1. General Provisions
1.1. The Regulations on the Attestation of Pedagogical Staff (hereinafter ‒ the Regulations) have been developed in accordance with the Laws of Ukraine «On Education», «On Higher Education», the Resolution of the Cabinet of Ministers of Ukraine No. 800 dated September 21, 2019 «Some Issues of Advanced Training of Pedagogical and Academic Staff», the Order of the Ministry of Education and Science of Ukraine No. 805 dated September 9, 2022 «On Approval of the Regulations on the Attestation of Pedagogical Staff», and other regulatory legal acts in the field of education, and determine the procedure for conducting the attestation of pedagogical staff of National Aerospace University «Kharkiv Aviation Institute» (hereinafter ‒ the University) as a system of measures aimed at a comprehensive and integrated evaluation of their pedagogical activity (hereinafter ‒ the Attestation).
1.2. In these Regulations, terms are used in the meanings defined by the Civil Code of Ukraine, the Laws of Ukraine «On Education», «On Pre-school Education», «On Full General Secondary Education», «On Out-of-school Education», «On Vocational (Vocational-Technical) Education», «On Professional Pre-higher Education», «On Higher Education», the Procedure for Advanced Training of Pedagogical and Academic Staff approved by the Resolution of the Cabinet of Ministers of Ukraine No. 800 dated August 21, 2019, and other regulatory legal acts in the field of education.
1.3. Based on the results of the Attestation of a pedagogical employee, their compliance or non-compliance with the held position is established, and a qualification category is assigned (not assigned) or a previously assigned qualification category is confirmed (not confirmed).
1.4. Attestation is an integral part of the University's external education quality assurance system.
1.5. The purpose of the Attestation is to stimulate a purposeful and continuous increase in the level of professional competence of the University's pedagogical staff, the growth of their professional skills, the development of creative initiative, the enhancement of prestige and authority, and ensuring the efficiency of the educational process.
1.6. These Regulations apply to pedagogical employees of the University who carry out pedagogical activity and whose positions are classified as pedagogical according to the List of Positions of Pedagogical and Academic Staff approved by the Resolution of the Cabinet of Ministers of Ukraine No. 963 dated June 14, 2000. These Regulations do not apply to pedagogical employees who undergo attestation in accordance with the requirements of the Law of Ukraine «On Professional Development of Employees».
1.7. Based on the results of the Attestation of a University pedagogical employee, regardless of the volume of their teaching load (the number of educational subjects (integrated courses, disciplines)), their compliance or non-compliance with the held position is established, and:
1) a qualification category is assigned (not assigned) or a previously assigned qualification category is confirmed (not confirmed);
2) a pedagogical title is assigned (not assigned), or a previously assigned pedagogical title is confirmed (not confirmed) (if any).
For pedagogical employees whose positions do not provide for the assignment of qualification categories, the results of the Attestation determine their compliance (non-compliance) with the held position, and a tariff rate is established (confirmed) in the manner prescribed by legislation.
The qualification category and pedagogical title assigned (confirmed) based on the results of the Attestation are determined in accordance with the List of Qualification Categories and Pedagogical Titles of Pedagogical Staff approved by the Resolution of the Cabinet of Ministers of Ukraine No. 1109 dated December 23, 2015.
1.8. Attestation of the University's pedagogical staff is mandatory.
Attestation can be regular or extraordinary. A pedagogical employee undergoes regular Attestation at least once every five years, except for cases specified in Clause 3.7 of these Regulations. Attestation is conducted no earlier than one year after the appointment of the pedagogical employee to the position. Attestation must be conducted in compliance with academic integrity.
1.9. Extraordinary Attestation may be conducted at the initiative of the Rector regarding:
- a pedagogical employee of the University in case of a decline in the quality of their pedagogical activity;
- the head of a separate structural unit of the University: the Separate Structural Unit «Kharkiv Professional College of Information Technologies of National Aerospace University named after M. E. Zhukovsky «Kharkiv Aviation Institute» (hereinafter ‒ the Professional College) in case a low quality of educational activity of the Professional College is revealed based on the results of an institutional audit conducted in accordance with legislation.
