procedure.

4.10. In case of a decision to continue the recognition procedure, the Commission holds an introductory interview with the applicant no later than 5 working days from the day the applicant receives the invitation in accordance with paragraph 13 of the Procedure. Such interview may be conducted within other timeframes upon a corresponding request from the applicant.

4.11. The introductory interview is conducted to clarify and verify the information specified by the applicant in the educational declaration, determine the content and scope of declared learning outcomes, and establish the possibility of their further assessment within the limits set by the Procedure.

4.12. Based on the results of the introductory interview, the Commission draws up minutes according to the form provided in Appendix 2 to these Regulations.

4.13. No later than within 15 working days from the date of the introductory interview, the University notifies the applicant in writing of the decision adopted in accordance with paragraph 13 of the Procedure regarding admission to the assessment of learning outcomes, specifying the schedule, venue, forms of assessment, and its scope, or of refusal to conduct the assessment. The notification also specifies the volume of additional study of the Ukrainian language, history of Ukraine, fundamentals of state and law for the applicant, and information on the possibility of participating in adaptation sessions for psychological support. The applicant's admission to the assessment procedure is issued by an order of the Rector of the University.

4.14. In case of a decision to conduct the assessment, the Commission determines the learning outcomes subject to assessment in accordance with the educational (educational-professional) program under which the recognition procedure is being carried out.

4.15. The assessment of learning outcomes is conducted by members of the Commission who possess relevant professional competence and experience in evaluating identical or similar learning outcomes.

4.16. The assessment of learning outcomes is conducted in the forms and through procedures defined by the Procedure, the relevant educational (educational-professional) program, and the decision of the Commission. The schedule of assessment events is agreed upon by the University with the applicant within the time limits of the recognition procedure in accordance with paragraph 14 of the Procedure. Within a single control event, recognition of an academic load up to 20 ECTS credits is permitted. The break between control events must be at least 3 calendar days. At least three members of the Commission participate in conducting control events in accordance with paragraph 15 of the Procedure. An interview for the recognition of learning outcomes not provided for by the higher education standard and not being mandatory educational components of the relevant educational program is conducted with the participation of at least two members of the Commission in accordance with paragraph 16 of the Procedure. A positive evaluation of such an interview serves as the basis for crediting the applicant with the discipline(s) marked as "passed" and credits in the amount of actually acquired learning outcomes, but not exceeding the volume of the elective part of the curriculum of the relevant educational program for the corresponding study period.

4.17. Based on the results of the assessment, the Commission establishes the compliance of the declared learning outcomes with the learning outcomes provided for by the relevant educational (educational-professional) program of the University.

4.18. Assessment results are documented in minutes according to the form provided in Appendix 3 to these Regulations.

4.19. Based on the results of the recognition procedure, the Commission decides to recognize the relevant learning outcomes or not to recognize them, in cases and within the limits provided for by the Procedure. Learning outcomes at the higher education level may be recognized in an amount not exceeding 75 percent of the total volume of the relevant educational program. The volume of recognized learning outcomes cannot exceed 60 European Credit Transfer and Accumulation System credits for each academic year in accordance with paragraph 17 of the Procedure.

4.20. The decision of the Commission on recognition or non-recognition of learning outcomes is documented in minutes according to the form provided in Appendix 4 to these Regulations, corresponding to the form approved by the Ministry of Education and Science of Ukraine, signed by all members of the Commission, and entered into the educational declaration in accordance with paragraphs 17 and 18 of the Procedure.

4.21. In case of a decision to recognize learning outcomes, the minutes of the Commission specify the recognized learning outcomes, their scope, and the corresponding educational components.

4.22. The decision of the Commission is made collegially in accordance with the requirements of the Procedure and these Regulations and is properly documented.

4.23. If inaccuracy of documents, data, or information submitted by the applicant is established during the recognition procedure, the Commission acts in accordance with the requirements of the Procedure and the legislation of Ukraine.

4.24. In case of detecting circumstances that, according to the legislation of Ukraine or the Procedure, make it impossible to conduct the recognition procedure, the Commission acts in accordance with the requirements of the Procedure.

4.25. The results of the recognition procedure are documented and transferred for further processing in accordance with the requirements of the Procedure and internal regulatory documents of the University. Based on the Commission's decision, the Rector of the University issues an order on the recognition of the applicant's learning outcomes in accordance with paragraph 19 of the Procedure.

4.26. Within 3 working days after the recognition of learning outcomes and the issuance of the corresponding order, the University notifies the applicant in writing of the results of the recognition procedure, using the communication channels specified by them, in accordance with paragraph 19 of the Procedure. The University ensures the preservation of documents formed during the recognition procedure in accordance with the legislation of Ukraine, record-keeping rules, and the University's index of files.

