Preamble
These Internal Rules of Procedure (hereinafter referred to as the Rules) of National Aerospace University “Kharkiv Aviation Institute” (hereinafter referred to as the University) have been developed and approved in accordance with the Model Internal Rules of Procedure for Employees of State Educational Institutions, approved by Order of the Ministry of Education and Science of Ukraine No. 455 dated 20.12.1993 (as amended), and the Statute of the University (hereinafter referred to as the Statute).
These Rules define the fundamental principles of organizing the educational process, labor and academic discipline, the rights and duties of participants in the educational process, the procedure for their interaction, and are aimed at ensuring proper working and learning conditions, effective functioning of the University, adherence to academic integrity, corporate culture, and the safety of all members of the university community.
The Rules regulate the primary rights and duties, standards of conduct, and mutual relationships for faculty members, students, and other employees of the University. In addition, the Rules determine the organization and duration of the working day for employees and students, as well as measures of encouragement and disciplinary actions for members of the collective.
The purpose of the Rules is to cultivate a responsible attitude toward the fulfillment of duties, maintenance of internal order, mutual respect, tolerance, and inclusiveness among students, scientific-pedagogical, pedagogical, scientific, and other employees of the University, as well as to create a favorable environment for the implementation of educational and scientific initiatives.
The Rules are uniform and mandatory for all services, structures, and departments within the University. The Rules apply to all participants in the educational process of the University – students, scientific-pedagogical, pedagogical, scientific, and other employees working at the University as their primary place of employment or part-time, as well as persons engaged in University activities on other grounds. The Rules are effective within the premises and on the territory of the University and are mandatory for all persons who work, study, or stay within the premises or on the territory of the University. The territory of the University includes land plots, buildings, aboveground and underground structures, sports and recreational zones, small architectural forms, and landscaping elements.
All matters related to the application of the Rules shall be resolved by the Rector and the administration of the University within the scope of their authority, and in cases provided for by the current legislation and the Rules, − jointly or in agreement with the Trade Union Committee of the Primary Trade Union Organization of the University. In matters not regulated by these Rules, the University is guided by the current legislation of Ukraine, the Collective Agreement, local regulatory acts of the University, and orders of the Rector.
1. General Provisions
1.1. These Rules have been drawn up on the basis of the provisions of the Constitution of Ukraine, the Labor Code of Ukraine (LC of Ukraine), the legislation of Ukraine on education, in particular, the Laws of Ukraine “On Education”, “On Higher Education”, “On Scientific and Scientific-Technical Activity”, the University Statute, and other regulatory acts governing labor relations, the educational process, scientific and economic activities, and educational/upbringing work in Ukraine and at the University.
1.2. These Rules constitute an updated edition adopted to replace the previous edition of the Internal Rules of Procedure of the University, adopted on 25.12.2013 at the conference of the labor collective and approved by the Rector of the University on 26.12.2013 (as amended).
1.3. In accordance with the legislation of Ukraine, the Statute, and the Collective Agreement, the draft of the Rules was provided for review and discussion prior to consideration at the conference of the labor collective of the University to:
- The Primary Trade Union Organization of University Employees* in accordance with Art. 43 of the LC of Ukraine,
- The Student Council of the University in accordance with Art. 40 of the Law of Ukraine “On Higher Education”,
- The Primary Trade Union Organization of Students, Postgraduates, and Doctoral Students of the University* in accordance with the Agreement between the Rector and the Primary Trade Union Organization of Students of the University (Appendix Z to the Collective Agreement).
* Powers on behalf of the primary trade union organization are exercised by the Trade Union Committee.
1.4. All University employees acknowledge these Rules with a signature pursuant to Art. 29 of the LC of Ukraine, and newly hired employees – prior to commencing work. Students acknowledge the Rules before beginning their studies. Knowledge and strict fulfillment of the Rules allow each member of the collective to more fully realize their capabilities and aspirations toward achieving high results in work, study, the social sphere, recreation, and the improvement of moral and ethical relations.
1.5. The Rules, along with any amendments and additions to these Rules, must not contradict the Statute of the University.
1.6. For the purposes of these Rules, terms are used in the following meaning:
University – National Aerospace University «Kharkiv Aviation Institute» – a higher education institution, a legal entity of public law, which is subordinate to and within the sphere of management of the Ministry of Education and Science of Ukraine and operates in accordance with the Statute.
Employer – the University represented by the Rector or officials authorized by him, which exercises the rights and duties of an employer in accordance with the legislation. The functions of the employer within the scope of competence are implemented by the University administration, which ensures the organization of labor relations, personnel management, and compliance with labor legislation.
Head of structural unit – a person who manages the activities of the corresponding unit of the University and bears personal responsibility for the compliance with labor discipline by the employees of this unit.
Employee – a natural person who is in an employment relationship with the University and performs labor functions in accordance with an employment contract (agreement). The category of employees includes scientific-pedagogical, scientific, pedagogical, and other workers of the University.
Scientific-pedagogical employee (NPR) – a person who conducts educational, methodical, scientific, organizational, and educational/upbringing work at a department of the University. Scientific-pedagogical employees include heads of departments, professors, associate professors, senior lecturers, and assistants.
Scientific worker – a person who on a professional basis engages in scientific, scientific-technical, or innovative activities, possesses the relevant qualifications, and holds the position of a scientific worker in accordance with the Law of Ukraine «On Scientific and Scientific-Technical Activity».
Pedagogical worker – an employee of the University who directly carries out educational, upbringing, methodical, or organizational-pedagogical activities aimed at ensuring the educational process, and who possesses the appropriate education, professional training, and qualifications. Pedagogical workers of the University include, in particular, methodologists of educational departments, heads of educational laboratories, as well as other employees whose activities are related to the organization and implementation of the educational process.
Student – a person studying at the University at a certain level of higher education with the aim of obtaining the corresponding higher education degree and qualification.
Labor discipline – compliance with the established order of labor, rules of conduct, and occupational safety requirements, mandatory for all employees.
Working time – the time during which an employee is obliged to perform their labor duties in accordance with the work schedule.
Workplace – the place where an employee performs their work in accordance with job duties.
Collective Agreement – a regulatory act that regulates social and labor relations between the employer and the labor collective of the University.
Staffing table – an organizational and administrative document of the University that defines the structure and list of structural units, names of positions, number of staffing units, and sizes of official salaries of employees, established in accordance with the current legislation and internal regulatory acts of the University.
1.7. Control over the implementation of the Rules is exercised by:
- the Rector, Vice-Rectors;
- the Head of the Human Resources Department – regarding compliance with labor routines by employees;
- the Director of the Center for Education Quality, Licensing and Accreditation, Deans of Faculties, Head of the Academic Department, Head of the Postgraduate and Doctoral Studies Department – regarding compliance with the educational order by students;
- heads of other structural units – according to job descriptions;
- the Student Council of the University – within the powers defined by the legislation on the activities of student self-government bodies;
- Trade Union Committees of the Primary Trade Union Organization of Employees, and the Primary Trade Union Organization of Students, Postgraduates, and Doctoral Students of the University – within the powers defined by the legislation on the activities of trade union organizations.
1.8. The operating mode of enterprises, institutions, organizations, and individual entrepreneurs who rent premises at the University shall correspond to the operating mode of educational buildings, student dormitories, and other buildings and structures of the University.
1.9. The following is prohibited at the University:
- any discrimination in the sphere of labor and education, in particular, violation of the principle of equality of rights and opportunities, direct or indirect restriction of the rights of employees and students based on race, skin color, political, religious and other beliefs, sex, gender identity, sexual orientation, ethnic, social and foreign origin, age, health status, disability, suspicion or presence of HIV/AIDS, family or property status, family duties, place of residence, membership in a trade union or other association of citizens, participation in a strike, appeal or intention to appeal to court or other bodies for the protection of their rights or providing support to other employees and students in the protection of their rights, based on language or other grounds;
- committing mobbing (bullying) and harassment;
- applying physical violence, psychological pressure, or inflicting bodily harm – intimidation and abuse are unacceptable forms of behavior;
- justifying or recognizing as lawful any actions related to the dissemination, production, or public demonstration of materials that deny the armed aggression of the Russian Federation against Ukraine, glorify its participants, or contain calls for collaborationism or fraudulent actions;
- demanding, accepting, receiving, or in any other way committing unlawful acts with the purpose of obtaining benefits for oneself or third parties in any form and manner during the performance of official duties;
- making decisions or taking any actions under conditions of a real or potential conflict of interest, without proper notification and settlement of such conflict in accordance with the requirements of current legislation.
2. Procedure for Hiring and Dismissal of Employees
2.1. Citizens of Ukraine freely choose types of activity not prohibited by legislation, as well as a profession and place of work in accordance with their abilities.
As a rule, employees may work at the University at their primary place of employment, as well as part-time, under conditions of dual job-holding (performing the duties of a temporarily absent employee), or on an hourly pay basis in accordance with the requirements of the current legislation of Ukraine and internal regulatory acts of the University.
2.2. Scientific-pedagogical employees are appointed to positions based on the results of a competitive selection process, the procedure for which is approved by the Academic Council of the University. The University may conclude short-term employment contracts with foreign citizens in accordance with the legislation.
In individual cases, if it is impossible to ensure the educational process with the available permanent staff, vacant positions of scientific-pedagogical employees may be filled under an employment contract until a competitive selection for these positions is held in the current academic year.