An extraordinary Attestation of a pedagogical employee whose educational level and length of service in positions of pedagogical staff meet the requirements specified in Clauses 8 and 9 of Section I of the «Regulations on the Attestation of Pedagogical Staff» approved by the Order of the Ministry of Education and Science of Ukraine No. 805 dated September 2022, may be conducted at their own initiative and/or under one of the following conditions:
1) recognition as a winner or laureate of the final stages of all-Ukrainian or international professional contests;
2) possession of an educational-scientific / educational-creative or scientific degree;
3) successful passing of certification.
1.10. The inter-attestation period (the time interval between the passing of the previous and the next Attestation by a pedagogical employee) cannot be less than three years, except for cases of extraordinary Attestation conducted at the initiative of the pedagogical employee. The time spent by a pedagogical employee on social leave, studying at higher education institutions, as well as the period for which the Attestation is postponed, are not included in the inter-attestation period.
1.11. Advanced training of pedagogical employees is conducted during the inter-attestation period in accordance with legislation and is a prerequisite for Attestation. The total volume (total duration) of advanced training is determined cumulatively for the last 5 years before the Attestation, regardless of the advanced training provider, type, form, or field in which the pedagogical employee underwent advanced training. The total volume (total duration) of advanced training required for pedagogical employees to pass the attestation is 180 hours or 6 ECTS credits over five years.
1.12. The qualification category «specialist» is assigned to a pedagogical employee who has an educational level of professional junior bachelor (educational-qualification level of junior specialist), junior bachelor, bachelor, or master (educational-qualification level of specialist).
The qualification category «second-category specialist» is assigned to a pedagogical employee who has an educational level of junior bachelor (educational-qualification level of junior specialist), bachelor, or master (educational-qualification level of specialist), and a length of service in positions of pedagogical staff of at least three years.
The qualification category «first-category specialist» is assigned to a pedagogical employee who has an educational level of bachelor or master (educational-qualification level of specialist), and a length of service in positions of pedagogical staff of at least five years.
The qualification category «higher-category specialist» is assigned to a pedagogical employee who has an educational level of master (educational-qualification level of specialist), and a length of service in positions of pedagogical staff of at least seven years.
Based on the results of the Attestation, a qualification category of «higher-category specialist» may be assigned to a pedagogical employee who holds an educational-scientific / educational-creative or scientific degree, without complying with the sequence of assignment, provided that they have at least one year of work experience in positions of pedagogical staff.
Persons who do not have a pedagogical education but have work experience in one of the sectors of the economy (except for the educational sector) and work in positions of pedagogical staff shall be attested as pedagogical staff without complying with the sequence of qualification category assignment as follows:
- «second-category specialist» ‒ provided they have at least two years of work experience;
- «first-category specialist» ‒ at least five years;
- «higher-category specialist» ‒ at least seven years.
1.13. Based on the results of the Attestation, pedagogical titles are assigned (confirmed) to pedagogical employees who hold the qualification category of «first-category specialist» / «higher-category specialist» and who, in particular:
- implement and disseminate methods of competency-based learning and new educational technologies, provide professional support and assistance to pedagogical staff;
- participate in procedures and activities related to ensuring the quality of education and the introduction of innovations, pedagogical novelties, and technologies into the educational system;
- were recognized as winners or laureates of all-Ukrainian or international professional contests;
- prepared winners of all-Ukrainian or international olympiads, contests, competitions, etc.
1.14. Qualification categories and pedagogical titles are, as a rule, assigned sequentially.
The possession of an educational (educational-qualification) level by a pedagogical employee is confirmed by the corresponding document on education. The possession of an educational-scientific / educational-creative or scientific degree is confirmed by the corresponding diploma.