4.27. The applicant has the right to receive information about the results of the recognition procedure and the decisions of the Commission in accordance with the procedure established by the legislation of Ukraine and these Regulations.

4.28. In case of changes to the time limits established by the Procedure, the time limits determined by the current edition of the Procedure apply. Time limits defined by these Regulations in accordance with the Procedure apply to the extent that they do not contradict the legislation of Ukraine.

5. Organization of the Commission's Work

5.1. The organization of the Commission's work is carried out in accordance with the legislation of Ukraine, the Procedure, these Regulations, and orders of the Rector of the University.

5.2. The main form of the Commission's work is meetings held as necessary to ensure timely consideration of applicants' documents, execution of the learning outcomes recognition procedure, and adoption of relevant decisions.

5.3. Meetings of the Commission are convened by the Head of the Commission. The Head of the Commission determines the date, time, place, form, and order of the meeting and instructs the Secretary of the Commission to ensure timely notification of its members.

5.4. The Head of the Commission:

- organizes the work of the Commission and ensures the execution of its assigned powers;

- convenes and conducts meetings of the Commission;

- coordinates the activities of the Commission members;

- ensures compliance with the requirements of the legislation of Ukraine, the Procedure, and these Regulations during the exercise of the Commission's powers;

- ensures objectivity and impartiality in the review of applicants' documents;

- signs meeting minutes, decisions of the Commission, and other documents within the competence of the Commission;

- represents the Commission in interaction with structural units of the University on matters related to the execution of its powers.

5.5. The Secretary of the Commission:

- provides organizational support for the activities of the Commission;

- receives and synthesizes materials submitted for consideration by the Commission;

- ensures the preparation of materials for Commission meetings;

- notifies members of the Commission of the date, time, and place of meetings;

- keeps minutes of Commission meetings;

- ensures the execution, registration, and tracking of Commission documents;

- compiles case files based on the results of reviewing the applicant's documents;

- ensures the transfer of documents to the Admissions Committee or another structural unit of the University in accordance with the requirements of the legislation of Ukraine and record-keeping rules;

- ensures the transfer of documents for archival storage in accordance with the University's index of files;

- performs other functions related to the organizational support of the Commission's activities.

5.6. Members of the Commission:

- participate in the work of the Commission and its meetings;

- review documents and materials submitted by applicants;

- carry out the assessment of learning outcomes in cases provided for by the Procedure;

- participate in the discussion of materials and the adoption of Commission decisions;

- submit proposals on resolving issues falling within the competence of the Commission;

- ensure objectivity, impartiality, and compliance with the legislation of Ukraine during the execution of their assigned powers.

5.7. Based on the results of reviewing documents and conducting the assessment of learning outcomes, the Commission adopts a corresponding decision according to Section 4 of these Regulations.

5.8. Meeting minutes, decisions of the Commission, and other documents created during its activity are executed, registered, tracked, and stored in accordance with the legislation of Ukraine, the Procedure, record-keeping rules, and the University's index of files.

5.9. Organizational and technical support for the activities of the Commission is provided by the Admissions Committee of the University, unless otherwise specified by the legislation of Ukraine or by order of the Rector of the University.

6. Final Provisions

6.1. These Regulations are approved by the Academic Council of the University and enacted by order of the Rector of the University.

6.2. Control over compliance with the requirements of these Regulations is exercised by the Rector of the University, the Vice-Rector in accordance with the allocation of functional duties, as well as heads of structural units within the scope of powers granted to them.

6.3. Amendments and additions to these Regulations are introduced in accordance with the legislation of Ukraine, approved by the Academic Council of the University, and enacted by order of the Rector of the University.

6.4. The University carries out the procedure for recognition of learning outcomes subject to its inclusion in the list of authorized higher education institutions determined by the Ministry of Education and Science of Ukraine for the relevant year.

6.5. Issues not regulated by these Regulations shall be resolved in accordance with the Constitution of Ukraine, laws of Ukraine, other regulatory legal acts of Ukraine, the Procedure, the Statute of the University, and other local regulations of the University.

6.6. Invalidity of individual provisions of these Regulations or amendments to the legislation of Ukraine shall not serve as grounds for terminating the operation of its remaining provisions, provided they do not contradict the legislation of Ukraine.

6.7. Appendices 1–4 to these Regulations are an integral part thereof. The document forms provided in the appendices are applied by the Commission in accordance with these Regulations.