As a rule, persons with scientific degrees or academic titles, as well as graduates of master's, postgraduate, and doctoral studies, are elected to the positions of scientific-pedagogical employees.
2.3. The hiring of scientific workers is carried out in accordance with the legislation of Ukraine, the Statute, and other internal regulatory acts of the University. Scientific workers are appointed to a position under a fixed-term employment contract for the period of execution of scientific work on the relevant scientific topic. The decision to appoint a scientific worker to a position is made by the Rector of the University on the basis of a submission from the head of the corresponding structural unit or the director of the scientific project.
2.4. Filling vacant positions of pedagogical and other employees of the University is carried out without a competitive selection process in accordance with the requirements of the legislation of Ukraine, the University Statute, and internal regulatory acts based on a submission from the head of the corresponding structural unit. As a rule, employees are hired under an employment contract of indefinite duration. In the event of replacing a temporarily absent employee or performing work that has a limited duration, hiring is carried out under a fixed-term employment contract for a specified period.
2.5. Submissions for appointment to a position are addressed to the Rector of the University. When hiring, the University administration is obliged to demand from candidates the documents stipulated by the current legislation of Ukraine, in particular:
- an application for employment (in paper or electronic form);
- a passport of a citizen of Ukraine or another document that identifies the person and confirms citizenship;
- information on labor activity from the register of insured persons of the State Register of Compulsory State Social Insurance (Electronic Labor Book and a certified copy of the dismissal order from the last place of work) in the absence of a paper labor book;
- the registration number of the taxpayer's account card (identification code);
- a military registration document (military ID card or registration certificate) – for persons subject to military registration.
When hiring for work that requires specific knowledge and qualifications, the University administration must require the employee to provide a diploma or another document certifying education, professional training, or the possession of scientific degrees and academic titles.
Employees who are hired by the University for the first time, or upon transfer to another position, as well as those categories of employees whose work requires verification of health status, shall arrange a medical examination document.
The employee bears responsibility for the accuracy of filling out documents and their timely submission to the Human Resources Department of the University.
2.6. The employment of workers is formalized by an order of the Rector for the University and announced to the employee, after which they must affix their signature on the form “Reverse Side of Order P-1”. The employment order must state the title of the position in accordance with the State Classifier of Professions of Ukraine and the staffing table of the University, as well as the terms of remuneration.
2.7. When hiring or transferring an employee to another job in accordance with the established procedure, the University administration is obliged to:
- explain to the employee their rights, duties, and existing working conditions, the presence of hazardous and harmful production factors at the workplace where they will work, and the potential consequences of their impact on health, as well as their rights, benefits, and compensations for work in such conditions in accordance with current legislation and the Collective Agreement;
- acquaint the employee in writing with the Internal Rules of Procedure, the Collective Agreement, and the job description;
- assign a workplace to the employee and provide them with the necessary means for work;
- instruct the employee on occupational safety and fire safety and conduct an introductory briefing.
2.8. When concluding an employment contract, it is prohibited to demand from persons applying for a job information regarding their national and political party affiliation, as well as documents not provided for by legislation.
2.9. The records of labor activities of University employees are kept in electronic form in accordance with the requirements of the current legislation of Ukraine. The electronic labor book is the primary source of information on labor activity and is maintained through the employee's personal account in the Register of Insured Persons of the Pension Fund of Ukraine. A paper labor book may be kept and updated only at the request of the employee or in the absence of digital records. For employees performing hourly paid work at the University, the labor book is kept only when this work is their primary place of employment. Persons working part-time have records of their labor activities at their primary place of work.
2.10. Hiring of foreign citizens and stateless persons is carried out in the manner prescribed by current legislation.
2.11. The dismissal of a University employee may occur on grounds specified in the Labor Code of Ukraine, with compliance with the established deadlines and payment of compensations provided for by legislation.
2.12. The termination of an employment contract is formalized by an order of the Rector for the University and brought to the attention of the employee, for which they must sign on the clearance form.
2.13. Upon termination of employment relations with the University, in order to prevent any indebtedness and confirm the absence of possible claims by the University, the employee must sign a clearance form according to the established template and submit it to the Human Resources Department of the University.
2.14. The day of dismissal is considered to be the last day of work. On the day of dismissal, the University administration is obliged to enter the relevant record of dismissal into the Register of Insured Persons (electronic labor book), make a final settlement with the employee, and, in the case of maintaining a paper labor book, issue it to the employee with the corresponding record.
3. Key Rights and Duties of University Employees
3.1. University employees have the right:
3.1.1. To proper working conditions that ensure the fulfillment of professional duties, in particular:
- a workplace provided with the necessary equipment, materials, and machinery;
- safe and healthy working conditions;
- compliance with established standards for the duration of working time, rest, and leaves.
3.1.2. To remuneration in accordance with the current legislation, the Collective Agreement, and the staffing table of the University.
3.1.3. To participate in the management of the University – through the right to elect and be elected to collegiate bodies and bodies of public self-government of the University and its units, and to participate in the work of working and advisory bodies.
3.1.4. To professional development, in particular:
- to undergo advanced training, internships, and to participate in scientific, methodical, and educational events;
- to receive support from the University administration in enhancing professional competence.
3.1.5. To the protection of their labor rights and legitimate interests in the manner prescribed by legislation.
3.1.6. To the protection of professional honor and dignity.
3.1.7. To submit proposals regarding the improvement of the educational process, scientific activity, the organization of units' work, and working conditions.
3.1.8. To receive information necessary for the performance of official duties.
3.1.9. To demand assistance from the University administration in the fulfillment of functional duties, ensuring discipline and order, creating appropriate working conditions, raising their professional level, and organizing recreation and living conditions established by current legislation, regulatory acts of the University, the terms of the employment contract, and the Collective Agreement.
3.1.10. To enjoy social guarantees provided for by legislation, the Collective Agreement, and internal regulations of the University.
3.1.11. To participate in the development of internal regulatory documents related to their activities.
3.1.12. To enjoy other rights provided for by the current legislation of Ukraine, the Statute, and the Collective Agreement of the University.
3.1.13. Scientific-pedagogical and pedagogical employees also have the right:
- to academic freedom, implemented in the interests of the individual, society, and humanity as a whole;
- to academic mobility for conducting professional activities.
- to choose methods and means of teaching that ensure high quality of the educational process;
- to use library and information resources free of charge, as well as the services of educational, scientific, sports, and cultural-educational units of the University in accordance with the established procedure;
- to the protection of intellectual property rights;
- to advanced training and internship at least once every five years.
3.1.14. Scientific workers also have the right:
- to make a reasoned decision to refuse participation in scientific (scientific-technical) activity, the results of which may violate the rights of the scientific worker themselves or another person, society, cause harm to the natural environment, or violate the ethical standards of the scientific community;
- to financial support for the conducted research from the state budget and other sources of funding in accordance with the legislation of Ukraine;
- to an objective evaluation of their activity and to receive material remuneration according to qualifications, scientific results, quality and complexity of the work performed, as well as to receive income or other remuneration from the realization of scientific or scientific-technical (applied) results of their activity in accordance with legislation;
- to conduct scientific-pedagogical activity, provide advisory assistance, and act as an expert in accordance with the legislation of Ukraine;
- to improve their qualifications.
3.2. Duties of University Employees:
3.2.1. Employees of all structural units of the University are obliged:
- to adhere to the Constitution, the laws of Ukraine, the Statute, the Collective Agreement, these Rules, and other internal regulatory acts of the University;
- to conscientiously perform job duties defined by the employment contract, the job (work) description, and orders of the management;
- to adhere to labor discipline – to arrive at work on time, not to leave the workplace without the permission of the University administration, and to use working time rationally;
- to maintain a high culture of labor, behave politely with colleagues, students, and visitors of the University, and contribute to a friendly working atmosphere;
- to fulfill requirements regarding occupational safety, safety techniques, fire safety, sanitary standards, and rules for using equipment and premises;
- to take care of their own health and the health of those around them, in particular, in case of symptoms of acute respiratory disease (ARD, ARVI, flu, COVID-19, and other viral infections) it is mandatory to notify the immediate supervisor and, if possible, stay home until full recovery, while arranging a certificate of temporary disability in the manner prescribed by legislation or providing other supporting documents of temporary disability; if arranging a certificate of temporary disability is complicated, or there is an urgent operational need for the employee to be present at the workplace, the employee showing symptoms of a viral disease is obliged:
- to mandatory use a protective medical mask throughout the entire stay at the University;
- to minimize the number of social contacts, in particular, avoid long meetings, appointments, and crowds;
- strictly adhere to the rules of respiratory hygiene and hand sanitization;
- whenever possible, work in a separate room or remotely;
- treat property with care, use material, financial, and energy resources rationally, and prevent their damage or loss;
- ensure the preservation of official and confidential information, and do not disclose personal data of students, employees, and partners of the University;
- adhere to academic integrity (for scientific-pedagogical, pedagogical, and scientific workers) and general ethical standards;
- constantly raise their professional level, and improve knowledge and skills;
- at least once a day, review the contents of orders, instructions, and other documents from the University administration (in particular, the Rector, Vice-Rectors, heads of structural units) sent to personal corporate email or posted in corporate chats on social networks;
- contribute to the creation of a safe, inclusive, and honest educational environment, and prevent discrimination, mobbing, bullying, and violence;
- uphold the authority of the University, and adhere to ethical standards in public statements, social networks, and while representing the University;
- refrain from actions, statements, and publications that show signs of collaborationism, or justify or support armed aggression against Ukraine;
- use special clothing, safety footwear, and personal and collective protective equipment in accordance with working conditions;
- take measures to eliminate causes that hinder normal work, or report them immediately to the University administration;
- remain at work throughout the working day, except for breaks for rest and meals*;
* for employees who, with the permission of the University Rector, work remotely, this requirement implies an obligation to be constantly “reachable” during the working day at the University
- abide by the Anti-Corruption Program of the University and take measures to prevent corruption and violations of anti-corruption legislation;
- behave with dignity, follow dormitory rules, and refrain from actions that interfere with other employees;
- smoke only outside the premises and territory of the University;
- undergo timely medical examinations in accordance with the established procedure;
- avoid conflicts of interest if the position involves organizational-administrative or managerial functions;
- perform other duties specified by the job (work) description.