The length of service in positions of pedagogical staff is determined according to the data of their personal file, employment record book, or information on labor activity from the register of insured persons of the State Register of Compulsory State Social Insurance, and other documents that, in accordance with legislation, confirm the length of service in positions of pedagogical staff defined by the List of Positions of Pedagogical and Academic Staff approved by the Resolution of the Cabinet of Ministers of Ukraine No. 963 dated June 14, 2000.
1.15. The job duties of a pedagogical employee are determined by their job description.
1.16. Pedagogical employees who have a teaching load in several subjects are attested in the subject they teach according to their specialty. In this case, the assigned qualification category applies to the entire teaching load. A prerequisite for this is advanced training in the educational subjects (integrated courses) that are mandatory for study in accordance with the annual curriculum of the University.
Pedagogical employees working part-time or under the terms of a fixed-term labor agreement are attested on general grounds.
Pedagogical employees who hold different pedagogical positions at the University, or at the University and other educational institutions, are attested for each of the positions.
Pedagogical employees who work at the University and in other educational institutions in the same position and/or teach one subject (integrated course) are attested at their main place of work. In this case, the qualification category and pedagogical title or tariff rate assigned to the pedagogical employee apply to the entire teaching load across all places of work and/or positions.
If, during the inter-attestation period, a pedagogical employee is given an additional teaching load with hours from other subjects (integrated courses), the assigned qualification category applies to the entire teaching load until the next regular Attestation.
The Director of the Professional College and their deputies, who work in the position of a pedagogical employee that involves carrying out pedagogical activity and having a teaching load, shall be attested for this position in the manner prescribed by these Regulations.
For the Director of the Professional College, their deputies, and other pedagogical employees whose positions do not provide for the assignment of qualification categories, the results of the attestation establish their compliance or non-compliance with the held position, and a tariff rate is established (confirmed).
1.17. Successful passing of certification is credited as the passing
of the Attestation by a pedagogical employee and is also a ground for assigning them the corresponding qualification category and/or pedagogical title.
The assignment/confirmation of a qualification category and/or a pedagogical title is carried out without taking into account the duration of the inter-attestation period, without observing the conditions defined in Clauses 8 and 9 of Section I of the «Regulations on the Attestation of Pedagogical Staff» approved by the Order of the Ministry of Education and Science of Ukraine No. 805 dated September 2022, and without conducting any measures related to the study and evaluation of their performance and professional competencies.
The crediting of certification is carried out once during the term of validity of the pedagogical employee's certificate during their regular or extraordinary Attestation, which is conducted at the initiative of the pedagogical employee.
1.18. Until the next regular Attestation of a pedagogical employee is conducted, their assigned qualification category (pedagogical title) shall be retained.
1.19. Pedagogical employees who transfer to work from another educational institution to the University, as well as to other pedagogical positions at the University, or who have interrupted their work in a pedagogical position (regardless of the duration of the break in work), retain the qualification categories and pedagogical titles assigned based on the results of their last Attestation. The attestation of such employees is carried out no later than two years after they are hired.
1.20. Persons appointed to positions of pedagogical staff in accordance with Part 5 of Article 58 of the Law of Ukraine «On Education» and/or those who have completed a pedagogical internship in the manner prescribed by legislation, shall be attested during their second year of work to continue working in these positions, but no earlier than one year after their appointment to the position.
1.21. If the time limits defined by these Regulations fall on a weekend, non-working day, or holiday, the corresponding period begins on the first working day following it. In the event of circumstances that objectively make the activity of the attestation commission or the pedagogical staff being attested impossible and prevent the conduct of the attestation, the course of the timeframes for conducting the attestation established by these Regulations is suspended for the duration of such circumstances and resumes after the termination of the circumstances that became an obstacle to conducting the attestation.
1.22. It is not permitted to create obstacles for a pedagogical employee to undergo Attestation, or to unreasonably refuse to assign (confirm) a qualification category or pedagogical title, or to establish a tariff rate.
