1. General Provisions
1.1. The Model Regulation on Advisory Bodies (hereinafter – Model Regulation) of the National Aerospace University "Kharkiv Aviation Institute" (hereinafter – the University) was developed in accordance with the Laws of Ukraine "On Education" dated 05.09.2017 No. 2145-VIII, "On Higher Education" dated 01.07.2014 No. 1556-VII, the University Charter (hereinafter – the Charter), and regulates the general organizational and management principles of the functioning of University advisory bodies, which are established by the Rector on a voluntary basis.
1.2. This Model Regulation, as well as changes and amendments to it, are considered and approved by the University Academic Council and implemented by an order of the University Rector.
1.3. In accordance with Part 2, Article 38 of the Law of Ukraine "On Higher Education" and Paragraph 7 of Clause 6.5 of the University Charter, the University’s advisory (consultative) bodies may include: the Employers' Council, Investors' Council, Business Council, Student Council, Scientific Council, as well as other advisory (consultative) bodies established in the prescribed manner in accordance with this Model Regulation.
1.4. The regulation on the relevant advisory (consultative) body (hereinafter – advisory body) is approved by the University Academic Council.
1.5. The advisory body is intended to promote the consolidation of efforts of all departments, management bodies, and self-governing bodies of the University, as well as all employees and students, in realizing the educational, scientific, and innovative mission of the University. The advisory body may act as a collective expert (advisor) on specific issues of the University's activities.
1.6. In its activities, the advisory body must be guided by the current legislation of Ukraine, the University Charter, this Model Regulation, and the regulation on the specific advisory body. Proposals, conclusions, and recommendations of the advisory body have an advisory and consultative character and are used by the University management bodies when making decisions within the scope of their own powers.
2. Creation of an Advisory Body
2.1. The advisory body is established by an order of the University Rector, which specifies the justification for the creation of the relevant advisory body, its goal, tasks, directions of activity, as well as its personal composition and the means of organizational support for the advisory body's activities (allocation of appropriate premises, etc.). The University Rector ensures the creation of proper conditions for the work of the advisory body, provides the information and documents necessary for performing the tasks assigned to it, as well as separate premises suitable for work, and ensures the availability of necessary communication facilities, office equipment, etc., in such premises.
2.2. Representatives of employers, investors, other University counterparties, leading experts in the educational and scientific fields, as well as full-time staff, students, post-graduate students, and doctoral candidates of the University may be included in the advisory body (with their consent).
2.3. The start of the advisory body’s activities may be preceded by the approval of the regulation on the relevant advisory body by the University Academic Council. In the event that an advisory body is created before the regulation on it is approved by the University Academic Council, this regulation must be prepared and submitted for approval within a period of no later than 2 months from the moment of the advisory body's creation, unless another period is established in the University Rector's order on the creation of the advisory body.
2.4. Persons involved in the work of the advisory body perform their duties on a voluntary basis.
3. Organization of the Advisory Body’s Work
3.1. The advisory body operates on the principles of self-government, collegiality, and respect for the achievements and traditions of the University.
3.2. The goal of the advisory body’s activities, in accordance with Part 2, Article 38 of the Law of Ukraine "On Higher Education" and Paragraph 7 of Clause 6.5 of the University Charter, may be the development of a strategy and directions for the University’s educational and/or scientific activities.
3.3. Depending on the goal, tasks, and directions of activity, the work of the advisory body may be of a permanent, periodic, or temporary nature. The personal composition of the advisory body may be changed on the initiative of the University Rector, upon the personal application of a person involved in the work of the advisory body (with the exception of full-time University staff), or upon the application of the advisory body's management body.
3.4. Forms of the advisory body’s work may include: holding meetings on University premises, creating working groups to prepare specific issues, discussing issues via video conferencing, processing proposals, conclusions, and recommendations online, etc. The list of specific forms and the frequency of the advisory body's work are determined by the body itself.
3.5. At its first meeting, which is held on University premises, the advisory body determines its own structure, forms of work, and elects the management bodies of the advisory body. The University Rector and the Head of the University Academic Council have the right to participate in the work of the advisory body. The elected head of the advisory body has the right to involve relevant University specialists in the work of the advisory body (on a voluntary basis) and to receive necessary information from University structural units.
3.6. Persons involved in the work of the advisory body must responsibly perform duties related to such work, must not disclose information that is brought to the attention of the advisory body as information with limited access, and must not allow a conflict of interest between their activities as a member of the advisory body and their activities at their place of work.
3.7. When planning its work, the advisory body must take into account the deadlines for preparation and development of issues assigned as tasks to this advisory body (if such deadlines are specified in the Rector's order on the creation of the advisory body), as well as deadlines related to annual events that affect the educational process at the University. It must also consider the necessary time for preliminary collegial discussion and processing of proposals created by the advisory body for inclusion in draft decisions or local regulatory acts that will be submitted for consideration by the Rector, the University Academic Council, the general meeting of the labor collective, or other University management (self-governance) bodies.
3.8. The result of the advisory body's work in a specific direction or in the fulfillment of specific tasks is the proposals, conclusions, recommendations, etc. (hereinafter – proposals) prepared (developed) by it. The advisory body’s proposals are drawn up in writing and signed by the head (and secretary, if applicable) of the advisory body. Persons involved in the work of the advisory body have the right to attach their own separate opinion to the advisory body’s proposals, which must be drawn up in writing and signed by the person.
3.9. Proposals of the advisory body (including separate opinions of persons involved in the work of the advisory body) are submitted to the University Rector.
3.10. The consideration of the advisory body’s proposals by the Rector, the Academic Council, or the conference of the University labor collective is carried out as a priority.
3.11. Current documentation created (accumulated) during the preparation (development) of proposals for a specific direction or the fulfillment of specific tasks of the advisory body, after the submission of the proposals, is transferred by the head and secretary (if applicable) of the advisory body to the University's records and archives department in the established manner.
4. Final Provisions
4.1. This Model Regulation is adopted by the University Academic Council and implemented by an order of the University Rector.
4.2. Changes and/or additions to this Model Regulation are made in the order established for its adoption.