3.2.2. Scientific-pedagogical employees, in addition to the duties listed in clause 3.2.1 of the Rules, are also obliged:
- to ensure proper quality of the educational process, and to adhere to curricula, programs, and class schedules;
- to adhere to the principles of academic integrity;
- to maintain accurate and timely records of educational work (journals, grade sheets, electronic systems, reporting, etc.);
- to raise their professional level, improve pedagogical skills, carry out scientific activities, and participate in methodical and scientific events;
- to participate in upbringing/educational work with students, cultivate an academic culture, civic stance, and responsibility, assist in independent student work, supervise students' research activities, and join career guidance events of the department, faculty, and University;
- to use working time rationally, prevent tardiness, absenteeism, or unethical behavior, and strictly adhere to the schedule of classes and consultations;
- to use the state language within the educational process, during classes (except for educational programs or separate educational components taught in a foreign language, as well as lectures and practical classes involving foreign instructors), and in communication among University employees, both with students and with each other;
- to adhere to the standards of pedagogical and scientific ethics, respect the dignity of students, instill a love for Ukraine, raise them in the spirit of patriotism and respect for the Constitution of Ukraine, and foster moral, cultural, spiritual, and national values;
- to perform other duties specified by the job description.
3.3. Rules of Etiquette for University Employees.
The rules of etiquette define the list of standards of conduct for University employees in order to ensure professional, ethical, and respectful interaction in the educational, scientific, operational, and administrative environments.
Compliance with the rules of etiquette is the duty of every University employee, regardless of the position held.
Etiquette is based on the principles of respect, integrity, cultural communication, tolerance, objectivity, and responsibility.
Any manifestations of discrimination, insults, humiliation, hostile statements, or biased attitude on any grounds are prohibited.
Employees must avoid conflicts of interest and act impartially in their professional decisions.
Official communication must be clear, professional, understandable, and conducted in a polite manner.
Employees are obliged to adhere to the culture of speech, avoiding profanity, rudeness, sarcasm, and manipulative expressions.
Electronic communication (correspondence, messaging in messengers, electronic platforms) must comply with the general rules of business correspondence and corporate style.
Employees shall respond to inquiries from students, colleagues, and other participants in the educational process within a reasonable timeframe, maintaining a professional style.
Scientific-pedagogical, pedagogical, and scientific workers are obliged to strictly adhere to the principles of academic integrity in learning, teaching, scientific activity, and assessment. For them, in particular, any forms of academic dishonesty are prohibited, including plagiarism, fabrication and falsification of data, biased assessment, and assisting students in violating integrity.
Instructors are obliged to ensure transparency of grading criteria and equal conditions for all students.
Employees do not have the right to demand or accept any material or non-material benefits in connection with the performance of their professional duties.
The appearance of employees must comply with generally accepted standards of neatness, business or casual-business style (depending on the specifics of the performed duties).
During participation in public events, scientific conferences, and meetings with partners, employees must represent the University professionally and with integrity.
In statements within the public space (including social networks), employees are recommended to refrain from comments that could harm the reputation of the University.
Employees must maintain a favorable atmosphere for learning, work, and development, and contribute to the formation of a safe, inclusive, and tolerant environment.
All employees must comply with the requirements of internal rules, occupational safety regulations, fire safety rules, and ethical conduct in work premises.
The use of official premises in a manner that obstructs the educational process or violates the rights of other persons is prohibited.
Violation of etiquette rules is reviewed in accordance with the internal regulations of the University and may serve as a ground for disciplinary liability.
In cases not regulated by this clause, employees shall be guided by the general standards of professional ethics, the legislation of Ukraine, and the University Statute.
3.4. The list of duties (works) performed by each employee in accordance with their specialty, qualification, or position is determined by job (work) descriptions, the terms of the agreement (contract), approved regulations, as well as qualification reference manuals.
3.5. For non-fulfillment of their duties, employees bear liability in accordance with the current legislation of Ukraine.
3.6. The rules of conduct for University employees are set forth in the University Statute, these Rules, and local regulatory documents of the University approved by the Academic Council of the University and enacted by orders of the Rector, in particular, the Code of Ethics, the Code of Academic Integrity, the Regulations on Prevention and Counteraction to Discrimination and Settlement of Conflict Situations, the Regulations on the Policy of Counteracting Discrimination and Sexual Harassment and Supporting Equality, the Regulations on the Procedure for Storing and Disseminating Information Constituting a Commercial Secret and Other Confidential Information, the Access Control Rules, as well as other regulatory documents of Ukraine and the University on matters regulating external manifestations of human relationships in the activities of higher education institution employees in Ukraine. In accordance with Art. 142 of the LC of Ukraine, the rules of conduct for University employees are an integral part of the Internal Rules of Procedure of the University.
4. Fundamental Rights and Duties of the University Administration
4.1. The University administration refers to the management of the University, headed by the Rector, Vice-Rectors, and heads of structural units acting within the scope of their granted authority. The University administration manages the educational, scientific, upbringing, operational, and personnel processes, ensuring the implementation of state policy in the field of education and compliance with the legislation of Ukraine.
4.2. The University administration has the right:
4.2.1. To determine the structure, staffing table, operating mode, and organization of the educational process in accordance with the current legislation.
4.2.2. To conclude, amend, and terminate employment contracts (agreements) with employees in accordance with the norms of labor legislation.
4.2.3. To demand from employees and students compliance with the provisions of the legislation of Ukraine, the University Statute, the Collective Agreement, these Rules, dormitory living regulations, other local regulatory acts of the University, requirements for labor and academic discipline, occupational safety, fire safety rules, and academic integrity, the execution of orders of the Rector, instructions of the Vice-Rectors of the University, and the immediate supervisor in accordance with the subordination established by the job description, and to take necessary measures to bring violators of labor discipline to liability.
4.2.4. To apply measures of encouragement and disciplinary action to employees within the limits specified by legislation.
4.2.5. To submit proposals for the improvement of the educational process, working conditions, and learning environment.
4.2.6. To control the quality of the performance of job duties by employees and the fulfillment of curricula by students.
4.2.7. To represent the interests of the University in bodies of state power, local self-government, and in relations with legal entities and natural persons.
4.2.8. To initiate and conduct activities for advanced training and professional development of employees.
4.2.9. To make decisions on encouragement, bonuses, and awards for employees for conscientious work and achievements in work.
4.3. The University administration is obliged:
4.3.1. To ensure the implementation of the requirements of the Constitution of Ukraine, the laws of Ukraine, acts of the Ministry of Education and Science of Ukraine, and the University Statute.
4.3.2. To create safe and healthy working and learning conditions, and ensure compliance with occupational safety standards, sanitary-hygienic, and fire safety requirements.
4.3.3. To ensure the organization of the educational process at a high scientific and methodical level, the necessary organizational and economic conditions for the effective work of University employees in accordance with their specialty or qualification, assign workplaces to employees, timely bring the class schedule to their attention, and provide them with the necessary means of work.
4.3.4. To facilitate advanced training of scientific-pedagogical employees and the development of professional competencies of students.
4.3.5. To timely pay salaries to employees, stipends to students, and other stipulated payments, and grant leaves to all University employees in accordance with the vacation schedule.
4.3.6. To ensure compliance with academic integrity, rights, and freedoms of employees and students.
4.3.7. To take measures to prevent discrimination, mobbing, bullying, corruption, and other violations of ethical standards in the activities of the University.
4.3.8. To provide employees and students with the opportunity to exercise their rights provided for by legislation and internal documents of the University.
4.3.9. To ensure the safety of University property, and the effective use of financial and material resources.
4.3.10. To ensure openness and transparency in the management of the University, and regular informing of the collective about decisions regarding the institution's operations.
4.3.11. To abide by the terms of the Collective Agreement, show sensitivity to the daily needs of University employees and students, ensure proper maintenance of premises, heating, lighting, ventilation, and equipment, create proper conditions for storing the outer clothing of University employees and students, and organize high-quality and wholesome catering.
4.3.12. To create organizational, personnel, inclusive, safe, informational, psychological-pedagogical, technological, barrier-free, and architectural conditions aimed at overcoming barriers, ensuring accessibility, and academic and social integration for persons with disabilities and persons with special educational needs, including the provision of necessary adaptations, resources, and support services in accordance with their individual needs and the requirements of current legislation.
4.3.13. To timely submit established statistical and accounting reporting, as well as other necessary information regarding the operation and status of the University, to the central bodies of state executive power.