2. Establishment, Composition, and Powers of Attestation Commissions
2.1. For the Attestation of pedagogical staff at the University, attestation commissions of levels I and II are established annually no later than September 20. A level I attestation commission is established at the Professional College.
2.2. The mentioned attestation commissions are established by order of the Rector of the University, which determines the personal composition of the attestation commission and appoints the chairperson and the secretary of the attestation commission. The number of members of the attestation commission cannot be less than five persons. Representatives of primary trade union organizations are involved in the work of the attestation commission (up to 2 persons upon consent) with the right to vote. Representatives of trade union organizations are involved in the work by the chairperson of the attestation commission in accordance with the decision of the trade union committee of the primary trade union organization. A person who, in accordance with the Law of Ukraine «On Prevention of Corruption», is a close person to the pedagogical employee being attested, or is a person who may have a conflict of interest, cannot be involved in the work of the attestation commission.
2.3. The chairperson of the level I attestation commission is the Vice-Rector for Academic Affairs of the University. The chairperson of the level II attestation commission is the Rector of the University.
In the absence of the chairperson of the attestation commission, the attestation commission shall elect another member of the attestation commission, except for its secretary, to act as the presiding chair.
The Rector and his deputies cannot preside over a meeting of the attestation commission if they undergo attestation themselves in accordance with these Regulations. In such a case, at the meeting of the attestation commission, the members of the attestation commission shall elect a person to perform the duties of the chairperson of the attestation commission, whose powers shall extend to the work of the attestation commission until the completion of the Attestation of the Rector (vice-rector) of the University.
2.4. An attestation commission is competent provided that at least two-thirds of its composition is present at its meeting. Decisions of the attestation commission are made by voting by a simple majority of votes. In the event of an equal distribution of votes «for» and «against», the attestation commission makes a decision in the interests of the pedagogical employee being attested.
Persons who are members of the attestation commission do not participate in voting regarding themselves if they undergo Attestation.
The voting procedure (open or secret) is determined at the meeting of the attestation commission and is recorded in the minutes.
2.5. The chairperson of the attestation commission conducts meetings of the attestation commission, participates in voting when decisions of the attestation commission are made, and signs minutes of meetings of the attestation commission and attestation sheets.
In the presence of circumstances that objectively make it impossible to conduct a meeting of the commission in person (martial law, emergency situation, quarantine restrictions, etc.), the chairperson of the attestation commission may make a decision to conduct the meeting in the mode of videoconferencing.
2.6. The secretary of the attestation commission:
- receives, registers, and stores documents submitted by pedagogical staff (prior to consideration and during consideration by the attestation commission);
- organizes the work of the attestation commission, maintains and signs the minutes of meetings of the attestation commission;
- formalizes and signs attestation sheets;
- notifies pedagogical staff of the place and time of the meeting of the attestation commission (in case pedagogical staff are invited to the meeting);
- ensures the publication of information about the activities of the attestation commission by placing it on the official website of the University, Professional College.
2.7. The level I attestation commission reviews documents submitted by pedagogical staff of the University / Professional College, establishes their compliance with the requirements of legislation, and takes measures to verify their authenticity (if necessary).
The level I attestation commission of the University / Professional College makes a decision on:
- compliance (non-compliance) of pedagogical staff of the University / Professional College with the held positions;
- assignment (confirmation) of qualification categories and pedagogical titles or on the refusal of such assignment (confirmation).
2.8. The level II attestation commission reviews appeals against decisions of level I attestation commissions.
The level II attestation commission makes a decision on:
- assignment (confirmation) of qualification categories and pedagogical titles or on the refusal of such assignment (confirmation);
- compliance (non-compliance) of heads of separate structural units with the held positions;
- assignment (confirmation) of qualification categories and pedagogical titles or on the refusal of such assignment (confirmation) to heads of separate structural units who teach educational subjects (integrated courses).
