Regulations on Training Courses for Drivers of Category "B" Vehicles

1. General Provisions

1.1 These Regulations on Training Courses for Drivers of Category "B" Vehicles (hereinafter – the Regulations) are developed to provide educational services for individuals (hereinafter – trainees) to acquire knowledge of traffic regulations, taking into account the requirements of Paragraph 1, Sub-paragraph 4 of the Law of Ukraine "On Education" dated 05.09.2017 No. 2145-VIII; Resolutions of the Cabinet of Ministers of Ukraine "On Approval of the List of Paid Services That May Be Provided by Educational Institutions, Other Establishments, and Educational System Institutions Belonging to State and Municipal Ownership" dated 27.08.2010 No. 796 (as amended); "On Approval of the Procedure for Training, Retraining, and Advanced Training of Vehicle Drivers" dated 20.05.2009 No. 487 (as amended); "On Approval of the Standard Educational Program for Training and Retraining Vehicle Drivers" dated 02.03.2010 No. 229 (as amended); "On Approval of the Regulations on the Procedure for Issuing Driver's Licenses and Admission of Citizens to Driving Vehicles" dated 20.05.2009 No. 511; Joint Order of the Ministry of Internal Affairs of Ukraine, the Ministry of Transport and Communications of Ukraine, the Ministry of Education and Science of Ukraine, the Ministry of Labor and Social Policy of Ukraine "On Approval of Requirements for Institutions Conducting Training, Retraining, and Advanced Training of Vehicle Drivers, and Qualification Requirements for Specialists Conducting Such Training" dated 05.04.2016 No. 255/369/132/344; Certificate of State Accreditation of the Ministry of Internal Affairs of Ukraine, orders, and administrative documents of National Aerospace University "Kharkiv Aviation Institute" (hereinafter – the University) for the purpose of defining the procedure for training drivers to operate Category "B" vehicles on the basis of the University in accordance with Certificate of the Ministry of Internal Affairs of Ukraine on State Accreditation of the Institution for Training, Retraining, and Advanced Training of Drivers No. 001804 dated 04.08.2020, Sub-paragraph 16 of Paragraph 2 of the Regulations "On the Procedure for Providing Paid Educational Services Provided by National Aerospace University 'Kharkiv Aviation Institute'" dated 29.09.2021.

1.2 Driver training is the process of trainees acquiring knowledge of Traffic Regulations, the design and operation of vehicles, and the fundamentals of traffic safety.

1.3 The courses provide theoretical training for trainees to operate Category "B" vehicles, which allows driving all types of passenger cars weighing up to 3.5 tons and with a passenger capacity of up to 8 people.

1.4 Trainees undergoing training, retraining, and advanced training for vehicle drivers may carry out distance/in-person learning using electronic communication technical equipment, including the Internet (Resolution of the Cabinet of Ministers of Ukraine on driver training and state registration of vehicles during martial law in Ukraine dated 10.05.2022 No. 584, Paragraph 1, Sub-paragraph 2).

1.5 General management of Category "B" driver training courses is carried out by the Head of the Department of Automobiles and Transport Infrastructure, who appoints a person responsible for the organizational work of the courses.

1.6 Monitoring of compliance with the University's internal regulations by enrolled trainees is carried out by the instructor of practical training, who conducts classes according to the schedule.

1.7 Driver training for Category "B" vehicles is carried out on a fee-paying and voluntary basis.

2. Procedure for Driver Training for Category "B" Vehicles

2.1 Theoretical driver training for Category "B" vehicles is carried out on the basis of the Standard Educational Program for Training, Retraining, and Advanced Training of Vehicle Drivers according to a working curriculum approved by the administration of the Main Service Center of the MIA of Ukraine in Kharkiv Oblast.

2.2 The scope of the theoretical driver training course for Category "B" vehicles is 64 hours.

2.3 Theoretical driver training is conducted as groups are assembled (minimum number of trainees in a group – 7).

2.4 The study of Traffic Regulations is conducted remotely/in-person (on the premises of the University) in compliance with the requirements of current University Instructions on occupational safety, fire safety rules, sanitary and hygienic norms, state building codes, and emergency situations.

2.6 Certified specialists meeting the qualification requirements established by the legislation of Ukraine are engaged to conduct theoretical training.

2.7 Theoretical training classes are held according to a schedule drawn up by the head of the courses and approved by the head of the department.

3. Records and Accounting of Trainees for Category "B" Vehicle Courses

3.1 Attendance of trainees in theoretical training courses is recorded in the attendance log, while the assessment of course trainees is maintained in the academic performance assessment log in the software application "ARM Driving School".

3.2 Upon completion of training, the online logs populated with attendance and assessment data, along with the issued certificates, are transferred according to approved templates to the database of the National Automated Information System;

3.3 The certificate of completion of the theoretical training course is generated in electronic form, but (upon request) it may be issued according to the established template in paper format.

4. Rights and Duties of Course Instructors

4.1 Instructors are obliged to:

- conduct classes in accordance with the agreed schedule;

- require course trainees to comply with the University's internal regulations;

- provide all necessary documentation related to training for review;

- ensure the necessary conditions for high-quality and comprehensive training of drivers in accordance with the program approved by the Main Service Center of the MIA of Ukraine.

4.2 Instructors have the right to utilize classrooms, equipment, technical tools, and educational literature of the Department of Automobiles and Transport Infrastructure to conduct theoretical driver training.

5. Rights and Duties of Course Trainees

5.1 Trainees have the right to:

- receive full training in accordance with the approved program;

- review the training program and other regulatory documentation related to traffic rules;

5.2 Trainees are obliged to:

- observe the established procedure and internal regulations of the University;

- attend classes according to the schedule;

- fully master the approved program.

6. Enrollment Procedure and Payment for Courses

6.1 Training services for Category "B" driver preparation are provided on the basis of a concluded agreement for the provision of educational services according to the established standard form.

6.2 Trainees wishing to enroll in the courses must submit the following documents:

- an application addressed to the Rector of the University requesting admission to theoretical training for Category "B" vehicle driver preparation (established form);

- a medical certificate of professional fitness to drive the relevant vehicle;

- a copy of the passport of a citizen of Ukraine or a document certifying identity and confirming citizenship or special status;

- a copy of the tax identification code.

6.3 Payment for course training is made in cash or non-cash form to the settlement account of the University in the amount corresponding to the cost of the paid educational service.

6.4 In the event of a breach by trainees of the terms of the agreement on the provision of educational services for Category "B" driver training (failure to complete the theoretical training program, etc.), funds received by the University are non-refundable.

7. Final Provisions

7.1 The Regulations are approved by the Academic Council of the University and enacted by order of the Rector of the University.

7.2 Monitoring the implementation of the Regulations is carried out by University officials within their powers as established by job descriptions.

7.3 Amendments and additions to the Regulations are considered and approved by the Academic Council of the University and brought into effect by order of the Rector of the University in accordance with the established procedure.