4.4. The University administration performs its duties in cases provided for by current legislation, jointly with the Trade Union Committee of the primary trade union organization of employees and bodies of public self-government.
4.5. Additional duties may be imposed on the University administration upon the conclusion of the Collective Agreement.
4.6. For employees engaged on a part-time working day or week basis, the University administration is obliged to provide the opportunity to establish a working schedule convenient for them within the respective balance of working time, provided that this does not hinder the educational process, scientific research work, or the performance of other works.
4.7. The following office hours are established at the University:
- the Rector of the University and Vice-Rectors receive students from 14:00 to 16:00 on Mondays, University employees on official matters daily from 14:00 to 16:00, and on personal matters from 16:00 to 17:30 on Mondays;
- Deans of faculties, their deputies, and heads of departments establish reception hours for professors, instructors, and students depending on the operating hours of the faculties and departments;
- heads of departments and services receive University employees on official matters daily from 14:00 to 17:00, and on personal matters from 16:00 to 17:30 on Mondays.
5. Operating Mode, Working Time, and Its Utilization
5.1. In accordance with the Constitution of Ukraine, the Labor Code of Ukraine, the Law of Ukraine “On Leaves”, the Law of Ukraine “On Education”, the Law of Ukraine “On Higher Education”, other regulatory acts, and local documents of the University, a five-day working week with two days off – Saturday and Sunday – is established. For certain categories of employees, depending on the specifics of their activities, individual working schedules or a six-day working week may be applied.
The University establishes the duration of working time:
- for scientific-pedagogical employees — up to 36 hours per week;
- for scientific workers, engineering and technical personnel, and other employees — up to 40 hours per week;
- for students and postgraduate students, the academic load must not exceed the standards established by educational and scientific standards.
5.2. Within their working time, scientific-pedagogical employees perform all types of activity (educational, educational-methodical, scientific, upbringing work, etc.) in accordance with their job duties, approved individual plans, and the terms of the employment contract (agreement). Part-time employment is permitted only during time free from primary work.
5.3. Heads of departments, Deans of faculties, and responsible officials ensure control over compliance with class schedules and the fulfillment of individual plans and regulated works by employees.
5.4. The University approves the following working schedule:
- for scientific-pedagogical employees — according to the class schedule and individual working schedules;
- for other employees — in accordance with the approved schedules (8:30–17:30).
Lunch break: from 13:00 to 14:00 for all categories of employees.
5.5. Upon agreement with the Rector, the Trade Union Committee, and the Human Resources Department, other operating modes, including shift schedules, summarized recording of working time, and hourly pay, may be established for individual units and groups of employees. The recording period is determined in accordance with the current legislation of Ukraine and the Collective Agreement.
5.6. The educational process at the University begins in accordance with the approved class schedule. General days off are Saturday and Sunday, except for categories of employees with approved special schedules.
5.7. For employees with a summarized recording of working time or with part-time employment, an individual working schedule is established, approved by the Rector after agreement with the heads of departments, the Trade Union Committee, and the respective structural units.
5.8. For persons under the age of 18 and persons engaged in work with hazardous working conditions, as confirmed by the results of workplace certification regarding working conditions, a shortened duration of working time is established in accordance with Articles 51 and 56 of the Labor Code of Ukraine. By agreement with the employer, part-time working hours may be established for a pregnant woman, a woman who has a child under the age of fourteen or a child with a disability, including a child under her guardianship, or an employee who cares for a sick family member in accordance with a medical report, pursuant to Art. 56 of the Labor Code of Ukraine.
5.9. All employees, except for the scientific-pedagogical staff, must register the start and completion of the working day in the approved recording systems or special logbooks. Responsibility for maintaining these logbooks rests with the designated person of the structural unit.
5.10. In the event of an employee's absence from the workplace for valid reasons, they are obliged to notify the head of the unit. Substitutions of instructors, when necessary, are organized by the department or the Department of Education Quality, Analytics, and Educational-Methodical Support.
5.11. Employees who report to work (or are found at work) in a state of alcohol or drug intoxication shall not be allowed to work (shall be suspended from work), and the matter of their further employment shall be resolved by the University administration in accordance with current legislation.
5.12. Overtime work is permitted only in exceptional cases, by written order of the Rector and upon agreement with the Trade Union Committee. Work on days off or holidays is compensated in accordance with the Labor Code of Ukraine.
5.13. Annual leave is planned according to a schedule approved by the University administration and the Trade Union Committee, taking into account legislative requirements. The order of granting annual basic leaves is regulated by the University administration upon agreement with the Trade Union Committee and is compiled for each calendar year. In any case, a part of the leave lasting at least 24 calendar days must be used in the current calendar year. At the employee's request, annual leave may be divided into parts of any duration, provided that its main continuous part is at least 14 calendar days. Specific periods for granting annual leave, including leave divided into parts, must be indicated in the vacation schedules. The division and deferral of leave to another period are permitted in the manner prescribed by current legislation.
It is prohibited to fail to grant annual leave for two consecutive years, as well as to fail to grant leave to employees under the age of eighteen and employees entitled to additional leaves.
Vacation schedules are compiled for each calendar year no later than January 05, signed by the employees responsible for time-sheet tracking and the head of the unit, agreed with the Trade Union Committee of the primary trade union organization of the University, countersigned by the head of the Occupational Safety Department in the presence of additional vacation days for work in hazardous or strenuous working conditions or neuro-emotional strain, approved by the Rector or the Vice-Rector responsible for the area of work, and affixed with the seal of the University.
5.14. Pedagogical employees are prohibited from changing the working schedule and class schedule, as well as from delegating the performance of their duties to others without prior agreement with the administration.
5.15. During working hours, it is prohibited to distract employees from the performance of their official duties, except for cases provided for by the current legislation of Ukraine and clause 8.4 of the Collective Agreement, and to convene meetings without prior agreement with the management.
6. Rights, Duties, and Liability of University Students (Higher Education Applicants)
6.1. University students (higher education applicants) include students (applicants for the educational degree of Junior Bachelor, Bachelor, Master), postgraduate students (applicants for the educational-scientific degree of Doctor of Philosophy), doctoral students (applicants for the scientific degree of Doctor of Sciences), and trainees (persons studying under educational programs provided for by legislation or internal regulations of the University).
6.2. University students have the right to:
- quality education in accordance with state standards and the educational program;
- free choice of academic disciplines and research supervisors, and participation in the formation of an individual curriculum (within the limits defined by the educational program);
- participation in the formation of an individual curriculum in accordance with the established procedure;
- safe and harmless conditions for study, work, residence, and rest at the University, access to learning materials, and transparent assessment procedures, particularly during the operation of the legal regime of martial law or quarantine restrictions;
- the use of the educational, scientific, information, cultural, sports, and recreational facilities of the University;
- participation in the management of the University through student self-government bodies, Academic Councils of the University / faculties, and public self-government bodies (Conference of the University Labor Collective, General Assembly of Faculties, Scientific Society of Students, Postgraduate Students, Doctoral Students, and Young Scientists of the University), etc.;
- academic freedom, including the right to one's own opinion, expression of views, and participation in scientific discussions;
- participation in research, development and design works, conferences, symposia, exhibitions, and contests, and submitting their works for publication;
- participation in student self-government and trade union activities, and the protection of their rights and legitimate interests, including through student self-government bodies, primary trade union organizations, and the University administration;
- academic mobility, and participation in international and national educational and scientific programs;
- receiving stipends, financial assistance, and dormitory accommodation in accordance with current legislation and internal regulations of the University;
- rest during vacations and breaks specified by the curriculum;
- protection from any forms of exploitation, physical, and psychological violence;
- moral and (or) financial encouragement for success in studies, active participation in research work, and the public life of the University or its units;
- appealing against decisions, actions, or omissions of the management bodies of the University and its officials;
- other rights for students as specified by the Law of Ukraine “On Higher Education” and the University Statute.
6.3. University students are obliged:
- to study conscientiously, fulfill the curriculum and educational program, and adhere to the requirements of academic integrity;
- to comply with the orders of the University administration (faculty, department), the requirements of current legislation, the University Statute, and these Rules;
- to attend classes in accordance with the approved schedule, and pass control measures, tests, exams, and other forms of knowledge assessment in a timely manner;
- to adhere to the rules of working in a remote environment, complete learning assignments on time, and maintain academic integrity, particularly during the operation of the legal regime of martial law and during quarantine restrictions;
- to adhere to the standards of ethical behavior, and respect the rights and dignity of University employees and other students;
- to form and uphold patriotic values, and respect for the state symbols, history, and language of Ukraine;
- to refrain from actions, statements, and publications that show signs of collaborationism, or justify or support armed aggression against Ukraine;
- to preserve University property, use equipment, inventory, technical means, and library collections with care; it is prohibited to remove items and various equipment from laboratories, classrooms, and other premises without the permission of the University management, the dean of the faculty, or the head of a structural unit of the University;
- to maintain cleanliness and order in academic buildings, dormitories, and on the territory of the University, and to participate in landscaping works in the territories adjacent to academic buildings, the University campus, and other cultural and community facilities;
- to adhere to safety regulations, fire safety rules, and sanitary norms;
- to prevent manifestations of discrimination, violence, bullying, academic plagiarism, and other violations of ethical and legal norms;
- to timely inform the management of the department / dean's office of the faculty about circumstances that may affect the fulfillment of the curriculum, in particular, about the inability for valid reasons to attend classes, take (retake) exams, tests, control works, etc. (illness, family circumstances, etc.), as well as about changes in their own personal status (full name, marital status, address, etc.);
- to undergo medical examinations and check-ups in accordance with the established procedure in a timely manner;
- to adhere to the standards of academic etiquette, and show respect to instructors, employees, and guests of the University;
- to compensate for damage caused to University property in accordance with the established procedure;
- to execute instructions of the University Rector or the head of a structural unit of the University within their powers, as well as instructions of the instructor or supervisor in connection with their conduct of the educational and upbringing process;
- to take care of the honor and authority of the University, prevent unlawful, unethical, and immoral actions, and be disciplined within the University and in other public places.