2.9. In case of refusal to assign (confirm an existing) qualification category of «first-category specialist» or «higher-category specialist» and assigning (confirming) a corresponding lower qualification category, the attestation commission shall make a decision to refuse the assignment and/or confirmation of a previously assigned pedagogical title.
3. Procedure for Conducting the Attestation
3.1. To conduct a regular Attestation, attestation commissions must, by October 10 of the current year:
- compile and approve the list of pedagogical staff subject to regular Attestation in the next calendar year, the terms for conducting their Attestation, and the schedule of meetings of the attestation commission;
- determine the timeframe and email address for submission of documents by pedagogical staff (in case of submission in electronic form).
In case a pedagogical employee subject to regular Attestation is missing from the list, upon their application submitted no later than December 20 of the current calendar year, the attestation commission shall include them in the lists of pedagogical staff subject to regular Attestation.
3.2. To conduct an extraordinary Attestation, an application in the form specified in Appendix 1 to these Regulations shall be submitted to the attestation commission by December 20.
The attestation commission approves a separate list of pedagogical staff subject to extraordinary Attestation, determines the terms for conducting their Attestation, the submission of documents by them, and may make changes to the schedule of its meetings if necessary.
3.3. In the presence of circumstances that make the activity of the attestation commission or the pedagogical staff being attested impossible and prevent the conduct of the Attestation, the course of the timeframes for conducting the Attestation established by these Regulations is suspended and resumes after the elimination of the circumstances that became an obstacle to conducting the Attestation.
3.4. The information specified in Clauses 3.1, 3.2 of these Regulations is published on the website of the University, Professional College no later than five working days from the day the decision is made by the corresponding attestation commission.
Within five working days from the day of publication of the information, the pedagogical employee being attested may submit documents to the attestation commission which, in their opinion, testify to their pedagogical skill and/or professional achievements.
Documents stored in the personal file of the pedagogical employee are not submitted to the attestation commission established at the University or Professional College where the personal file is kept.
3.5. The pedagogical employee being attested may submit documents to the relevant attestation commission in paper or electronic form. The electronic version of the documents (PDF format, each document in a separate file) shall be sent to the email address [email protected], intended for the submission of documents in electronic form by pedagogical staff, with an acknowledgment of receipt.
Documents submitted to the attestation commission shall be registered by the secretary of the attestation commission. It is prohibited to groundlessly refuse to accept documents from a pedagogical employee if they meet the requirements specified in this clause.
3.6. The attestation commission reviews the documents of the pedagogical staff being attested, verifies their authenticity if necessary, establishes compliance with the requirements of Clauses 8 and 9 of Section I of the «Regulations on the Attestation of Pedagogical Staff» approved by Order of the Ministry of Education and Science of Ukraine dated September 09, 2022, No. 805, and also assesses the professional competencies of the pedagogical employee, taking into account their job duties and the requirements of the professional standard (if available).
For the proper assessment of the professional competencies of a pedagogical employee, the attestation commission designates, from among its members, persons who, in accordance with the approved work schedule, will analyze the operational activities and practical work experience of the pedagogical employee being attested. This is done by reviewing educational and methodological developments and materials related to the performance of job duties by the pedagogical employee, their participation in activities associated with the organization of educational, methodological, and organizational work, etc. For this purpose, the head of the department submits a performance evaluation report (characterization) of the pedagogical employee's activities during the inter-attestation period to the attestation commission. The report must contain an assessment of the performance of job duties by the pedagogical employee, information about their professional training, creative and organizational skills, initiative, competence, organizational ability, moral and psychological qualities, information on participation in the development of educational and methodological literature and documents, implementation of recommendations provided by the previous attestation commission, etc. The pedagogical employee shall familiarize themselves with the report under signature no later than ten days before the attestation is conducted.
Decisions on the results of the Attestation of pedagogical staff are made by the attestation commissions:
- Level I - no later than June 30;
- Level II - no later than July 31.