6.4. Academic Etiquette at the University and the Culture of Students' Conduct.
6.4.1. Academic etiquette is an integral part of the culture of the university environment and implies compliance with the standards of politeness, respect, tolerance, and dignity in relations between all participants in the educational process.
6.4.2. The purpose of adhering to academic etiquette is to create a friendly, safe, and comfortable learning atmosphere, foster respect for the human personality and Ukrainian national values, and shape a positive image of the University.
6.4.3. Students must behave with dignity, demonstrate a culture of communication, and prevent rudeness, aggression, discriminatory statements, or humiliation of the honor and dignity of other persons.
6.4.4. During classes, students are obliged:
- to arrive for classes on time, without interfering with the conduct of classes and the work of others;
- to be neatly dressed, adhering in their appearance to a business or neat casual style appropriate for an educational environment;
- to refrain from using mobile phones, audio devices, or other gadgets, unless directly related to the educational process;
- not to use profane language, and not to create noise or conflict situations;
- to treat the equipment, furniture, textbooks, and materials of the classroom with care.
6.4.5. During communication with instructors, University employees, and other students, it is necessary:
- to address others in a polite form (using the formal “You”), respecting subordination;
- to show respect to persons senior in age, scientific, or official status;
- to express one's own opinion constructively, without interrupting the instructor or colleagues;
- to prevent manifestations of intolerance, bullying, harassment, or aggression.
6.4.6. A tradition of university etiquette is showing respect to instructors, employees, and guests of the University.
Students are recommended to show signs of respect, in particular, to stand up or greet warmly, when an instructor or a senior employee enters the classroom. Such actions should be an expression of goodwill, mutual respect, and academic culture, rather than a forced ritual.
Instructors, in their turn, must demonstrate respect for students, and adhere to the principles of partnership, academic freedom, tolerance, and mutual support.
6.4.7. Language Culture and Communication.
The language of the educational process at the University is the state language. The educational process in foreign languages is carried out in accordance with the legislation.
Higher education applicants are obliged to:
- use the state language in the educational process, official appeals, academic communication, and during correspondence with the University administration;
- adhere to the rules of literacy and speech etiquette;
- refrain from using words, expressions, or symbols containing signs of hate speech or propaganda of aggression.
In electronic communication (correspondence, online classes, in particular, via educational platforms Mentor, Teams, Zoom, etc.), higher education applicants must:
- adhere to the norms of academic communication;
- use polite formulas of address;
- not use jargon, profanity, offensive emojis, or abbreviations.
6.4.8. Symbols, National Values, and Civic Stance.
The academic etiquette of the University is based on the principles of civic responsibility, national consciousness, and patriotism.
Higher education applicants are obliged to treat the State Flag of Ukraine, the Coat of Arms, and the Anthem of Ukraine with respect, and to participate in events dedicated to national and state occasions.
Any manifestations of the following are prohibited at the University:
- public approval or justification of armed aggression against Ukraine;
- demonstration of symbols of the aggressor state or collaborationist movements;
- dissemination of anti-Ukrainian materials, calls for cooperation with occupation structures, or undermining state sovereignty.
Such actions are considered a gross violation of the requirements of these Rules and may serve as grounds for disciplinary liability, including expulsion from the University.
6.4.9. Adherence to academic etiquette is an important component of the University's reputation and the personal academic culture of a higher education applicant.
The University encourages manifestations of politeness, mutual respect, assistance, and partnership among all participants in the educational process.
Violation of the norms of academic etiquette may be taken into account when evaluating the behavior of a higher education applicant, considering issues regarding encouragement, or bringing to disciplinary liability.
6.5. Disciplinary Liability of Higher Education Applicants.
6.5.1. Higher education applicants of the University bear disciplinary liability for violating these Rules, the University Charter, requirements of academic integrity, and the legislation of Ukraine.
Disciplinary sanctions are applied to foster a responsible attitude towards learning, form an academic culture, and prevent offenses, including manifestations of collaborationism or anti-Ukrainian activity.
6.5.2. The following disciplinary sanctions may be applied to higher education applicants: a warning about the inadmissibility of violating these Rules, a reprimand, or expulsion from the University.
1) A warning about the inadmissibility of violating these Rules is the mildest type of disciplinary sanction applied to a higher education applicant in case of a minor violation by them of these Rules, norms of academic culture, ethical requirements, or requirements of other local regulatory documents of the University.
The purpose of applying a warning is the prevention of repeated violations, the formation of conscious responsibility, and encouragement to comply with behavioral norms, rather than punishment or humiliation of the higher education applicant.
A warning may be applied for isolated or minor violations that do not have significant negative consequences for other persons, the reputation, or property of the University, as well as for the first violation, unless a stricter measure is provided. Educational and upbringing measures may be assigned along with the warning.
2) The grounds for applying a reprimand may be:
- systematic or a single gross violation of these Rules;
- repeated skipping of classes without valid reasons;
- a gross manifestation of disrespect towards staff or other higher education applicants;
- violation of the rules of academic integrity (cheating, plagiarism, fabrication of results, use of other people's works without reference, etc.);
- violation of the norms of ethical behavior or rules of residence in the dormitory;
- public offensive statements on the grounds of national, linguistic, religious, or other discrimination;
- dissemination of misinformation that undermines the authority of the University or violates public order.
3) The grounds for expelling a higher education applicant may be:
- systematic non-fulfillment of the individual study plan or unsatisfactory learning results after passing the semester control;
- violation of academic integrity that is of a gross or repeated nature;
- committing unlawful acts provided for by the legislation of Ukraine;
- violation of contract terms (for higher education applicants studying at the expense of physical (legal) persons);
- participation in actions showing signs of collaborationism, including public approval or justification of armed aggression against Ukraine, dissemination of materials containing hostile propaganda or supporting occupation regimes, participation in events, organizations, or information campaigns directed against the state sovereignty, independence, or territorial integrity of Ukraine, calls for cooperation with occupation administrations or support of the aggressor;
- other cases directly provided for by the legislation of Ukraine as grounds for expelling an applicant.
6.5.3. Procedure for Applying Disciplinary Sanctions.
Facts that may indicate a violation by a higher education applicant are subject to documentation in internal memos, acts, reports, or materials of an internal investigation.
The decision to impose a disciplinary sanction is made by the Rector of the University based on a submission from the Dean of the Faculty or another official of the University, in accordance with the established procedure.
Before a decision is made, the higher education applicant is given the opportunity to explain the circumstances of the violation in writing or orally.
The decision to apply a disciplinary sanction is issued by an order of the Rector, with mandatory notification to the higher education applicant against acknowledgment of receipt (signature).
In case of disagreement, the applicant has the right to appeal the decision in accordance with the established procedure.
6.5.4. The University does not tolerate any forms of harassment, persecution, coercion, discrimination, humiliation of honor and dignity, or the creation of a hostile, tense, or humiliating atmosphere towards higher education applicants on the basis of their political views, religious beliefs, philosophical worldviews, national-cultural identity, civic or volunteer activities, provided that such activities and beliefs do not violate the current legislation of Ukraine, do not infringe upon the constitutional order, rights and freedoms of other persons, and do not show signs of propaganda of aggression against Ukraine, collaborationism, or assistance to the aggressor state. Public or private expression of positions, participation in permitted forms of civic activism, religious rites, civic or youth movements, participation in volunteer initiatives, associations, and civil society events in itself cannot be a ground for restricting access to educational services, deteriorating academic status, restricting rights, initiating disciplinary measures, or forming negative personal evaluations.
6.6. Application of Academic Sanctions.
6.6.1. In addition to disciplinary sanctions, academic sanctions may be applied to higher education applicants in case of violations of academic integrity, which is regulated by the Regulations on Academic Integrity and the Code of Academic Integrity of the University, in particular:
- annulment of evaluation results;
- the work (test, quiz, term paper, qualification paper, etc.) is considered unfulfilled;
- re-execution of the assignment / re-evaluation;
- the obligation to redo the work under separate conditions;
- lowering the grade / assigning an "unsatisfactory" / "fail" grade.
- mandatory completion of a course or training on academic integrity;
- participation in consultations on academic writing.
6.6.2. In the event of a proven violation of academic integrity rules by a higher education applicant, the following academic sanctions may be applied:
- deprivation or refusal of appointment of an academic stipend / prizes / grants (temporarily or until the next semester/evaluation);
- restriction of access to certain academic rights or opportunities, in particular, to participation in scientific competitions, international programs;
- annulment of the topic or rejection of the qualification work / project, if the violation concerns a thesis.
6.6.3. Academic sanctions are applied taking into account the principles of fairness, proportionality of the violation, transparency, and the right of the higher education applicant to explanation and appeal. The choice of sanction is made by the University administration, taking into account the severity, systematic nature, and consequences of the violation.
6.7. Assignment of Educational and Upbringing Measures.
6.7.1. Educational and upbringing measures are an integral element of the system for ensuring proper behavior, academic culture, and a socially responsible environment of the University.
The purpose of applying educational and upbringing measures is not to punish the higher education applicant, but to form responsible behavior, correct violations, develop self-reflection skills, and comply with University rules.
Educational and upbringing measures may be applied as an independent type of response or simultaneously with other measures provided for by internal documents, if this does not contradict the principle of proportionality.
6.7.2. Educational and upbringing measures may be assigned in the event of:
- violation of these Rules, rules of academic ethics, or culture of conduct;
- manifestations of disrespect towards participants in the educational process and/or University property;
- violation of safety standards, ethical standards of communication, dishonest or socially unacceptable behavior;
- one-time or minor violations that do not require the application of disciplinary sanctions.
6.7.3. The following measures of corrective and educational influence may be applied to a higher education applicant:
- an individual conversation with an official of the University, curator, mentor, or psychologist;
- participation in a training session, seminar, or consultation on issues of ethics, communication, psycho-emotional regulation, or non-violent behavior;
- completion of a reflective written assignment (essay, analytical note, self-correction plan);
- drawing up and implementing an individual behavior correction plan in agreement with an official of the University;
- involvement in volunteer, educational, or social initiatives of the University (with the consent of the higher education applicant and taking into account the principle of prohibition of forced labor);
- consultations and/or accompaniment by the psychological service of the University;
- other measures corresponding to the goals of corrective, educational influence that do not humiliate the dignity of the higher education applicant.
6.7.4. The decision to assign an educational and upbringing measure is made by the relevant official or body of the University after considering the established fact of violation and receiving explanations from the higher education applicant.
The higher education applicant has the right to provide oral and/or written explanations, proposals, comments, and alternative options for the measure that correspond to the purpose of correction.
6.8. When deciding on bringing a higher education applicant to disciplinary liability, applying academic sanctions, or assigning educational and upbringing measures, they have the right to:
- objective, impartial, and timely consideration of the circumstances of a possible violation;
- receipt of full and reliable information regarding the essence of the alleged violation, the content of evidence, and the proposed response measures;
- provision of oral and/or written explanations, additional materials, evidence, or objections;
- defense of their interests personally or through a legal representative, attorney, or another authorized person;
- participation in the meeting of the authorized body (commission) during the consideration of the issue, if provided for by internal documents;
- respect for honor and dignity, prevention of discrimination, pressure, and public disclosure of personal data;
- submission of proposals regarding the type and form of a possible response measure;
- familiarization with the adopted decision in written or electronic form;
- appeal of the adopted decision in accordance with the established procedure and deadlines.
7. Principles of Educational Process Organization
7.1. The University organizes and implements educational activities on a systematic and regulatory basis, guided by the provisions of internal regulations and acts that determine the order of the educational process functioning. In particular, educational activity is carried out in accordance with the Regulations on the Organization of the Educational Process, the Regulations on Rating Evaluation of Higher Education Applicants' Achievements by Educational Components, the Regulations on the Creation and Organization of the Work of the Examination (Attestation) Commission, as well as other local regulatory documents developed on the basis of the requirements of the current legislation of Ukraine. The regulatory and legal framework of educational activity consists of the Laws of Ukraine "On Higher Education", "On Education", "On Professional Pre-Higher Education", "On Professional Development of Employees", "On Scientific and Scientific-Technical Activity" and other legislative acts, Decrees of the President of Ukraine, resolutions and orders of the Cabinet of Ministers of Ukraine, orders, methodological recommendations, regulations of the Ministry of Education and Science of Ukraine regulating the requirements for the organization of the educational process, accreditation of educational programs, evaluation of learning outcomes, and quality assurance of education, as well as the University Charter and other regulatory and legal acts in the fields of higher education, employment, and social-labor relations. The organization of the educational process at the University is aligned with the recommendations, standards, and regulations applied in the single European Higher Education Area by the member countries of the Bologna Process and recognized by Ukraine, which ensures compliance of the University's educational programs with European quality criteria.
All participants in the educational process are obliged to comply with the requirements for ensuring gender equality in accordance with the Gender Equality Policy at the University, bear liability for violations of academic integrity, which is regulated by the Regulations on Academic Integrity and the Code of Academic Integrity of the University, and also adhere to the principles of inclusiveness, which include equality, accessibility, tolerance, and active participation of all members of society, in particular those who are in unfavorable conditions or have limitations of physical, mental, or other differences in order to eliminate physical, informational, and communication barriers.
Enrollment, expulsion, transfer, and reinstatement of applicants are carried out in accordance with the current legislation of Ukraine, the Admission Rules to the University, the Regulations on the Organization of the Educational Process at the University, these Rules, as well as other acts adopted at the University.
The rights and duties of postgraduate and doctoral students, as well as the procedure for their admission and expulsion, are regulated by the current legislation of Ukraine, the Admission Rules to Postgraduate and Doctoral Studies of the University, the Regulations on the Organization of the Educational Process at the University, these Rules, as well as other acts adopted at the University.
7.2. The main regulatory document that determines the organization of the educational process is the curriculum, which is drawn up on the basis of the educational program and the structural-logical scheme of training and determines the list and volume of mandatory and elective academic disciplines, the sequence of their study, specific forms of conducting training sessions and their volume, the schedule of the educational process, forms and means of conducting current and final control. Curricula are approved by the decision of the Academic Council of the University and are enacted by the order of the Rector.
Control over the development of curricula for the preparation of Doctor of Philosophy is carried out by the Department of Postgraduate and Doctoral Studies of the University.
7.3. Studying at the University is conducted in the following forms of higher education: full-time (daytime); distance; part-time (correspondence); dual. Forms of obtaining education can be combined.
The educational process at the University is carried out in the following forms: training sessions, independent work, practical training, research work, control measures.
The main types of training sessions are lectures, laboratory, practical, seminar, individual sessions, and consultations. The University has the right to establish other forms of the educational process and types of training sessions (training, round table, colloquium, etc.) depending on the need by the decision of the department that teaches the discipline.
Control measures are carried out in order to establish the level of mastery by the applicant of the theoretical material and the acquisition of practical skills provided for by the syllabi of academic disciplines taught at the University. All types of control measures and the organization of the process of evaluating the knowledge of higher education applicants are defined in the Regulations on Rating Evaluation of Higher Education Applicants' Achievements by Educational Components.
Academic deficiencies are liquidated during the semester control and holidays.
Within the framework of education quality analysis, separate monitoring activities (SMA) are conducted annually for each educational program:
‒ surveying higher education applicants at the end of the autumn semester;
‒ analysis of academic performance indicators, taking into account the scope of each educational component (the number of European Credit Transfer and Accumulation System (ECTS) credits allocated to the discipline) at the time of the end of the final control week.
7.4. Attestation of an applicant is the process of establishing the level of their knowledge, skills, and other competencies in accordance with the requirements of the educational program in the form of a qualification work (thesis/project), an attestation exam, and/or the Unified State Qualification Exam (USQE).
Attestation of applicants for the degree of Doctor of Philosophy is regulated by the relevant regulatory documents.
Departments have the right to deny admission to credit tests and exams in their disciplines to higher education applicants who have not completed and submitted the mandatory assignments, laboratory, and calculation-graphic works provided for by the program and curriculum.
7.5. The educational process at the University is conducted on a five-day week basis.
The student's workload is determined by the volume of ECTS credits required to obtain the appropriate degree of higher education under a specific educational program at a certain level of higher education, and includes classroom instruction, independent work, control measures, etc.
The accounting units of the applicant's study time are the ECTS credit, academic hour, school day, school week, academic semester, academic year, and academic course.
The academic year, except for graduating classes, lasts 12 months and usually begins on September 1, during which the applicant completes the corresponding part of the workload determined by the educational program and curriculum.
The academic year is divided into:
‒ two semesters (autumn and spring) of theoretical study;
‒ weeks of final and semester control (examination sessions);
‒ weekends, holidays;
‒ vacations.
An academic hour is the minimum accounting unit of study time. The duration of an academic hour at the University is 45 minutes. Two academic hours form a pair of academic hours (hereinafter referred to as a "pair"). A pair at the University lasts 95 minutes, including a five-minute break between the two halves of the pair. The break between the second and third pairs is 30 minutes. Teachers and applicants are notified of the beginning and end of pairs (breaks) by bells.
7.6. The schedule of training sessions is drawn up by the dispatch service of the educational and methodological support group of the University's Department of Quality of Education, Analytics, and Educational and Methodological Support in accordance with the educational process schedule for each specialty (specialization) and student group, and is brought to the attention of applicants and teachers no later than one week before the start of classes under the given schedule.
Exam schedules are approved and brought to the attention of applicants and teachers no later than two weeks before they begin.
Changes to the schedule of training sessions may be made in exceptional cases with the permission of the Vice-Rector for Scientific and Pedagogical Work.
Electronic versions of training session schedules must be mandatory posted on the University website.
Schedules of attestation exams and the schedule for defending qualification works (theses/projects) are drawn up by the respective faculty on the basis of the Regulations on the Creation and Organization of the Work of the Examination (Attestation) Commission.
Control over the implementation of the training session schedule during the academic semester, the schedules of attestation exams, and the schedule for defending qualification works (theses/projects) is carried out by the leadership of the University, faculties, departments, the analytics group, the educational and methodological support group of the Department of Quality of Education, Analytics, and Educational and Methodological Support, and the Academic Department of the University.