3.7. In the event of temporary disability of the pedagogical employee being attested, or the occurrence of other circumstances beyond their control that prevent them from undergoing attestation, the conduct of the attestation or individual meetings of the attestation commission shall be postponed by decision of the relevant attestation commission until such circumstances cease, but for no more than one year. In such a case, the previously assigned qualification category (pedagogical title) is retained for the pedagogical employee until they undergo attestation in the manner prescribed by these Regulations.
3.8. The attestation commission may invite a pedagogical employee to its meeting if questions arise regarding them, particularly those related to the documents they submitted.
The invitation to the meeting of the attestation commission is signed by the chairperson of the attestation commission and is delivered by the secretary of the attestation commission to the pedagogical employee under signature or sent in a scanned form to their email address (if available, with confirmation of receipt) no later than five working days prior to the day of the meeting. The invitation of a pedagogical employee to a meeting of the Level II attestation commission is also sent to the email address of the University or Professional College in a scanned form (with confirmation of receipt).
3.9. The pedagogical employee may be present at the meeting of the attestation commission during the consideration of matters relating to their Attestation, including via videoconferencing. In case of non-appearance of a pedagogical employee who was invited to the meeting of the attestation commission in accordance with the established procedure, the attestation commission, in the presence of circumstances specified in Clause 3.7 of these Regulations, conducts the meeting in the absence of the pedagogical employee.
Representatives of pedagogical staff may represent their interests at meetings of attestation commissions by a written power of attorney or an agency contract executed in accordance with legal requirements, and the identity of such representative must be established by the secretary of the relevant attestation commission based on an identity document.
3.10. Meetings of the attestation commission are recorded in the minutes in the form specified in Appendix 2 to these Regulations.
3.11. Based on the decision of the attestation commission, the secretary formalizes an attestation sheet in the form according to Appendix 3 to these Regulations, in which the result of the attestation of the pedagogical employee is recorded.
In the case of simultaneous attestation (within a single procedure) of a pedagogical employee in two or more subjects (integrated courses, disciplines) taught by them, a single attestation sheet is issued, which must contain information on the results of the attestation for each of these subjects (integrated courses, disciplines).
The attestation sheet is drawn up in two copies, which are signed by the chairperson (the presiding chair at the meeting) of the attestation commission and the secretary. The first copy of the attestation sheet is issued to the pedagogical employee under signature and/or sent in a scanned form to their email address (with confirmation of receipt) within three working days from the date the relevant decision is made by the attestation commission; the second copy is attached to their personal file.
The pedagogical employee, on their own initiative, may personally receive their copy of the attestation sheet from the secretary of the relevant attestation commission under signature.
Upon application by the pedagogical employee, the original of the attestation sheet may be sent by mail with an acknowledgment of delivery.
3.12. The decision of the Level I attestation commission on the results of the attestation is brought to the attention of the pedagogical employee by issuing them an attestation sheet (sending it to their email address in a scanned form) in the manner and within the timeframes specified in Clause 3.11 of these Regulations.
The decision of the Level II attestation commission on the results of the attestation is brought to the attention of the Rector or the Director of the Professional College at the place of work of the pedagogical employee no later than seven working days from the date of its adoption by submitting (sending) an extract from the minutes of its meeting and the attestation sheet to the email address of the University or Professional College in a scanned form, or in its absence, by mail with an acknowledgment of delivery.
3.13. The second copies of the attestation sheets are stored in accordance with the List of Typical Documents Created During the Activities of State Bodies and Local Self-Government Bodies, Other Institutions, Enterprises, and Organizations, Indication of Document Storage Periods, approved by Order of the Ministry of Justice of Ukraine dated April 12, 2012, No. 578/5, registered with the Ministry of Justice of Ukraine on April 17, 2012, under No. 571/20884.
Attestation sheets and copies of documents on advanced training of the pedagogical employee are stored in the personal file of the pedagogical employee.
3.14. The decision of the attestation commission serves as the basis for the issuance (no later than three working days from the date of receipt of the documents specified in Clause 3.12 of these Regulations) of a corresponding order by the Rector of the University / Director of the Professional College. Pedagogical staff must be familiarized with the order under signature within three working days from the date of its issuance.
The order based on the results of the Attestation must be submitted to the accounting department of the University / Professional College where the pedagogical employee works within three working days from the day of its adoption for payroll calculation and the performance of the corresponding recalculation. Remuneration, taking into account the results of the Attestation, is carried out from the date of issuance of the order based on the results of the Attestation.
4. Appealing the Decisions of Attestation Commissions
4.1. In case a pedagogical employee disagrees with the decisions of Level I or Level II attestation commissions, they have the right to appeal such a decision by filing an appeal with the relevant higher-level attestation commission within seven working days from the date the pedagogical employee received the attestation sheet (personally or at their email address).
4.2. An appeal is submitted by sending an appeal statement drafted in accordance with Appendix 4 to these Regulations.
A copy of the attestation sheet issued by the attestation commission whose decision is being appealed, as well as copies of documents that were submitted by the pedagogical employee to the attestation commission whose decision is being appealed (if they were submitted), shall be attached to the appeal statement.
4.3. The appeal statement with appendices shall be submitted in paper and/or electronic form to the email address specified by the attestation commission (with confirmation of receipt) in a scanned form (PDF format, each document as a separate file). Documents submitted to the attestation commission shall be registered and stored by the secretary of the attestation commission.
4.4. The attestation commission shall review the appeal statement and make a decision within 15 working days from the date of its receipt. During the review of the pedagogical employee's appeal statement, a person who participated in making the decision being appealed cannot participate in the work of the attestation commission.
Based on the results of the appeal review, the attestation commission makes a decision on:
1) compliance of the pedagogical employee with the held position, confirmation of the previously assigned qualification category and/or pedagogical title, and reversal of the decision of the lower-level attestation commission;
2) assignment of the next qualification category and/or pedagogical title to the pedagogical employee and reversal of the decision of the lower-level attestation commission;
3) leaving the decision of the lower-level attestation commission unchanged, and leaving the appeal without satisfaction.
4.5. The decision on the results of the appeal review is documented by the minutes, which are signed by the chairperson and the secretary of the attestation commission. An extract from these minutes, drafted in accordance with Appendix 5 to these Regulations, shall be sent to the pedagogical employee and to the relevant educational institution by email in a scanned form (with confirmation of receipt) within three working days from the date of adoption of the relevant decision, or in the absence of a corresponding email address - by mail with an acknowledgment of delivery.
The Rector of the University / Director of the Professional College shall, within three working days from the date of receipt of the extract from the minutes on the results of the appeal review, based on the results of which the pedagogical employee was assigned (confirmed) a qualification category or a corresponding pedagogical title, issue a corresponding order and familiarize the pedagogical employee with it under signature. The order must be submitted to the accounting department of the University / Professional College for payroll calculation and the performance of the corresponding recalculation from the date the decision was made by the attestation commission on the assignment of the next qualification category or the assignment of the pedagogical title.
4.6. In case the pedagogical employee disagrees with the decision of the higher-level attestation commission regarding the review of the appeal statement, they have the right to appeal such a decision to the court in the manner established by legislation.
4.7. The decision of the attestation commission may serve as a basis for dismissal of the pedagogical employee from work in the manner established by legislation. An order of dismissal or transfer of the employee, upon their consent, to another position based on the results of the attestation shall be issued only after the review of their appeal (if submitted) by the higher-level attestation commissions in compliance with labor legislation. Termination of the employment contract under such conditions is permissible if it is impossible to transfer the employee, upon their consent, to another position that corresponds to their qualification within the same educational institution.
5. Final Provisions
5.1. The Regulations on the Attestation of Pedagogical Staff are adopted by the Academic Council of the University and enacted by order of the Rector of the University.
5.2. Changes and/or additions to these Regulations are made in the manner established for its adoption.