7.7. After the start of classes, silence and order, as well as appropriate sanitary and fire safety conditions necessary for a normal educational process, must be ensured in all classrooms and adjacent premises. Applicants are prohibited from entering the classroom after the bell until the break. It is unacceptable to interrupt classes, enter or leave the classroom during their conduct, or use personal electronic devices (media players, mobile phones, tablets, etc.) during classes.
The work of University employees and higher education applicants on University premises is additionally regulated by:
- in the Scientific and Technical Library of the University − the rules for using the library;
- in methodological rooms, educational and scientific laboratories, computer classes, etc. − occupational safety and health rules, fire safety rules, sanitary standards and rules, as well as instructions approved for these premises.
7.8. The educational and support staff of the department, before the start of each training session (and during breaks between them), prepares the necessary informational educational and methodological materials, didactic materials (tests, task options of various complexity, models of problem situations proposed for applicants to solve during the class), and equipment in classrooms, laboratories, educational workshops, and study rooms.
7.9. Practical and laboratory sessions are conducted in classrooms or educational laboratories equipped with the necessary technical teaching aids, computer equipment, on training complexes, or real objects using equipment adapted to the conditions of the educational process (laboratory models, installations, etc.) in accordance with the Regulations on the Organization of the Educational Process.
In the event of the introduction of a decision by order of the University to conduct the educational process using distance learning technologies, laboratory sessions may be conducted in the form of laboratory-calculation works based on laboratory data provided by the teacher.
7.10. Logbooks for tracking attendance and performance of higher education applicants in academic groups are the sole primary document certifying the conduct of classes and confirming the fulfillment of the workload by teachers; they also serve as a source of information on the current attendance and performance of applicants used to analyze and implement organizational measures aimed at improving the quality of the learning process. Keeping attendance and performance logbooks for academic groups by participants in the educational process is mandatory and is regulated by the Regulations on the Procedure for Keeping Attendance and Performance Logbooks for Students of Academic Groups and the Regulations on the Electronic Logbook for Tracking the Educational Work of Students of an Academic Group.
7.11. Applicants studying on a contractual basis at the expense of physical (legal) persons are obliged to strictly adhere to the payment deadlines specified in the contract. In the absence of valid reasons for violating the tuition payment deadlines, the University administration has the right to expel the higher education applicant from the University.
7.12. For non-fulfillment of duties and violation of these Rules, the Rector of the University has the right to impose a disciplinary sanction on an applicant or expel them from the University. Persons studying at the University may be expelled for the following reasons:
‒ at their own request;
‒ for failure to fulfill the curriculum;
‒ for violation of the terms of the contract concluded between the University and the higher education applicant or the physical (legal) person paying for such tuition;
‒ for appearing for classes in educational buildings, the library, the dormitory, and other University premises in a state of intoxication, as well as under the influence of drugs or toxic substances;
‒ under a court verdict that enters into legal force, or under a decision of a body whose competence includes imposing an administrative penalty or applying measures of public influence;
‒ for a one-time gross violation of educational discipline, these Rules, or the Internal Rules of the Dormitory (in agreement with the primary trade union organization);
‒ for attempting to give money or any other forms of material reward to a teacher or another employee of the University for passing a credit test, exam, or obtaining another grade;
‒ all other definitions, requirements, procedures, and consequences that arise upon a violation of academic integrity, in accordance with the Code of Academic Integrity and the Regulations on Academic Integrity of the University;
‒ in other cases provided for by legislation.
7.13. Upon graduation or expulsion from the University, in order to avoid outstanding liabilities and confirm the absence of possible claims from the University, the person who studied at the University must sign a clearance sheet according to the established form.
8. Incentives for Success in Work and Studies
8.1. Incentives are a form of moral and material stimulation for employees and higher education applicants of the University for conscientious fulfillment of official duties, significant results in professional activity, success in studies, scientific, research, creative, project, organizational, and public work.
8.2. The system of incentives is aimed at creating a motivating environment, developing initiative, enhancing academic culture, and forming a positive image of the University.
8.3. Incentives are applied on the basis of submissions from the heads of structural subdivisions, decisions of the Academic Council of the University / faculties, student self-government bodies of the University, primary trade union organizations of the University, or on the initiative of the University administration. The procedure for initiating and applying incentive awards is set forth in the Regulations on Incentive Awards of the University (approved by the decision of the Academic Council of the University, minutes No. 12 dated June 19, 2024, enacted from July 1, 2024, by order dated June 20, 2024, No. 265 (Revision No. 1), Appendix G5 to the Collective Agreement).
8.4. Types of Incentives for University Employees:
- commendation by the Rector;
- awarding of a certificate, certificate of honor, the badge of honor "For Merit", and the honorary award "Star of KhAI";
- bonuses for high achievements in professional activity;
- submission for state or departmental awards in accordance with the established procedure;
- provision of opportunities for professional development (participation in training sessions, professional development courses, etc.);
- provision of subsidized vacation packages;
- other forms of moral or material incentive determined by internal regulations.
8.5. Types of Incentives for Higher Education Applicants:
- commendation;
- awarding of a certificate, certificate of honor, the badge of honor "For Merit", and the honorary award "Star of KhAI";
- recommendation for participation in academic events (conferences, olympiads, competitions);
- bonuses or provision of material support in accordance with current regulations;
- submission of a petition for the award of a state, named, or special stipend;
- provision of additional academic mobility opportunities or preferences in selection for international cooperation programs;
- inclusion in the ranking of the best higher education applicants of the University;
- provision of subsidized vacation packages;
- other forms of incentive provided for by the regulations of the University.
8.6. Procedure for Applying Incentives.
The decision on incentive is made by the University administration in accordance with the established procedure based on petitions or submissions indicating the person's merits and the justification for the need to apply the appropriate form of incentive. Incentives are announced in an order and brought to the attention of the entire staff. Information about the applied incentive may be announced at meetings of the University Academic Council, the administration, etc., published on official resources of the University, and entered into the personal file of the employee or higher education applicant. When applying incentive measures, a combination of material and moral stimulation of labor is ensured.
8.7. The procedure and types of incentives may be specified and supplemented in accordance with changes in the current legislation of Ukraine, the Collective Agreement, and other local regulatory acts of the University.
9. Disciplinary Liability and Procedure for Applying Disciplinary Sanctions
9.1. Violation of labor discipline, that is, non-fulfillment or improper fulfillment by an employee of their labor duties provided for by legislation, the labor contract, the job (work) instruction, the Internal Labor Regulations, and other local acts of the University, entails the application of disciplinary sanctions or measures of public influence in the manner determined by the legislation of Ukraine.
9.2. For violation of labor discipline, the University administration has the right to apply the following disciplinary sanctions to the employee, as provided for in Article 147 of the Labor Code of Ukraine:
- reprimand;
- dismissal.
Dismissal as a disciplinary sanction may be applied in cases provided for by paragraphs 3, 4, 7, 8 of Article 40 and relevant provisions of Article 41 of the Labor Code of Ukraine.
The Rector of the University, in accordance with the procedure established by legislation, may dismiss an employee, in particular, for:
- systematic non-fulfillment, without valid reasons, of labor duties defined by legislation, the labor contract, the job (work) instruction, or the Internal Labor Regulations, if disciplinary or public sanctions were previously applied to the employee;
- absenteeism (including absence from the workplace for more than three hours during the working day) without valid reasons;
- appearing at work in a state of alcoholic, drug, or toxic intoxication or being in such a state during working hours;
- committing theft of the employer's property, including petty theft, established by a court verdict that has entered into force or by a decision of a competent authority;
- commission by an employee performing educational functions of an immoral offense incompatible with the continuation of work.
Immoral offenses, in particular, include:
- creating situations or conditions that shape in higher education applicants an understanding of the possibility of receiving a positive grade or another learning outcome in exchange for material or non-material goods;
- demanding or accepting money, gifts, or any other forms of reward from higher education applicants or third parties for passing a credit test, exam, assigning a grade, or other actions related to the educational process;
- participation in actions showing signs of collaborationism, including public approval or justification of armed aggression against Ukraine, dissemination of materials containing hostile propaganda or supporting occupation regimes, participation in events, organizations, or information campaigns directed against state sovereignty, independence, or territorial integrity of Ukraine, calls for cooperation with occupation administrations or support of the aggressor.
Dismissal may also be applied in other cases directly provided for by the labor legislation of Ukraine.
9.3. Disciplinary sanctions are applied by the Rector of the University upon submission from the heads of structural subdivisions, or on the initiative of the Rector.
9.4. Prior to the application of a disciplinary sanction, the University administration is obliged to request a written explanation from the employee.
In case of refusal of the employee to provide such an explanation, a relevant act is drawn up.
A disciplinary sanction is imposed directly after the discovery of the offense, but no later than one month from the day of its discovery, not counting the time of temporary disability of the employee or their being on leave.
A disciplinary sanction cannot be applied later than six months from the day the offense was committed (Article 148 of the Labor Code of Ukraine).
9.5. Only one disciplinary sanction can be applied for each violation of labor discipline.
9.6. When determining the type of disciplinary sanction, the degree of severity of the committed offense, its causes, the circumstances under which it was committed, the employee's behavior, and their previous work are taken into account.
9.7. The disciplinary sanction is issued by an order of the Rector and is announced to the employee against acknowledgment of receipt within a three-day period.
The order on the application of a disciplinary sanction may be brought to the attention of the staff in accordance with the procedures established at the University.
9.8. If within a year from the day of imposing the disciplinary sanction the employee has not been subjected to a new disciplinary sanction, they are considered as not having had a disciplinary sanction.
The sanction may be lifted prematurely by an order of the Rector if the employee does not commit new violations of labor discipline and proves themselves to be a conscientious worker.
10. Requirements for Conduct on the Premises and Territory of the University
10.1. The norm of behavior for persons on the premises and territory of the University is adherence to the following principles:
- mutual goodwill, demandingness, and respect between people, honoring the personal dignity of a individual, their beliefs, and the good name of the University;
- respect for the cultural-national, spiritual, and historical values of Ukraine;
- conscientious attitude towards studies and work;
- careful attitude towards the facilities, territory, and property of the University.
10.2. In order to create a scientific and business atmosphere at the University during the educational and working process, ensure compliance with sanitary and hygienic standards, and foster aesthetic taste and dress culture, employees and higher education applicants are recommended to adhere to the rules of business communication and business dress code, namely: to wear clean, fresh, and ironed clothing that complies with generally accepted standards of business style in society.
10.3. On the premises of the University, it is not considered acceptable:
- to walk around in outerwear, headwear, shorts, or beachwear;
- to talk loudly, make noise, or run along the corridors during classes;
- to open doors and enter classrooms during classes, take off outerwear in classrooms, or use mobile phones, radio receivers, etc., during classes;
- to litter or deface the premises, in particular, sticking chewing gum, scratching or writing on walls and desks, etc.;
- to enter the office premises of structural subdivisions without authorization;
- to enter classrooms with food or drinks;
- to sing or play musical instruments during the educational process.
10.3. On the premises and territory of the University, it is prohibited:
- to be in a state of alcoholic, drug, or other intoxication;
- to consume low-alcohol, alcoholic, and strong alcoholic beverages;
- to smoke;
- to store and use narcotic and toxic substances, as well as hookahs and other smoking devices;
- to gamble;
- to store and use firearms, traumatic, pneumatic, and cold weapons;
- to instigate fights and other actions showing signs of an administrative offense or a criminal offense;
- unethical, immoral behavior, including profanity;
- to place outdoor advertising in any way, including on information stands (boards) located on the territory and premises of the campus and the University, without prior written permission from the University administration or the campus administration;
- to stay on the territory of the University after 19:00 without a special permit;
- to conduct political or religious campaigning;
- to organize mass events on the premises of the University without permission from the administration;
- to bring pets into the territory or premises of the University;
- to commit other actions that violate the current legislation of Ukraine.
11. Ensuring Order on University Premises
11.1. Responsibility for the organization of works on the improvement of educational premises (availability of serviceable furniture, educational equipment, compliance with relevant temperature and lighting standards, etc.) is borne by the Vice-Rector for Administrative and Economic Activities of the University.
11.2. Heads of departments and heads of subdivisions within their functional duties bear personal responsibility for the preservation of property, instruments, and equipment on the premises assigned to the respective departments and structural subdivisions.
11.3. The protection of buildings and property, as well as responsibility for their fire safety and sanitary condition, are assigned by order of the Rector to the relevant officials of the University subdivisions.
11.4. Keys to educational premises, classrooms, laboratories, and offices must be kept by the officer on duty of the building security department and issued according to lists compiled by heads of departments and heads of divisions and services.
12. Specifics of Organizing the Educational Process and Other Activities of the University During Martial Law and the Period of Quarantine Restrictions
12.1. General Provisions on the Organization of the Educational Process and Other Activities of the University During Martial Law and the Period of Quarantine Restrictions.
12.1.1. During the validity of martial law or the introduction of quarantine restrictions, the University ensures the continuity of the educational process, respect for the rights and safety of all participants in the educational environment, and adaptation of organizational processes in accordance with the current legislation of Ukraine and official decisions of state authorities.
12.1.2. The operating mode, form of organization of the educational process, and other types of activities of the University may be changed (transferred to a distance or mixed form using asynchronous and synchronous learning formats, using LMS (learning management systems, in particular, Mentor), video conferences, and other means of distance interaction) in accordance with the security situation and technical capabilities by decision of the University administration, followed by official notification of higher education applicants and employees.
12.1.3. All participants in the educational process are obliged to comply with safety standards, official notices, instructions, and action algorithms determined by the University. Higher education applicants are required to attend training sessions in the specified form, and teachers must ensure the proper organization of teaching and evaluation of learning outcomes.
12.1.4. The forms and terms of final and current evaluation may be changed by decision of the Rector and the Academic Council of the University in order to ensure objectivity and accessibility. It is possible to postpone or re-conduct certain types of evaluation for applicants who could not participate for objective reasons related to security or medical restrictions.
12.1.5. The University may implement special individual educational trajectories, academic leaves, interruption of studies, temporary transfer, or other adaptive mechanisms.
12.2. Organization of Safety and Communications.
12.2.1. In the event of an air raid alert declaration, danger, or other emergency circumstances, all participants in the educational process, in particular those who are directly at the University, are obliged to immediately relocate to shelters or safe zones in accordance with the University's instructions.
12.2.2. The teacher (head of subdivision) must:
- notify the participants of the educational process (higher education applicants, University employees) about the threat and stop the training session (work);
- organize the movement of higher education applicants (University employees) into the shelter according to the evacuation plan to the shelter approved for the University;
- turn off lights, electrical appliances, and equipment in the room;
- coordinate the relocation of educational process participants and employees to the shelter;
- explain to the higher education applicants present at the class in a mixed offline mode the necessity to proceed to the shelter, and to the higher education applicants present online, suggest moving to a safe place if necessary;
- if technically possible, continue the class in the shelter; if there is no such possibility, remain in the shelter together with the participants of the educational process until the end of the air raid alert, record the interrupted pair, and upload the video recording and presentation to the relevant section of the course on the Mentor platform;
- if during the air raid alert there are no offline higher education applicants present at the pair, make a video recording of the lecture and, after the all-clear signal, upload the video recording of the class to the relevant section of the course on the Mentor platform;
- everyone must take personal protective equipment (if available), documents, and personal belongings.
12.2.3. Participants in the educational process and employees who are in the courtyard of the University or in the corridors during the "Air Raid Alert" signal must move to the shelter independently.
12.2.4. In the shelter, the teacher (head of subdivision) must check the presence of the participants of the educational process (employees), and help the participants of the educational process and employees to quickly and calmly take the available seats.
12.2.5. During relocation to the shelter, the presence of persons with disabilities or other less mobile persons must be taken into account. In the case of the presence of less mobile higher education applicants, conduct training and conversations with them in advance, and provide for their rapid and calm relocation.
12.2.6. During the stay in the shelter, responsible persons provide the necessary support to all participants in the educational process and control over order.
12.2.7. After the announcement of the "All-Clear Signal":
- the teacher (head of subdivision) ensures the exit from the shelter of all participants in the educational process;
- the educational process (work) is resumed.
12.2.8. After the end of the alert and the announcement of the all-clear signal, teachers and responsible persons ensure that the exit of all educational process participants and employees from the shelter is carried out calmly and in an organized manner.
12.2.9. In the event of threats, training sessions may be suspended, postponed, continued exclusively in a distance format, or deferred.
12.2.10. Official communications regarding changes in the organization of educational and working processes due to security circumstances are carried out through the electronic channels of the University (official website, corporate email, information platforms).
12.3. Psychological, Informational, and Social Support.
12.3.1. The University facilitates the provision of access to psychological, advisory, and informational support for higher education applicants and University employees, including online services.
12.3.2. Special attention is paid to higher education applicants who are internally displaced persons, located in the combat zone, or face other difficult circumstances.
12.4. This section remains in force throughout the entire period of the legal regime of martial law or established state quarantine restrictions and may be promptly amended by decision of the University administration. All matters not regulated by this section shall be resolved on the basis of the current legislation of Ukraine, orders of the Rector, and local regulatory acts of the University governing the activities of the University during a special period.
13. Final Provisions
13.1. The draft Rules were developed by the Legal Department, verified by the Human Resources Department, and visaed by the Center for Quality of Education, Licensing, and Accreditation, the Internal Audit Department, the Occupational Safety and Health Department, the Department of Emergency Situations and Civil Protection, and the Office of Equality, Inclusion, and Safe Environment of the University.
13.2. The Rules shall enter into force upon their approval by the Rector of the University following their endorsement at the conference of the University's labor collective, upon prior agreement with the primary trade union organizations of the University and the Student Council of the University.
13.3. After approval, the Rules shall be published on the official website of the University. The Rules or excerpts from them may also be posted in the subdivisions of the University.
13.4. Dean's offices and departments shall bring the content of Sections 1, 6−8, and 10-12 of these Rules to the attention of all higher education applicants at meetings of groups, streams, and courses.
13.5. In the event of amendments to the regulatory acts of Ukraine governing the relations defined in these Rules, the norms of the legislation of Ukraine shall apply until the relevant amendments are made to these Rules.
If the updated version of the Collective Agreement provides for changes and supplements to specific paragraphs and sections of these Rules, the norms of the updated version of the Collective Agreement shall apply until the relevant amendments are made to these Rules.
13.6. In all matters not reflected in these Rules, it is necessary to be guided by the current legislation of Ukraine.
